The Secretary of State, in exercise of the powers conferred upon her by sections 7(5) and 60(4) of the National Lottery etc. Act 1993(1), hereby makes the following Order:
1. This Order may be cited as the National Lottery (Licence Fees) (Amendment) Order 2003 and shall come into force on 25th November 2003.
2.—(1) The National Lottery (Licence Fees) Order 2001(2) shall be amended as follows.
(2) In article 3(1) for the words “paragraph (2)” substitute “the following provisions of this article”.
(3) At the beginning of article 3(2) insert “Subject to paragraph (3)”.
(4) After article 3(2) insert the following new paragraphs—
“(3) Where a licence granted under section 6 of that Act authorises the promotion by the licensee of a lottery pursuant to an agreement, entered into between the licensee and the promoters of other lotteries in other countries of the European Union, under which lotteries falling within the agreement share a common game structure and prizes, the fee shall be £150,000.
(4) In the case of a licence that—
(a)takes effect on the expiry of a licence mentioned in paragraphs (2) or (3) that was held by the same licensee, and
(b)is in substantially the same terms as the licence mentioned in paragraphs (2) or (3), the fee shall be £20,000.”.

This Order amends the National Lottery (Licence Fees) Order 2001 (S.I. 2001/2506) which prescribes the fees payable on all licences granted under section 5 or 6 of the National Lottery etc. Act 1993 (“the Act”). That Order is amended to prescribe the sums payable by the licensee to the National Lottery Commission by way of fees on—
(a)the renewal of a licence under section 6 of the Act which authorises the promotion by the licensee of an unrestricted number of lotteries (£20,000), and
(b)the grant and renewal of a licence under section 6 of the Act which authorises the promotion of a lottery by the licensee pursuant to an agreement with the promoters of other lotteries within the European Union (£150,000 and £20,000 respectively).
1993 c. 39. Section 7(5) was amended by section 1(5) of, and paragraph 4 of Part 1 of Schedule 1 to, the National Lottery Act 1998 (c. 22).
