The National Lottery (Licence Fees) (Amendment) Order 2003

Coming into force
The Secretary of State, in exercise of the powers conferred upon her by sections 7(5) and 60(4) of the National Lottery etc. Act 19931, hereby makes the following Order:
Citation and commencement1
This Order may be cited as the National Lottery (Licence Fees) (Amendment) Order 2003 and shall come into force on 25th November 2003.
Fees for licences under section 6 of the National Lottery etc. Act 19932

The National Lottery (Licence Fees) Order 20012 shall be amended as follows.

In article 3(1) for the words “paragraph (2)” substitute “the following provisions of this article”.

At the beginning of article 3(2) insert “Subject to paragraph (3)”.

After article 3(2) insert the following new paragraphs—

Where a licence granted under section 6 of that Act authorises the promotion by the licensee of a lottery pursuant to an agreement, entered into between the licensee and the promoters of other lotteries in other countries of the European Union, under which lotteries falling within the agreement share a common game structure and prizes, the fee shall be £150,000.

In the case of a licence that—
a
takes effect on the expiry of a licence mentioned in paragraphs (2) or (3) that was held by the same licensee, and
b
is in substantially the same terms as the licence mentioned in paragraphs (2) or (3), the fee shall be £20,000.
