The Private Hire Vehicles (London) Act 1998 (Commencement No. 2) Order 2003

The Secretary of State for Transport, in exercise of the power conferred by section 40(2) of the Private Hire Vehicles (London) Act 1998(1), hereby makes the following Order—

Citation and interpretation

1.—(1) This Order may be cited as the Private Hire Vehicles (London) Act 1998 (Commencement No. 2) Order 2003.

(2) In this Order—

“the Act” means the Private Hire Vehicles (London) Act 1998;

“the first appointed day” means 1st April 2003;

“the second appointed day” means 1st June 2003; and

“the third appointed day” means 1st April 2006.

Commencement of provisions of the Private Hire Vehicles (London) Act 1998

2.—(1) The following provisions of the Act shall come into force on the first appointed day—

(a)section 13(1), (2)(a) and (4) to (7);

(b)section 13(2)(b), except so far as it relates to the requirement mentioned in section 13(3); and

(c)sections 14(1), (2) and (4), 15(4), 16(4) and 22(3).

(2) The following provisions of the Act shall come into force on the second appointed day—

(a)sections 12(1) to (6), 14(3) and (5) and 31; and

(b)so much of section 39(2) as relates to the entries in Schedule 2 for section 4 of the London Cab Act 1968(2), the Broadcasting Act 1990(3) and the Transport and Works Act 1992(4).

(3) Section 13(2)(b) of the Act so far as it is not already in force, and section 13(3) shall come into force on the third appointed day in relation to applications for London PHV drivers' licences received by Transport for London on or after that day.

Explanatory Note

(This note is not part of the Order)

This Order brings into force provisions of the Private Hire Vehicles (London) Act 1998 relating to the licensing of drivers and the provisions relating to advertisements including the words “taxi” and “cab” and similar words.
