Section 39(3) (prohibition of certain air weapons) of the Anti-social Behaviour Act 2003 shall, subject to paragraph (2), to the extent not already in force come into force on 30th April 2004.

Section 1(1)(a) of the Firearms Act 196810 shall not apply to a person who has in his possession any air rifle, air gun or air pistol which uses, or is designed or adapted for use with, a self-contained gas cartridge system where he has applied before 30th April 2004 for a firearm certificate under Part 2 of that Act and either that application is still being processed or any appeal in respect of it has not been determined.
