Citation, commencement and application1.

This Order may be cited as the Local Government (Best Value) Performance Plans and Reviews (Amendment) (England and Wales) Order 2003 and shall come into force on 3rd April 2003.

This Order applies—
(a)
in relation to England, to all best value authorities; and
(b)
Amendments to Order2.

Articles 3 and 4 are revoked.

In article 6(1)(f), after “consult”, insert “recognised trade unions, organisations representing staff engaged in the exercise of the function, staff engaged in the exercise of the function and”.

This Order amends the Local Government (Best Value) Performance Plans and Reviews Order 1999 “the 1999 Order”, which relates to Best Value reviews and performance plans.
Article 2(2) revokes the existing requirements of the 1999 Order as to the matters that must be included in the performance plan that a Best Value authority is required to prepare.
Article 2(3) extends the consultation requirements in article 6 of the 1999 Order to include a requirement on Best Value authorities, in reviewing a function, to consult recognised trade unions and employees' associations representing staff and with staff engaged in that function.
