<Text>These Regulations may be cited as the Guardian’s Allowance (General) Regulations 2003 and shall come into force on 7th April 2003 immediately after the commencement of section 49 of the Tax Credits Act 2002.</Text>

RestrictStartDate="2006-04-10"><Title>Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/2" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/2" id="regulation-2"><Pnumber><CommentaryRef Ref="key-88b361f5f6535f3f8b7df29dde507a68"/>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/2/1" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/2/1" id="regulation-2-1"><Pnumber>1</Pnumber><P2para><Text>In these Regulations –</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Abbreviation Expansion="Social Security Contributions and Benefits Act 1992 c. 4">the Act</Abbreviation>” means the Social Security Contributions and Benefits Act 1992;</Text></Para></ListItem><ListItem><Para><Text>“adopted” means adopted pursuant to –</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>an order made in the United Kingdom, the Channel Islands or the Isle of Man;</Text></Para></ListItem><ListItem><Para><Text>an overseas adoption within the meaning of section 72(2) of the Adoption Act 1976<FootnoteRef Ref="f00004"/>;</Text></Para></ListItem><ListItem><Para><Text>a Convention adoption order within the meaning of section 72(1) of the Adoption Act 1976<FootnoteRef Ref="f00005"/>; or</Text></Para></ListItem><ListItem><Para><Text>a foreign adoption order within the meaning of section 4(3) of the Adoption (Hague Convention) Act (Northern Ireland) 1969<FootnoteRef Ref="f00006"/>.</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Abbreviation Expansion="Commissioners of Inland Revenue">the Board</Abbreviation>” means the  <Substitution ChangeId="key-9e2eae7e2ea5c4de0d98a58309c3fc29-1742813031125" CommentaryRef="key-9e2eae7e2ea5c4de0d98a58309c3fc29">Commissioners for Her Majesty’s Revenue and Customs</Substitution>;</Text></Para></ListItem><ListItem><Para><Text>“the <Abbreviation Expansion="Social Security Contributions and Benefits (Northern Ireland) Act 1992 c. 7">Northern Ireland Act</Abbreviation>” means the Social Security Contributions and Benefits (Northern Ireland) Act 1992.</Text></Para></ListItem></UnorderedList></P2para></P2></P1para></P1></P1group>
<P1group RestrictStartDate="2025-04-07" RestrictExtent="E+W+S+N.I."><Title>Modification to section 77(2) of the Act</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/3" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/3" id="regulation-3"><Pnumber><CommentaryRef Ref="key-53a47f381f684e7cbf0ded16e70b8ca4"/>3</Pnumber><P1para><Text>Section 77(2) of the Act and section 77(2) of the Northern Ireland Act shall be treated as modified where  <Substitution ChangeId="key-1709ab28c37aefbe37a919c97554fa36-1746013934453" CommentaryRef="key-1709ab28c37aefbe37a919c97554fa36">regulation 4 applies</Substitution>.</Text></P1para></P1></P1group>
<P1group RestrictExtent="E+W+S+N.I." RestrictStartDate="2006-04-10"><Title>Adopted children</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/4" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/4" id="regulation-4"><Pnumber><CommentaryRef Ref="key-5fbdc9ec8295fbae0704ef407116acd7"/>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/4/1" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/4/1" id="regulation-4-1"><Pnumber>1</Pnumber><P2para><Text>Where a child <Addition ChangeId="key-f92105c50c02d7cced3d72472d590167-1742813992144" CommentaryRef="key-f92105c50c02d7cced3d72472d590167">or a qualifying young person</Addition>  has been adopted by two persons jointly, a reference in section 77(2) of the Act or section 77(2) of the Northern Ireland Act to  <Substitution ChangeId="key-43cf107fcda405dc637097b16f86ebf4-1742814086157" CommentaryRef="key-43cf107fcda405dc637097b16f86ebf4">the parents of the child or qualifying young person</Substitution>  shall be read as a reference to those two persons.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/4/2" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/4/2" id="regulation-4-2"><Pnumber>2</Pnumber><P2para><Text>Where a child <Addition ChangeId="key-e1f3702c2e05e16dd36e88bbcbdcf673-1742814840327" CommentaryRef="key-e1f3702c2e05e16dd36e88bbcbdcf673">or qualifying young person</Addition>  has been adopted by one person only, the circumstances to be satisfied in section 77(2) of the Act or section 77(2) of the Northern Ireland Act are that that person is dead.</Text></P2para></P2></P1para></P1></P1group>

<P1group RestrictStartDate="2020-12-01" RestrictExtent="E+W+S+N.I."><Title>Circumstances in which a person is to be treated as being in prison</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7" id="regulation-7"><Pnumber><CommentaryRef Ref="key-0d997c41c60530af6b70cf9cb9bcc2d4"/>7</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7/1" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7/1" id="regulation-7-1"><Pnumber>1</Pnumber><P2para><Text>The circumstances in which a person is to be treated as being in prison for the purposes of section 77 of the Act or section 77 of the Northern Ireland Act are that he is –</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7/1/a" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7/1/a" id="regulation-7-1-a"><Pnumber>a</Pnumber><P3para><Text>serving a custodial sentence within the meaning of section 76 of the Powers of Criminal Courts (Sentencing) Act 2000<FootnoteRef Ref="f00009"/>,  <Addition ChangeId="key-f443064b4058f3f00ddf0e5e0caad1c4-1746013519172" CommentaryRef="key-f443064b4058f3f00ddf0e5e0caad1c4">section 222 of the Sentencing Code or</Addition> Article 2(2) of the Criminal Justice (Northern Ireland) Order 1996<FootnoteRef Ref="f00010"/> or a sentence of detention or imprisonment within the meaning of section 307(1) of the Criminal Procedure (Scotland) Act 1995<FootnoteRef Ref="f00011"/>,  <Substitution ChangeId="key-8e41d748a53b5e493b4e3a81c2ae817c-1746012574251" CommentaryRef="key-8e41d748a53b5e493b4e3a81c2ae817c">of at least 2 years and the other parent is deceased</Substitution>; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7/1/b" id="regulation-7-1-b"><Pnumber>b</Pnumber><P3para><Text>detained in a hospital by order of the court under –</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7/1/b/i" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7/1/b/i" id="regulation-7-1-b-i"><Pnumber>i</Pnumber><P4para><Text>section 37(1)<FootnoteRef Ref="f00012"/>, 38, or 45A<FootnoteRef Ref="f00013"/> of the Mental Health Act 1983;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7/1/b/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7/1/b/ii" id="regulation-7-1-b-ii"><Pnumber>ii</Pnumber><P4para><Text>section 5 of the Criminal Procedure (Insanity) Act 1964<FootnoteRef Ref="f00014"/>;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7/1/b/iii" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7/1/b/iii" id="regulation-7-1-b-iii"><Pnumber>iii</Pnumber><P4para><Text>section 6 or 14 of the Criminal Appeal Act 1968<FootnoteRef Ref="f00015"/>;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7/1/b/iv" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7/1/b/iv" id="regulation-7-1-b-iv"><Pnumber>iv</Pnumber><P4para><Text>section 57, <Addition ChangeId="key-9472bc16b92e27ffbe48b41e289f172d-1741687783427" CommentaryRef="key-9472bc16b92e27ffbe48b41e289f172d" Extent="E+W+S+N.I.">57A</Addition>  or 59A of the Criminal Procedure (Scotland) Act 1995<FootnoteRef Ref="f00016"/>;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7/1/b/v" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7/1/b/v" id="regulation-7-1-b-v"><Pnumber>v</Pnumber><P4para><Text>Article 44, 45, 50A, or 51(2) and (3) of the Mental Health (Northern Ireland) Order 1986<FootnoteRef Ref="f00017"/>; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7/2/b" id="regulation-7-2-b"><Pnumber>b</Pnumber><P3para><Text>include any period spent in custody immediately prior to sentencing, save that where he is serving a custodial sentence or sentence of detention or imprisonment with the meaning of paragraph (1)(a) above immediately prior to sentencing, include only such period of that sentence as remains following sentencing for the later sentence,</Text></P3para></P3><Text>but nothing in this paragraph shall permit the payment of guardian’s allowance in respect of any period in custody prior to sentencing.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7/3" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7/3" id="regulation-7-3"><Pnumber>3</Pnumber><P2para><Text>Subject to paragraph (4) below, a person shall not cease to be treated as being in prison in accordance with paragraph (1) above by virtue of the fact that he is temporarily released, unlawfully at large, or, in the case of a person serving a sentence, transferred to a hospital.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7/4" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7/4" id="regulation-7-4"><Pnumber>4</Pnumber><P2para><Text>A person serving a sentence in accordance with paragraph (1)(a) above shall cease to be treated as being in prison in accordance with that paragraph where –</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7/4/a" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7/4/a" id="regulation-7-4-a"><Pnumber>a</Pnumber><P3para><Text>he is released on licence, the remainder of his sentence is remitted, his sentence is reduced on appeal to a term of less than 2 years, or his conviction is quashed on appeal; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7/4/b" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7/4/b" id="regulation-7-4-b"><Pnumber>b</Pnumber><P3para><Text>he is not in custody and has not been in custody for a period at least equal to the remaining period of his sentence,</Text></P3para></P3><Text>but that where a person to whom sub-paragraph (b) applies returns to prison to serve the remainder of the sentence, the length of the sentence for the purposes of paragraph (1)(a) above shall be the period of the remainder of the sentence.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/7/5" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/7/5" id="regulation-7-5"><Pnumber>5</Pnumber><P2para><Text>This regulation shall apply, subject to the necessary modifications, to a parent who is outside Great Britain or Northern Ireland and serving a custodial sentence with not less than 2 years remaining from the death of the other parent or detained in a hospital by a court order.</Text></P2para></P2></P1para></P1></P1group>
<P1group RestrictExtent="E+W+S+N.I." RestrictStartDate="2006-04-10"><Title>Rate of allowance and payment to the National Insurance Fund or the Northern Ireland National Insurance Fund</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/8" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/8" id="regulation-8"><Pnumber><CommentaryRef Ref="key-c474dc8404cf16773b39351e594cc0d4"/>8</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/8/1" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/8/1" id="regulation-8-1"><Pnumber>1</Pnumber><P2para><Text>Where a person treated as being in prison for the purposes of section 77 of the Act or section 77 of the Northern Ireland Act contributes to the cost of providing for a child <Addition ChangeId="key-7eec63323c025613926b91f034df4869-1742816981820" CommentaryRef="key-7eec63323c025613926b91f034df4869">or qualifying young person</Addition>, the weekly rate of any guardian’s allowance payable shall be reduced by the amount of the contribution made in the week preceding the week for which any allowance is payable.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/8/2" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/8/2" id="regulation-8-2"><Pnumber>2</Pnumber><P2para><Text>In a case where entitlement to guardian’s allowance is established by reference to a person being in prison, that person shall, on notice being given by the Board, pay to the National Insurance Fund or the Northern Ireland National Insurance Fund an amount equal to that paid by way of guardian’s allowance.</Text></P2para></P2></P1para></P1></P1group>
<P1group RestrictStartDate="2025-04-07" RestrictExtent="E+W+S+N.I."><Title>Residence condition</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/9" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/9" id="regulation-9"><Pnumber><CommentaryRef Ref="key-db56365b694f07e69ce4ba5b137c20de"/>9</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/9/1" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/9/1" id="regulation-9-1"><Pnumber>1</Pnumber><P2para><Text>There shall be no entitlement to guardian’s allowance in respect of a child <Addition ChangeId="key-d24602162528769311b2fc91b1a862b2-1742818347283" CommentaryRef="key-d24602162528769311b2fc91b1a862b2">or qualifying young person</Addition>  unless at least one of  <Substitution ChangeId="key-2600121554511395e7a0357221ab103a-1742818384568" CommentaryRef="key-2600121554511395e7a0357221ab103a">the parents of that child or qualifying young person</Substitution>  –</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/9/1/a" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/9/1/a" id="regulation-9-1-a"><Pnumber>a</Pnumber><P3para><Text>was born in the United Kingdom <Addition ChangeId="key-acadca50512a45eb843a640bd74377bb-1746012743177" CommentaryRef="key-acadca50512a45eb843a640bd74377bb">an EEA state or Switzerland</Addition>; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/9/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/9/1/b" id="regulation-9-1-b"><Pnumber>b</Pnumber><P3para><Text>at the date of death of the parent whose death gives rise to the claim for guardian’s allowance, has, in any two year period since the age of 16, spent at least 52 weeks of that period in Great Britain or Northern Ireland, as the case may require.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/9/2" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/9/2" id="regulation-9-2"><Pnumber>2</Pnumber><P2para><Text>For the purposes of paragraph (1)(b) above, a person shall be treated as being present in Great Britain or Northern Ireland (as the case may require) where –</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/9/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/9/2/a" id="regulation-9-2-a"><Pnumber>a</Pnumber><P3para><Text>his absence is by virtue of his employment –</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/9/2/a/i" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/9/2/a/i" id="regulation-9-2-a-i"><Pnumber>i</Pnumber><P4para><Text>as a serving member of the forces within the meaning of regulation 140 of the Social Security (Contributions) Regulations 2001<FootnoteRef Ref="f00019"/>;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/9/2/a/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/9/2/a/ii" id="regulation-9-2-a-ii"><Pnumber>ii</Pnumber><P4para><Text>as an airman within the meaning of regulation 111 of those Regulations; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2003/495/regulation/9/2/a/iii" IdURI="http://www.legislation.gov.uk/id/uksi/2003/495/regulation/9/2/a/iii" id="regulation-9-2-a-iii"><Pnumber>iii</Pnumber><P4para><Text>as a mariner within the meaning of regulation 115 of those Regulations; <Text>These Regulations make provisions in respect of guardian’s allowance.</Text>
</P>
<P>
<Text>Regulation 1 provides for the commencement and citation of these Regulations, and Regulation 2 for the interpretation of certain terms used in them.</Text>
</P>
<P>
<Text>Regulations 3 to 6 modify, in cases where a child is adopted, illegitimate, or of divorced parents, the circumstances in section 77(2) of the Social Security Contributions and Benefits Act 1992 (“the Act”) or section 77 of the Social Security Contributions and Benefits (Northern Ireland) Act 1992 (“the Northern Ireland Act”) which must be satisfied before a person is entitled to claim guardian’s allowance in respect of that child.</Text>

<P>
<Text>Regulation 7 prescribes the circumstances in which a person is to be treated as being in prison for the purposes of section 77 of the Act or section 77 of the Northern Ireland Act.</Text>
</P>
<P>
<Text>Regulation 8(1) provides for the rate of guardian’s allowance to be reduced by reference to the contributions of a person in prison. Regulation 8(2) provides for a person in prison to reimburse the National Insurance Fund or the Northern Ireland National Insurance Fund in respect of sums paid by way of guardian’s allowance.</Text>

<Text>Regulation 9 prescribes conditions as to place of birth and residence, of which at least one must be satisfied by at least one of a child’s parents before a person is entitled to claim guardian’s allowance in respect of that child. Regulation 9(3) modifies this requirement where a child is adopted, and Regulation 9(4) modifies this requirement where a child is illegitimate.</Text>

<Text>Regulation 10 prescribes the manner in which a wife may elect for any payment of guardian’s allowance not to be made to her husband.</Text>
