Regulations:</p></formula></preamble><body eId="body"><part eId="part-I"><num>PART I</num><heading>PRELIMINARY</heading><hcontainer name="regulation" eId="regulation-1"><heading>Title, commencement and application</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Access to the Countryside (Exclusions and Restrictions) (England) Regulations 2003 and shall come into force on 17th November 2003.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations apply in relation to England only<authorialNote class="footnote" eId="f00003" marker="3"><p>Regulations made by the Secretary of State may be made only as respects England: see section 45(1) for the meaning of “regulations”.</p></authorialNote>.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>General interpretation</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><intro><p>In these Regulations—</p></intro><hcontainer name="definition"><content><p>“<abbr title="Countryside and Rights of Way Act 2000 c. 37">the Act</abbr>” means the Countryside and Rights of Way Act 2000;</p></content></hcontainer><hcontainer name="definition"><content><p><noteRef href="#key-5ec55891d823832ce71a36c8d913aec8" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>...</p></content></hcontainer><hcontainer name="definition"><content><p>“electronic communication” has the meaning given in section 15(1) of the Electronic Communications Act 2000<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00002" href="http://www.legislation.gov.uk/id/ukpga/2000/7">2000 c. 7</ref>.</p></authorialNote></p></content></hcontainer><hcontainer name="definition"><content><p>“right of access” means the right conferred by section 2(1);</p></content></hcontainer><hcontainer name="definition"><intro><p>“working day” means any day other than—</p></intro><level class="para1"><num>(a)</num><content><p>a Saturday, Sunday, Christmas Day or Good Friday; or</p></content></level><level class="para1"><num>(b)</num><content><p>any day which is a bank holiday under the Banking and Financial Dealings Act 1971<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/1971/80">1971 c. 80</ref>.</p></authorialNote> in England.</p></content></level></hcontainer></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p>Any reference in these Regulations to a notice in writing includes a reference to a notice given by means of an electronic communication.</p></content></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><content><p>In these Regulations references to sections are to sections of <abbr title="Countryside and Rights of Way Act 2000 c. 37">the Act</abbr>.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Use of electronic communications</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><intro><p>Any requirement imposed by or under these Regulations as to the giving or sending by one person to another of a notice or other document may be met by means of an electronic communication if—</p></intro><level class="para1" eId="regulation-3-1-a"><num>(a)</num><content><p>the use of such a communication results in the information contained in that notice or document being available to the other person in all material respects as it would appear in a notice or document given or sent in printed form; and</p></content></level><level class="para1" eId="regulation-3-1-b"><num>(b)</num><content><p>the other person has consented to the information being made available to him by such means.</p></content></level></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><intro><p>Where, under paragraph (1), an electronic communication is used for the purposes of giving or sending a document—</p></intro><level class="para1" eId="regulation-3-2-a"><num>(a)</num><content><p>any requirement for the notice or document to be given or sent by a particular time shall be met in respect of an electronic communication only if the conditions mentioned in paragraph (1) are met by that time; and</p></content></level><level class="para1" eId="regulation-3-2-b"><num>(b)</num><content><p>any requirement for more than one copy to be sent on any single occasion may be complied with by a single such communication.</p></content></level></paragraph><paragraph eId="regulation-3-3"><num>(3)</num><content><p>For the purposes of paragraph (1)(a), “in all material respects” means in all respects material to an exact reproduction of the content of the information as it would appear in a notice given or sent in printed form.</p></content></paragraph></hcontainer></part><part eId="part-II"><num>PART II</num><heading>EXCLUSIONS AND RESTRICTIONS</heading><hcontainer name="regulation" eId="regulation-4"><heading>Notice of exclusion or restriction of access under section 22</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><intro><p>Notice given by an entitled person to the relevant authority under section 22(1) for the purpose of excluding or restricting the right of access to any land shall state—</p></intro><level class="para1" eId="regulation-4-1-a"><num>(a)</num><content><p>the name and postal address of the entitled person;</p></content></level><level class="para1" eId="regulation-4-1-b"><num>(b)</num><content><p>the nature of the entitled person’s interest in the land;</p></content></level><level class="para1" eId="regulation-4-1-c"><num>(c)</num><content><p>the location and extent of the land to be affected by the exclusion or restriction, sufficiently to enable it to be identified by the authority, whether by marking it on a map or otherwise;</p></content></level><level class="para1" eId="regulation-4-1-d"><num>(d)</num><content><p>the days and, if for less than twenty-four hours in a single day, the times during which the exclusion or restriction is to apply; and</p></content></level><level class="para1" eId="regulation-4-1-e"><num>(e)</num><content><p>the purpose of the exclusion or restriction and, in the case of a restriction, the nature of it.</p></content></level></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><content><p>Notice of any information under paragraph (1) may be given to a relevant authority by instalments, and shall be regarded as having been received by the authority when they have received all the required information.</p></content></paragraph><paragraph eId="regulation-4-3"><num>(3)</num><content><p>Notice of the information referred to in paragraph (1)(a) and (b) shall be given to the relevant authority in writing.</p></content></paragraph><paragraph eId="regulation-4-4"><num>(4)</num><content><p>Notice of the information referred to in paragraph (1)(c), (d) and (e) shall be given to the relevant authority in writing or, subject to paragraph (8), by telephone.</p></content></paragraph><paragraph eId="regulation-4-5"><num>(5)</num><content><p>Subject to paragraph (6), notice given by an entitled person under paragraph (1) excluding or restricting access shall not have effect until the expiry of five working days after the day on which it is received by the relevant authority.</p></content></paragraph><paragraph eId="regulation-4-6"><num>(6)</num><intro><p>Notice given by an entitled person under paragraph (1) excluding or restricting the right of access for no more than four hours, or for no more than five days in relation to not more than five hectares of land, shall not have effect unless—</p></intro><level class="para1" eId="regulation-4-6-a"><num>(a)</num><content><p>the notice is received by the relevant authority not less than two hours before the time at which the exclusion or restriction is to commence, and</p></content></level><level class="para1" eId="regulation-4-6-b"><num>(b)</num><content><p>the exclusion or restriction will not prevent access to any other land to which there is a right of access at such time.</p></content></level></paragraph><paragraph eId="regulation-4-7"><num>(7)</num><content><p>Notice given under paragraph (1), other than notice of an exclusion or restriction mentioned in paragraph (6), may be withdrawn by the entitled person by further notice to the relevant authority in writing or, subject to paragraph (8), by telephone, provided that such notice is received by the authority not less than two working days before the time at which the exclusion or restriction is to commence.</p></content></paragraph><paragraph eId="regulation-4-8"><num>(8)</num><intro><p>Where, pursuant to this regulation, notice of any matter is given by telephone, it shall not be effective unless the relevant authority indicate during the course of the telephone conversation in which the information is given to them that they are satisfied as to the identity of the person giving it, and—</p></intro><level class="para1" eId="regulation-4-8-a"><num>(a)</num><content><p>in the case of any information given for the purposes of paragraph (1)(c), that the location and extent of the land are sufficiently described to enable the authority to identify the land;</p></content></level><level class="para1" eId="regulation-4-8-b"><num>(b)</num><content><p>in the case of any information given for the purposes of paragraph (1)(e), that it is sufficient to enable the authority to understand the purpose of the exclusion or restriction in question and, in the case of a restriction, the nature of it.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Restriction on the right of access with dogs</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><content><p>Any restriction on the right of access which is imposed by the owner of any land under section 23(1) or (2) shall only be effective if notice is given by that person to the relevant authority in accordance with paragraphs (2) and (3).</p></content></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><intro><p>Notice given by the owner of the land for the purposes of paragraph (1) shall be in writing and shall state—</p></intro><level class="para1" eId="regulation-5-2-a"><num>(a)</num><content><p>his name and postal address;</p></content></level><level class="para1" eId="regulation-5-2-b"><num>(b)</num><content><p>the nature of his interest in the land to which the restriction will apply;</p></content></level><level class="para1" eId="regulation-5-2-c"><num>(c)</num><content><p>the location and extent of the land to be affected by the restriction, sufficiently to enable it to be identified by the relevant authority, whether by marking it on a map or otherwise;</p></content></level><level class="para1" eId="regulation-5-2-d"><num>(d)</num><content><p>the period of the restriction;</p></content></level><level class="para1" eId="regulation-5-2-e"><num>(e)</num><content><p>whether the restriction is imposed under section 23(1) or under section 23(2); and</p></content></level><level class="para1" eId="regulation-5-2-f"><num>(f)</num><intro><p>that—</p></intro><level class="para2" eId="regulation-5-2-f-i"><num>(i)</num><content><p>in the case of a restriction to be imposed under section 23(1), the land is a moor managed for the breeding and shooting of grouse and will remain so during the period referred to in sub-paragraph (d); or</p></content></level><level class="para2" eId="regulation-5-2-f-ii"><num>(ii)</num><content><p>in the case of a restriction to be imposed under section 23(2), the land will be used in connection with lambing during the period referred to in that sub-paragraph.</p></content></level></level></paragraph><paragraph eId="regulation-5-3"><num>(3)</num><intro><p>Notice given by the owner of land for the purposes of paragraph (1) shall not have effect so as to restrict the right of access earlier than—</p></intro><level class="para1" eId="regulation-5-3-a"><num>(a)</num><content><p>in the case of a restriction to be imposed under section 23(1), the expiry of one calendar month from the day on which it is received by the relevant authority; and</p></content></level><level class="para1" eId="regulation-5-3-b"><num>(b)</num><content><p>in the case of a restriction to be imposed under section 23(2), the expiry of five working days from that day.</p></content></level></paragraph><paragraph eId="regulation-5-4"><num>(4)</num><content><p>Notice given under paragraph (1) may be withdrawn by the person who gave it or, where he has ceased to hold the land, by his successor in title, by means of further notice to the relevant authority in writing or, subject to paragraph (5), by telephone, provided that, in the case of a restriction imposed under section 23(2), such notice is received by the authority not less than two working days before the time at which the restriction is to commence.</p></content></paragraph><paragraph eId="regulation-5-5"><num>(5)</num><content><p>Where, pursuant to paragraph (4), notice withdrawing any notice under paragraph (1) is given by telephone, it shall not be effective unless the relevant authority indicate during the course of the telephone conversation in which the information is given to them that they are satisfied as to the identity of the person giving it.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Applications for a direction under section 24 or 25</heading><num>6.</num><paragraph eId="regulation-6-1"><num>(1)</num><intro><p>An application by a person interested in any land for a direction under section 24 or 25 shall be made to the relevant authority in writing and shall state—</p></intro><level class="para1" eId="regulation-6-1-a"><num>(a)</num><content><p>the name and postal address of the applicant;</p></content></level><level class="para1" eId="regulation-6-1-b"><num>(b)</num><content><p>the nature of the applicant’s interest in the land and, if the applicant is a person whose interest in the land is solely as a holder of rights of common, the nature of those rights;</p></content></level><level class="para1" eId="regulation-6-1-c"><num>(c)</num><content><p>the location and extent of the land, sufficiently to enable it to be identified by the authority, whether by marking it on a map or otherwise;</p></content></level><level class="para1" eId="regulation-6-1-d"><num>(d)</num><content><p>the period of the exclusion or restriction to be provided for by the direction, except where that period is to be determined by the applicant in accordance with the direction;</p></content></level><level class="para1" eId="regulation-6-1-e"><num>(e)</num><content><p>the purpose of the exclusion or restriction and, in the case of a restriction, the nature of it;</p></content></level><level class="para1" eId="regulation-6-1-f"><num>(f)</num><content><p>the reason (or reasons) why the applicant considers that such exclusion or restriction is necessary; <noteRef href="#key-b390e256e1f3377fab98a1986443092b" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>...</p></content></level><level class="para1" eId="regulation-6-1-g"><num>(g)</num><content><p>if the applicant is an entitled person for the purposes of section 22, the total number of days in respect of which he has exercised, or proposes to exercise, the right conferred by that section in each calendar year in respect of which the direction is being sought and the purpose for which he has exercised, or proposes to exercise, that right<ins class="substitution first last" ukl:ChangeId="key-aae3d4fcb043af7b3c78115e7a5a960f-1534324434140" ukl:CommentaryRef="key-aae3d4fcb043af7b3c78115e7a5a960f"><noteRef uk:name="commentary" ukl:ChangeId="key-ca3f71573704c882ec24b001f05aec08-1534324490097" ukl:CommentaryRef="key-ca3f71573704c882ec24b001f05aec08"><noteRef uk:name="commentary" href="#key-ca3f71573704c882ec24b001f05aec08" class="commentary"/>(h)</ins></num><content><p><ins class="last" ukl:ChangeId="key-ca3f71573704c882ec24b001f05aec08-1534324490097" ukl:CommentaryRef="key-ca3f71573704c882ec24b001f05aec08">whether the land is coastal margin;</ins></p></content></level></paragraph><paragraph eId="regulation-6-2"><num>(2)</num><content><p>An application made by a person under paragraph (1) may be withdrawn by that person by notice in writing given to the relevant authority at any time before the date on which the application is determined by the authority.</p></content></paragraph><paragraph eId="regulation-6-3"><num><ins class="first" ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324056884" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441"><noteRef uk:name="commentary" href="#key-4789e4fd34341ef659a6a582ea2d4441" class="commentary"/>(3)</ins></num><content><p><ins class="last" ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324056884" margin.</ins></p></content></paragraph><paragraph eId="regulation-6-4"><num><ins class="first" ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324073498" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441"><noteRef uk:name="commentary" href="#key-4789e4fd34341ef659a6a582ea2d4441" class="commentary"/>(4)</ins></num><intro><p><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324073498" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">Where the proposed direction would authorise a specified person to exclude or restrict access to land in a manner specified in the direction, the application must state—</ins></p></intro><level class="para1" eId="regulation-6-4-a"><num><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324073498" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">(a)</ins></num><content><p><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324073498" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">the name of the specified person, and</ins></p></content></level><level class="para1" eId="regulation-6-4-b"><num><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324073498" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">(b)</ins></num><content><p><ins class="last" ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324073498" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">the manner in which access may be excluded or restricted by the specified person.</ins></p></content></level></paragraph><paragraph eId="regulation-6-5"><num><ins class="first" ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324088396" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441"><noteRef uk:name="commentary" href="#key-4789e4fd34341ef659a6a582ea2d4441" class="commentary"/>(5)</ins></num><intro><p><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324088396" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">Where the proposed direction would authorise a specified person to exclude or restrict access to such part or parts of the land as may be determined in accordance with the direction, the application must state—</ins></p></intro><level class="para1" eId="regulation-6-5-a"><num><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324088396" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">(a)</ins></num><content><p><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324088396" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">the name of the specified person, and</ins></p></content></level><level class="para1" eId="regulation-6-5-b"><num><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324088396" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">the manner in which the part or parts of the land to which access may be excluded or restricted is to be determined by the specified person.</ins></p></content></level></paragraph><paragraph eId="regulation-6-6"><num><ins class="first" ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324105026" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441"><noteRef uk:name="commentary" href="#key-4789e4fd34341ef659a6a582ea2d4441" class="commentary"/>(6)</ins></num><intro><p><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324105026" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">Where the period in the proposed direction is to be determined by a specified person, the application must state—</ins></p></intro><level class="para1" eId="regulation-6-6-a"><num><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324105026" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">(a)</ins></num><content><p><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324105026" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">the name of the specified person, and</ins></p></content></level><level class="para1" eId="regulation-6-6-b"><num><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324105026" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">the manner in which the specified period may be determined by the specified person.</ins></p></content></level></paragraph><paragraph eId="regulation-6-7"><num><ins class="first" ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324211137" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441"><noteRef uk:name="commentary" href="#key-4789e4fd34341ef659a6a582ea2d4441" class="commentary"/>(7)</ins></num><intro><p><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324211137" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">The application must include the names of any person who —</ins></p></intro><level class="para1" eId="regulation-6-7-a"><num><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324211137" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">is an owner of the land,</ins></p></content></level><level class="para1" eId="regulation-6-7-b"><num><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324211137" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">(b)</ins></num><content><p><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324211137" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">holds a term of years absolute in the land, or</ins></p></content></level><level class="para1" eId="regulation-6-7-c"><num><ins ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324211137" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">(c)</ins></num><content><p><ins class="last" ukl:ChangeId="key-4789e4fd34341ef659a6a582ea2d4441-1534324211137" ukl:CommentaryRef="key-4789e4fd34341ef659a6a582ea2d4441">is in lawful occupation of the land.</ins></p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-7"><heading>Notices relating to periods during which exclusions or restrictions are to apply</heading><num>7.</num><paragraph eId="regulation-7-1"><num>(1)</num><intro><p>Subject to paragraph (3), where a direction is given by a relevant authority under section 24, 25<ins class="first last" ukl:ChangeId="key-daabc6b6657690ddb9f4a8d21f675581-1534324744521" ukl:CommentaryRef="key-daabc6b6657690ddb9f4a8d21f675581"><noteRef uk:name="commentary" href="#key-daabc6b6657690ddb9f4a8d21f675581" class="commentary"/>, 25A</ins>  or 26, or by the Secretary of State under section 28, so as to exclude or restrict the right of access to any land during a period to be determined by a relevant person, <ins class="first last" ukl:ChangeId="key-e55a72a5850183ea612e94b487f3fd5b-1534324830805" ukl:CommentaryRef="key-e55a72a5850183ea612e94b487f3fd5b"><noteRef uk:name="commentary" href="#key-e55a72a5850183ea612e94b487f3fd5b" class="commentary"/>where the direction so requires,</ins>  notice of the period so determined shall be given by the relevant person to the authority or the Secretary of State and the direction shall have no effect until—</p></intro><level class="para1" eId="regulation-7-1-a"><num>(a)</num><content><p>the expiry of five working days after the day on which notice of that period given by the relevant person is received by the authority or the Secretary of State; or</p></content></level><level class="para1" eId="regulation-7-1-b"><num>(b)</num><content><p>such other time after the day on which the notice is received by the authority or the Secretary of State as may be specified in the direction.</p></content></level></paragraph><paragraph eId="regulation-7-2"><num>(2)</num><content><p>Notice given under paragraph (1) shall be given in writing or, if so permitted by the direction, by telephone.</p></content></paragraph><paragraph eId="regulation-7-3"><num>(3)</num><content><p>Where, pursuant to paragraph (2), notice is given by telephone, it shall not be effective unless the relevant authority indicate during the course of the telephone conversation in which the information is given to them that they are satisfied as to the identity of the person giving it.</p></content></paragraph><paragraph eId="regulation-7-4"><num>(4)</num><intro><p>In this regulation, “relevant person” means—</p></intro><level class="para1" eId="regulation-7-4-a"><num>(a)</num><content><p>in the case of a direction under section 24, the person who applied for the direction <ins class="first last" ukl:ChangeId="key-f140ac8195fb445c19a6cf5bacb525be-1534324875172" ukl:CommentaryRef="key-f140ac8195fb445c19a6cf5bacb525be"><noteRef uk:name="commentary" href="#key-f140ac8195fb445c19a6cf5bacb525be" class="commentary"/>or, if a person is specified in the direction, that person</ins>;</p></content></level><level class="para1" eId="regulation-7-4-b"><num>(b)</num><content><p>in the case of a direction under section 25<ins class="first last" ukl:ChangeId="key-3ed191a4203bef472ac942e43983f3ea-1534324915686" ukl:CommentaryRef="key-3ed191a4203bef472ac942e43983f3ea"><noteRef uk:name="commentary" href="#key-3ed191a4203bef472ac942e43983f3ea" class="commentary"/>, 25A</ins>  or 26, a person specified in the direction; and</p></content></level><level class="para1" eId="regulation-7-4-c"><num>(c)</num><content><p>in the case of a direction under section 28, a person authorised by the Secretary of State.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-8"><heading>Applications for a direction under section 24 or 25 by holders of rights of common</heading><num>8.</num><paragraph eId="regulation-8-1"><num>(1)</num><content><p>A person who is interested in any land only as the holder of rights of common may not apply for a direction under section 24 or 25 excluding access to that land.</p></content></paragraph><paragraph eId="regulation-8-2"><num>(2)</num><intro><p>Any such person may only apply for a direction under section 24 or 25 restricting access to that land if—</p></intro><level class="para1" eId="regulation-8-2-a"><num>(a)</num><content><p>the restriction is necessary for the purposes of any use of the land in exercise of his rights of common; and</p></content></level><level class="para1" eId="regulation-8-2-b"><num>(b)</num><content><p>the restriction would only restrict access to the land for the whole or part of the period in which he is entitled to exercise such rights.</p></content></level></paragraph><paragraph eId="regulation-8-3"><num>(3)</num><content><p>A person making an application in accordance with paragraph (2) shall submit in support of his application a certified copy of the entry in respect of his rights of common over the land to which his application relates which appears in the register maintained under the Commons Registration Act 1965<authorialNote class="footnote" eId="f00006" marker="6"><p><ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1965/64">1965 c. 64</ref>.</p></authorialNote> in respect of that land, save that this requirement shall not apply where the person making the application has complied with it when making a previous application in respect of the land in question.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-9"><heading>Consultation on proposals for long-term exclusions or restrictions</heading><num>9.</num><paragraph eId="regulation-9-1"><num>(1)</num><content><p>For the purposes of consulting a local access forum under section 27(1), the relevant authority shall supply the forum with <ins class="substitution first last" ukl:ChangeId="key-e0403079c56def4fde9ec46cc3a5394b-1534325060509" ukl:CommentaryRef="key-e0403079c56def4fde9ec46cc3a5394b"><noteRef uk:name="commentary" href="#key-e0403079c56def4fde9ec46cc3a5394b" class="commentary"/> a copy of the notice referred to in paragraph (3)</ins>.</p></content></paragraph><paragraph eId="regulation-9-2"><num>(2)</num><content><p>Before giving a direction under section 28 for the purposes of defence which will, indefinitely or for a period which exceeds (or may exceed) six months, exclude or restrict the right of access in relation to any land in an area in which there is a local access forum, the Secretary of State shall consult the forum.</p></content></paragraph><paragraph eId="regulation-9-3"><num>(3)</num><intro><p>Where a relevant authority proposes to give a direction under section 24, 25 <ins class="first last" ukl:ChangeId="key-1a97b03d49f7ef75c9c9c266c5c438b6-1534325106231" ukl:CommentaryRef="key-1a97b03d49f7ef75c9c9c266c5c438b6"><noteRef uk:name="commentary" href="#key-1a97b03d49f7ef75c9c9c266c5c438b6" class="commentary"/>, 25A</ins>  or 26, or the Secretary of State proposes to give a direction under section 28 for the purposes of defence which (in any such case) will exclude or restrict access to any land indefinitely or for a period which exceeds (or may exceed) six months, they or he, as the case may be, shall publish a notice which—</p></intro><level class="para1" eId="regulation-9-3-a"><num>(a)</num><content><p>describes the area of land to which the proposed direction will relate sufficiently to identify it;</p></content></level><level class="para1" eId="regulation-9-3-b"><num>(b)</num><content><p>describes the nature and purpose of the proposed direction;</p></content></level><level class="para1" section 28 for the purposes of defence, the Secretary of State,</p></content></level><wrapUp><p>until such time as the application for the direction in question is determined.</p></wrapUp></paragraph><paragraph eId="regulation-9-6"><num>(6)</num><content><p>Where a notice is published under paragraph (3), the relevant authority or the Secretary of State (as the case may be) shall send a copy of the notice to the persons specified in the Schedule to these Regulations.</p></content></paragraph><paragraph eId="regulation-9-7"><num>(7)</num><content><p>A notice referred to in paragraph (3) may relate to more than one proposal.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-10"><heading>Time for determination of applications for a direction under section 24 or 25</heading><num>10.</num><paragraph eId="regulation-10-1"><num>(1)</num><content><p>Where an application for a direction under section 24 or 25 is made before the right of access comes into force, a relevant authority shall determine the application within six weeks of receiving it or within any such longer period, as may have been determined by the Secretary of State, notice of which has been given to the authority by the Secretary of State and details of which have been published by her.</p></content></paragraph><paragraph eId="regulation-10-2"><num>(2)</num><content><p>Subject to paragraph (3), a relevant authority shall determine any other application for a direction under section 24 or 25 within six weeks of receiving it, or within such longer period as may have been agreed between the authority and the applicant.</p></content></paragraph><paragraph eId="regulation-10-3"><num>(3)</num><content><p>Paragraph (2) shall not apply where a relevant authority is required by section 27(1) to consult a local access forum before giving such a direction, and in any such case the authority shall determine an application referred to in paragraph (2) within four months of receiving it, or within such longer period as may have been agreed between the authority and the applicant.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-11"><heading>Notification by relevant authorities of directions and decisions</heading><num>11.</num><intro><p>A relevant authority shall—</p></intro><level class="para1" eId="regulation-11-a"><num>(a)</num><intro><p>in relation to an application for a direction under section 24 or 25, as soon as practicable notify the applicant of the decision which they have taken in respect of the application and, where they have given such a direction, supply a copy of the direction to—</p></intro><level class="para2" eId="regulation-11-a-i"><num>(i)</num><content><p>the applicant, and</p></content></level><level class="para2" eId="regulation-11-a-ii"><num>(ii)</num><content><p>the access authority for the area in which the land to which the direction relates is situated;</p></content></level></level><level class="para1" eId="regulation-11-b"><num>(b)</num><intro><p>where they have given a direction under section 25 other than on an application by a person interested in the land to which the direction relates, or a direction under  <ins class="substitution first last" ukl:ChangeId="key-9c0102cb1b0c09ebfe4bccb45fa0da95-1534325414807" ukl:CommentaryRef="key-9c0102cb1b0c09ebfe4bccb45fa0da95"><noteRef uk:name="commentary" href="#key-9c0102cb1b0c09ebfe4bccb45fa0da95" class="commentary"/>section 25A or 26</ins>, notify—</p></intro><level class="para2" eId="regulation-11-b-i"><num>(i)</num><content><p>the owner of the land, if it is reasonably practicable to do so, and</p></content></level><level class="para2" eId="regulation-11-b-ii"><num>(ii)</num><content><p>the access authority for the area in which the land to which the direction relates is situated;</p></content></level></level><level class="para1" eId="regulation-11-c"><num>(c)</num><content><p>notify the access authority of any notice given to them for the purposes of regulation 5(1);</p></content></level><level class="para1" eId="regulation-11-d"><num>(d)</num><intro><p>notify the relevant advisory body of any decision which they have taken—</p></intro><level class="para2" eId="regulation-11-d-i"><num>(i)</num><content><p>to give a direction under section 26, or</p></content></level><level class="para2" eId="regulation-11-d-ii"><num>(ii)</num><content><p>not to act in accordance with any advice given to them by that body in considering whether to give a direction under that section,</p></content></level><wrapUp><p>and, where they have given such a direction, supply a copy of it to the relevant advisory body; and</p></wrapUp></level><level class="para1" eId="regulation-11-e"><num>(e)</num><content><p>in relation to any decision which they have taken in respect of a proposed direction or the review of a direction following consultation with a local access forum under section 27(1) or regulation 15(1)(a) respectively, notify the forum by supplying them with a copy of the direction.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-12"><heading>Notification by the Secretary of State of directions</heading><num>12.</num><intro><p>Where the Secretary of State has given a direction under section 28 for the purposes of defence, he shall notify—</p></intro><level class="para1" eId="regulation-12-a"><num>(a)</num><content><p>the relevant authority;</p></content></level><level class="para1" eId="regulation-12-b"><num>(b)</num><content><p>the access authority for the area in which the land to which the direction relates is situated; and</p></content></level><level class="para1" eId="regulation-12-c"><num>(c)</num><content><p>the owner of the land, if it is reasonably practicable to do so.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-13"><heading>Revocation or variation of directions</heading><num>13.</num><paragraph eId="regulation-13-1"><num>(1)</num><content><p>Before revoking or varying, in accordance with section 27(2), a direction given under section 24 or a direction given under section 25 on the application of a person interested in the land to which the direction relates, a relevant authority shall, if it is reasonably practicable to do so, provide the person on whose application the direction was made or his successor in title with the information specified in paragraph (3).</p></content></paragraph><paragraph eId="regulation-13-2"><num>(2)</num><content><p>Where, in accordance with section 27(6), a relevant authority consults the relevant advisory body before revoking or varying (in accordance with section 27(2)), a direction given under section 26, the authority shall provide the advisory body with the information specified in paragraph (3).</p></content></paragraph><paragraph eId="regulation-13-3"><num>(3)</num><intro><p>The information referred to in paragraphs (1) and (2) is—</p></intro><level class="para1" eId="regulation-13-3-a"><num>(a)</num><content><p>a statement of the relevant authority’s reasons for the proposed revocation or variation; and</p></content></level><level class="para1" eId="regulation-13-3-b"><num>(b)</num><content><p>in the case of a proposed variation, a description of the variation.</p></content></level></paragraph><paragraph eId="regulation-13-4"><num>(4)</num><content><p>Where the relevant authority decide, after consultation in accordance with section 27(5) or (6), as appropriate, not to revoke or vary the direction, they shall notify the applicant or his successor in title or the relevant advisory body, as the case may be, of that decision as soon as practicable after they have made it.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-14"><heading>Reviews of directions</heading><num>14.</num><intro><p>Where, in accordance with section 27(3), a relevant authority review a direction given under section 24, 25 <ins class="first last" ukl:ChangeId="key-d7c10da5d7d6debb98c1c15548297601-1534325520697" ukl:CommentaryRef="key-d7c10da5d7d6debb98c1c15548297601"><noteRef uk:name="commentary" href="#key-d7c10da5d7d6debb98c1c15548297601" class="commentary"/>, 25A</ins>  or 26 or, in accordance with section 28(4), the Secretary of State reviews a direction given under section 28 for the purposes of defence, they or he (as the case may be) shall, having regard to the interest of the public in having access to the land to which the direction relates—</p></intro><level class="para1" eId="regulation-14-a"><num>(a)</num><content><p>consider whether the exclusion or restriction is still necessary for the purpose for which the direction was given; and</p></content></level><level class="para1" eId="regulation-14-b"><num>(b)</num><content><p>if so, consider whether the extent of the exclusion or the nature of the restriction remains appropriate for the purpose for which the direction was given.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-15"><heading>Consultation on reviews by relevant authorities of directions excluding or restricting access on a long-term basis</heading><num>15.</num><paragraph eId="regulation-15-1"><num>(1)</num><intro><p>Before reviewing, in accordance with section 27(3), a direction given under <ins class="substitution first last" ukl:ChangeId="key-0265cbcd22b7543371909608f3b2e5f7-1534325603911" ukl:CommentaryRef="key-0265cbcd22b7543371909608f3b2e5f7"><noteRef uk:name="commentary" href="#key-0265cbcd22b7543371909608f3b2e5f7" class="commentary"/>section 24, 25, 25A or 26</ins> a relevant authority shall—</p></intro><level class="para1" eId="regulation-15-1-a"><num>(a)</num><content><p>consult the local access forum;</p></content></level><level class="para1" eId="regulation-15-1-b"><num>(b)</num><content><p>in the case of a direction under section 24 or a direction under section 25 given on the application of a person interested in the land to which the direction relates, consult, if it is reasonably practicable to do so, the person on whose application the direction was given or his successor in title;</p></content></level><level class="para1" eId="regulation-15-1-c"><num>(c)</num><content><p>in the case of a direction under section 26, consult the relevant advisory body;</p></content></level><level class="para1" eId="regulation-15-1-d"><num>(d)</num><intro><p>publish a notice which states—</p></intro><level class="para2" eId="regulation-15-1-d-i"><num>(i)</num><content><p>that the authority propose to review the direction in question,</p></content></level><level class="para2" eId="regulation-15-1-d-ii"><num>(ii)</num><content><p>where documents relating to the proposed review may be inspected and copies of them may be obtained, and</p></content></level><level class="para2" eId="regulation-15-1-d-iii"><num>(iii)</num><content><p>that representations in writing with regard to the proposed review may be made by any person to the authority by such date as is specified in the notice, which date shall not be earlier than a date two weeks after the date on which the notice is published.</p></content></level></level></paragraph><paragraph eId="regulation-15-2"><num>(2)</num><content><p>A relevant authority shall not be required to publish a notice under sub-paragraph (d) of paragraph (1) where they consider that it is not in the public interest that the information referred to in that sub-paragraph should be disclosed.</p></content></paragraph><paragraph eId="regulation-15-3"><num>(3)</num><content><p>The notice referred to in paragraph (1)(d) shall be published by being made available for inspection on a website maintained by or on behalf of the relevant authority until the review has been completed.</p></content></paragraph><paragraph eId="regulation-15-4"><num>(4)</num><content><p>The relevant authority shall send a copy of the notice referred to in paragraph (1)(d) to the persons specified in the Schedule to these Regulations.</p></content></paragraph><paragraph eId="regulation-15-5"><num>(5)</num><content><p>A notice referred to in paragraph (1)(d) may relate to more than one direction.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-16"><heading>Consultation on reviews by the Secretary of State of directions excluding or restricting access on a long-term basis</heading><num>16.</num><paragraph eId="regulation-16-1"><num>(1)</num><intro><p>Before reviewing, in accordance with section 28(4), a direction given under section 28 the Secretary of State shall—</p></intro><level class="para1" eId="regulation-16-1-a"><num>(a)</num><content><p>consult the local access forum; and</p></content></level><level class="para1" eId="regulation-16-1-b"><num>(b)</num><intro><p>publish a notice which states—</p></intro><level class="para2" eId="regulation-16-1-b-i"><num>(i)</num><content><p>that the Secretary of State proposes to review the direction in question,</p></content></level><level class="para2" eId="regulation-16-1-b-ii"><num>(ii)</num><content><p>where documents relating to the proposed review may be inspected and copies of them may be obtained, and</p></content></level><level class="para2" eId="regulation-16-1-b-iii"><num>(iii)</num><content><p>that representations in writing with regard to the proposed review may be made by any person to the Secretary of State by such date as is specified in the notice, which date shall not be earlier than a date two weeks after the date on which the notice is published.</p></content></level></level></paragraph><paragraph eId="regulation-16-2"><num>(2)</num><content><p>The Secretary of State shall not be required to publish a notice under sub-paragraph (b) of paragraph (1) where he considers that it is not in the public or defence interest that the information referred to in that sub-paragraph should be disclosed.</p></content></paragraph><paragraph eId="regulation-16-3"><num>(3)</num><content><p>The notice referred to in paragraph (1)(b) shall be published by being made available for inspection on a website maintained by or on behalf of the Secretary of State until the review has been completed.</p></content></paragraph><paragraph eId="regulation-16-4"><num>(4)</num><content><p>The Secretary of State shall send a copy of the notice referred to in paragraph (1)(b) to the persons specified in the Schedule to these Regulations.</p></content></paragraph><paragraph eId="regulation-16-5"><num>(5)</num><content><p>The notice referred to in paragraph (1)(b) may relate to more than one direction.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-17"><heading>Informing the public of exclusions or restrictions</heading><num>17.</num><paragraph eId="regulation-17-1"><num>(1)</num><intro><p> <ins class="substitution first last" ukl:ChangeId="key-816d26885bf5255f933f4b6bc248c77e-1534325759956" ukl:CommentaryRef="key-816d26885bf5255f933f4b6bc248c77e"><noteRef uk:name="commentary" href="#key-816d26885bf5255f933f4b6bc248c77e" class="commentary"/>Natural England</ins>  shall, as soon as practicable, make available on a website maintained by them details of—</p></intro><level class="para1" eId="regulation-17-1-a"><num>(a)</num><content><p>any exclusion or restriction of the right of access under section 22 or 23 other than an exclusion or restriction referred to in regulation 4(6); and</p></content></level><level class="para1" eId="regulation-17-1-b"><num>(b)</num><content><p>any direction given by the relevant authority under section 24, 25 <ins class="first last" ukl:ChangeId="key-53e4c9403545de68b37329a325614acc-1534325720300" ukl:CommentaryRef="key-53e4c9403545de68b37329a325614acc"><noteRef uk:name="commentary" href="#key-53e4c9403545de68b37329a325614acc" class="commentary"/>, 25A</ins>  or 26 or any direction given by the Secretary of State under section 28 for the purposes of defence, other than a direction to which paragraph (3) applies.</p></content></level></paragraph><paragraph eId="regulation-17-2"><num>(2)</num><content><p> <ins class="substitution first last" ukl:ChangeId="key-ac3b8cb4b36217ae7de7d942d79a82fd-1534325780829" ukl:CommentaryRef="key-ac3b8cb4b36217ae7de7d942d79a82fd"><noteRef uk:name="commentary" href="#key-ac3b8cb4b36217ae7de7d942d79a82fd" class="commentary"/>Natural England</ins>  shall not be required to make available any information under paragraph (1) where they consider that it is not in the public or defence interest that the information should be disclosed.</p></content></paragraph><paragraph eId="regulation-17-3"><num>(3)</num><content><p>Where any direction given by the relevant authority under section 24, 25 <ins class="first last" ukl:ChangeId="key-b794e601f065d1dbcd5bc730c45ab541-1534325803510" ukl:CommentaryRef="key-b794e601f065d1dbcd5bc730c45ab541"><noteRef uk:name="commentary" href="#key-b794e601f065d1dbcd5bc730c45ab541" class="commentary"/>, 25A</ins>  or 26 or any direction given by the Secretary of State under section 28 for the purposes of defence provides for the period during which it is to have effect to be notified to the authority or, as the case may be, the Secretary of State,  <ins class="substitution first last" ukl:ChangeId="key-486b1c0545ec46648640882ed681f4cc-1534325859328" ukl:CommentaryRef="key-486b1c0545ec46648640882ed681f4cc"><noteRef uk:name="commentary" href="#key-486b1c0545ec46648640882ed681f4cc" class="commentary"/>Natural England</ins>  shall, as soon as practicable after any such notification has been given, make details of the exclusion or restriction imposed by the direction, and of the period referred to in the notification, available for inspection on such a website, provided that not less than five working days' notice of the notification has been given to the authority.</p></content></paragraph><paragraph eId="regulation-17-4"><num>(4)</num><content><p>Where the details of any notice or direction have been made available in accordance with paragraph (1) or (3),  <ins class="substitution first last" ukl:ChangeId="key-c11a153c3ba195a78abf86b75ecc9818-1534325888812" ukl:CommentaryRef="key-c11a153c3ba195a78abf86b75ecc9818"><noteRef uk:name="commentary" href="#key-c11a153c3ba195a78abf86b75ecc9818" class="commentary"/>Natural England</ins>  shall ensure that such details shall remain available until such time as the exclusion or restriction of the right of access referred to in the notice or direction ceases to have effect.</p></content></paragraph><paragraph eId="regulation-17-5"><num>(5)</num><content><p>The Secretary of State, a National Park Authority and the Forestry Commissioners shall assist  <ins class="substitution first last" ukl:ChangeId="key-53c3dde2707591e52168dc7ed92ac71a-1534325907844" ukl:CommentaryRef="key-53c3dde2707591e52168dc7ed92ac71a"><noteRef uk:name="commentary" href="#key-53c3dde2707591e52168dc7ed92ac71a" class="commentary"/>Natural England</ins>  in carrying out their duty under paragraph (1) or (3) by supplying to  <ins class="substitution first last" ukl:ChangeId="key-53c3dde2707591e52168dc7ed92ac71a-1534325972132" ukl:CommentaryRef="key-53c3dde2707591e52168dc7ed92ac71a"><noteRef uk:name="commentary" href="#key-53c3dde2707591e52168dc7ed92ac71a" class="commentary"/>Natural England</ins>  in writing any relevant information concerning any exclusion, restriction or direction referred to in these paragraphs as soon as reasonably practicable after they have received notification of the exclusion or restriction or given the direction, as the case may be.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-18"><heading>Amendment of the Local Access Forums (England) Regulations 2002</heading><num>18.</num><content><p><mod>After regulation 8 of the Local Access Forums (England) Regulations 2002<authorialNote class="footnote" eId="f00007" marker="7"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00005" href="http://www.legislation.gov.uk/id/uksi/2002/1836">2002/1836</ref>.</p></authorialNote> (inspection of minutes and other documents after meetings of a local access forum) there shall be inserted the following regulation—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="uksi" ukl:TargetClass="secondary" ukl:TargetSubClass="regulation" ukl:Context="main" ukl:Format="default"><hcontainer name="regulation"><heading>Restriction on access to documents of a local access forum</heading><num>8A.</num><paragraph><num>(1)</num><content><p>Where, pursuant to any provision specified in paragraph (2), a relevant authority or the Secretary of State (as the case may be) has decided not to publish a notice of a kind mentioned in that provision on the grounds that it is not in the public or defence interest that the information contained in it should be disclosed, any part of the documents mentioned in regulations 7(3) and 8(1) and (2) of these Regulations that relates to such information shall not be open to inspection by members of the public.</p></content></paragraph><paragraph><num>(2)</num><intro><p>The provisions mentioned in paragraph (1) are—</p></intro><level class="para1"><num>(a)</num><content><p>regulation 9(4) of the Access to the Countryside (Exclusions and Restrictions) (England) Regulations 2003 (consultation on proposals for long-term exclusions or restrictions),</p></content></level><level class="para1"><num>(b)</num><content><p>regulation 15(2) of those Regulations (consultation on reviews by relevant authorities of directions excluding or restricting access on a long-term basis), and</p></content></level><level class="para1"><num>(c)</num><content><p>regulation 16(2) of those Regulations (consultation on reviews by the Secretary of State of directions excluding or restricting access on a long-term basis).</p></content></level></paragraph><paragraph><num>(3)</num><content><p>In paragraph (1) “a relevant authority” has the meaning given by section 21(5) and (6).</p></content></paragraph></hcontainer></quotedStructure><inline name="appendText">.</inline></mod></p></content></hcontainer></part><part eId="part-III"><num>PART III</num><heading>APPEALS</heading><chapter eId="part-III-chapter-I"><num>CHAPTER I</num><heading><i>Initial stages of all appeals (other than an appeal against a decision of a relevant authority not to act in accordance with an application for a direction under section 25(1)(a))</i></heading><hcontainer name="regulation" eId="regulation-19"><heading>Interpretation</heading><num>19.</num><intro><p>In this Part—</p></intro><hcontainer name="definition"><content><p>“appeal land” means the land which is the subject of an appeal;</p></content></hcontainer><hcontainer name="definition"><content><p>“appeal period” means the period referred to in regulations 20(1) and 56(1);</p></content></hcontainer><hcontainer name="definition"><content><p>“appointed person” means a person appointed by the Secretary of State under section 8 to determine an appeal or any matter involved in such an appeal and having the powers conferred by paragraphs 3 and 4 of Schedule 3 to <abbr title="Countryside and Rights of Way Act 2000 c. 37">the Act</abbr>;</p></content></hcontainer><hcontainer name="definition"><content><p>“assessor” means a person appointed by the Secretary of State under paragraph 4(3) of Schedule 3 to <abbr title="Countryside and Rights of Way Act 2000 c. 37">the Act</abbr> to sit with an inspector at a hearing or inquiry and advise the inspector on any matter arising;</p></content></hcontainer><hcontainer name="definition"><content><p>“document” includes a photograph, map or plan;</p></content></hcontainer><hcontainer name="definition"><content><p>“hearing” means a hearing in relation to which this Part applies;</p></content></hcontainer><hcontainer name="definition"><content><p>“inquiry” means a local inquiry in relation to which this Part applies;</p></content></hcontainer><hcontainer name="definition"><intro><p>“inspector” means—</p></intro><level class="para1"><num>(a)</num><content><p>an appointed person; or</p></content></level><level class="para1"><num>(b)</num><content><p>a person holding a hearing or inquiry and making a report to the Secretary of State in order for her to determine the appeal;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“interested person” means a person who has made representations to the Secretary of State in respect of the appeal pursuant to regulation 25(c);</p></content></hcontainer><hcontainer name="definition"><content><p>“pre-inquiry meeting” means a meeting held before an inquiry to consider what may be done to ensure that the inquiry is conducted efficiently and expeditiously and, where two or more such meetings are held, references to the conclusion of a pre-inquiry meeting are references to the conclusion of the final meeting;</p></content></hcontainer><hcontainer name="definition"><content><p>“prescribed period” means a period prescribed by these Regulations as one within which certain requirements so prescribed are to be met;</p></content></hcontainer><hcontainer name="definition"><content><p>“proof of evidence” means a proof of evidence sent to the Secretary of State in accordance with regulation 47;</p></content></hcontainer><hcontainer name="definition"><content><p>“questionnaire” means a document, in a form supplied by the Secretary of State, seeking information relating to the appeal;</p></content></hcontainer><hcontainer name="definition"><content><p> <ins class="first last" ukl:ChangeId="key-a6c6a0a3b9d05f710c6c049734340ba6-1534326130747" ukl:CommentaryRef="key-a6c6a0a3b9d05f710c6c049734340ba6"><noteRef uk:name="commentary" href="#key-a6c6a0a3b9d05f710c6c049734340ba6" class="commentary"/>“relevant website” means a website maintained by the Secretary of State for purposes which include making available for inspection certain notices, decisions and notifications relating to an appeal under this Part;</ins> </p></content></hcontainer><hcontainer name="definition"><content><p>“start date” means the date on which certain prescribed periods are to begin, and, in relation to any given appeal, means the date specified by the Secretary of State under regulation 23(1)(a) in her written notice to the appellant and the relevant authority under that regulation;</p></content></hcontainer><hcontainer name="definition"><content><p>“statement of case” means a written statement containing full particulars of the case which a person proposes to put forward, at a hearing or inquiry or by written representations, in relation to the appeal, and includes copies of any supporting documents which that person intends to refer to or put in evidence;</p></content></hcontainer><hcontainer name="definition"><content><p>“statement of common ground” means a written statement which is prepared jointly by the appellant and the relevant authority pursuant to regulation 48, and contains agreed factual information about the appeal;</p></content></hcontainer><hcontainer name="definition"><content><p>“transferred appeal” means an appeal or any matter involved in an appeal, in respect of which the Secretary of State has exercised her power in section 8 to appoint a person to determine the appeal or the matter (as the case may be) on her behalf, and in relation to any such appeal, references in these Regulations to a decision on appeal shall be construed as references to a decision on the appeal or the matter involved in an appeal (as the case may be) which that person has been appointed to determine; and</p></content></hcontainer><hcontainer name="definition"><content><p>“written representations” includes supporting documents.</p></content></hcontainer></hcontainer><hcontainer name="regulation" eId="regulation-20"><heading>Notice of appeal</heading><num>20.</num><paragraph eId="regulation-20-1"><num>(1)</num><intro><p>Any appeal to the Secretary of State under section 30 against a decision of a relevant authority not to act in any respect in accordance with—</p></intro><level class="para1" eId="regulation-20-1-a"><num>(a)</num><content><p>an application made by the appellant for a direction under section 24 or 25(1)(b); or</p></content></level><level class="para1" eId="regulation-20-1-b"><num>(b)</num><content><p>any representations made by the appellant on being consulted by the authority under section 27(5);</p></content></level><wrapUp><p>shall be made by notice given to the Secretary of State, on a form obtained from her, within six weeks of the date on which the authority issued the decision.</p></wrapUp></paragraph><paragraph eId="regulation-20-2"><num>(2)</num><content><p>If the appellant wishes to withdraw the appeal before it is determined, he shall do so by giving notice to the Secretary of State in writing before the appeal is determined, and the Secretary of State shall, as soon as practicable, send a copy of that notice to the relevant authority.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-21"><heading>Notification of receipt of documents <abbr title="et cetera" xml:lang="la">etc.</abbr></heading><num>21.</num><content><p>The Secretary of State shall, as soon as practicable after she has received all the information required to enable her to entertain the appeal, notify the appellant and relevant authority of this in writing and send a copy of the notice of appeal to the authority.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-22"><heading>Preliminary information to be supplied by the relevant authority</heading><num>22.</num><intro><p>The relevant authority shall ensure that, within two weeks of the receipt by them of notification in accordance with regulation 21, the following have been received by the Secretary of State and a copy has been received by the appellant—</p></intro><level class="para1" eId="regulation-22-a"><num>(a)</num><content><p>a completed questionnaire (which shall also state the date on which it is sent to the Secretary of State) together with a copy of each document referred to in it;</p></content></level><level class="para1" eId="regulation-22-b"><num>(b)</num><intro><p>the names and addresses of any person who made representations to the authority in respect of—</p></intro><level class="para2" eId="regulation-22-b-i"><num>(i)</num><content><p>where a decision not to act in any respect in accordance with an application made by the appellant for a direction under section 24 or 25(1)(b) is the subject of the appeal, that application, or</p></content></level><level class="para2" eId="regulation-22-b-ii"><num>(ii)</num><content><p>where a decision not to act in any respect in accordance with any representations made by the appellant on being consulted by the authority under section 27(5) is the subject of the appeal, those representations or the review under section 27(3); and</p></content></level></level><level class="para1" eId="regulation-22-c"><num>(c)</num><content><p>details of the time and place at which the authority intends to make documents available for the purpose of regulation 67.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-23"><heading>Notification of start of appeal <abbr title="et cetera" xml:lang="la">etc.</abbr></heading><num>23.</num><paragraph eId="regulation-23-1"><num>(1)</num><intro><p>The Secretary of State shall, as soon as practicable after receipt of the information required to be supplied by the relevant authority in accordance with regulation 22, notify in writing the appellant, the authority and any other person who has made representations to the authority in respect of the appeal land of—</p></intro><level class="para1" eId="regulation-23-1-a"><num>(a)</num><content><p>the start date;</p></content></level><level class="para1" eId="regulation-23-1-b"><num>(b)</num><content><p>whether the appeal will take the form of a hearing or inquiry or will be determined on the basis of written representations;</p></content></level><level class="para1" eId="regulation-23-1-c"><num>(c)</num><content><p>whether the appeal will be determined by the Secretary of State or by an inspector;</p></content></level><level class="para1" eId="regulation-23-1-d"><num>(d)</num><content><p>the reference number allocated to the appeal;</p></content></level><level class="para1" eId="regulation-23-1-e"><num>(e)</num><content><p>the address (including an e-mail address) to which written communications to the Secretary of State about the appeal are to be sent; and</p></content></level><level class="para1" eId="regulation-23-1-f"><num>(f)</num><content><p>the time and place where documents relating to the appeal are to be made available for the purposes of regulation 67.</p></content></level></paragraph><paragraph eId="regulation-23-2"><num>(2)</num><intro><p>A notice under paragraph (1) shall—</p></intro><level class="para1" eId="regulation-23-2-a"><num>(a)</num><content><p>state the name of the appellant and the location and extent of the appeal land, sufficiently to enable it to be identified;</p></content></level><level class="para1" eId="regulation-23-2-b"><num>(b)</num><intro><p> state that the appeal is in respect of the decision of a relevant authority not to act in accordance with—</p></intro><level class="para2" eId="regulation-23-2-b-i"><num>(i)</num><content><p>an application made by the appellant for a direction under section 24 or 25(1)(b), or</p></content></level><level class="para2" eId="regulation-23-2-b-ii"><num>(ii)</num><content><p>representations made by the appellant on being consulted under section 27(5) in respect of the proposed revocation or variation of such a direction,</p></content></level><wrapUp><p>and provide a brief description of such application or representations;</p></wrapUp></level><level class="para1" eId="regulation-23-2-c"><num>(c)</num><intro><p>state that the relevant authority—</p></intro><level class="para2" eId="regulation-23-2-c-i"><num>(i)</num><content><p>has sent to the Secretary of State and the appellant the name and address of any person, other than the appellant, who made representations to the relevant authority in respect of the matters mentioned in regulation 22(b)(i) or (ii), and</p></content></level><level class="para2" eId="regulation-23-2-c-ii"><num>(ii)</num><content><p>is required to send a copy of such representations to the Secretary of State and the appellant;</p></content></level></level><level class="para1" eId="regulation-23-2-d"><num>(d)</num><content><p>state that, if any such persons wish their representations to be disregarded by the Secretary of State for the purposes of the appeal, they should notify the Secretary of State in writing of this within six weeks of the start date;</p></content></level><level class="para1" eId="regulation-23-2-e"><num>(e)</num><content><p>state that a person who has made any such representations may make further representations in writing to the Secretary of State in respect of the appeal by ensuring that they are received by the Secretary of State within six weeks of the start date;</p></content></level><level class="para1" eId="regulation-23-2-f"><num>(f)</num><content><p>state that any other person may also make representations in writing to the Secretary of State in respect of the appeal by ensuring that they are received by the Secretary of State within such time; and</p></content></level><level class="para1" eId="regulation-23-2-g"><num>(g)</num><content><p>if there is to be a hearing or inquiry, state that any person, other than the appellant or a relevant authority, may be heard with the permission of the inspector and that such permission shall not be unreasonably withheld.</p></content></level></paragraph><paragraph eId="regulation-23-3"><num>(3)</num><content><p>The Secretary of State shall ensure that a copy of the notice of appeal is available for inspection on a  <ins class="substitution first last" ukl:ChangeId="key-549e65ddda2fcfbbac7a22447a6164ab-1534326276509" ukl:CommentaryRef="key-549e65ddda2fcfbbac7a22447a6164ab"><noteRef uk:name="commentary" href="#key-549e65ddda2fcfbbac7a22447a6164ab" class="commentary"/>relevant website</ins>  until the appeal is determined.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-24"><heading>Supply of further information by the relevant authority</heading><num>24.</num><intro><p>The relevant authority shall ensure that, within two weeks of the start date, the Secretary of State and the appellant have received copies of—</p></intro><level class="para1" eId="regulation-24-a"><num>(a)</num><intro><p>any representations made to the relevant authority in respect of—</p></intro><level class="para2" eId="regulation-24-a-i"><num>(i)</num><content><p>the application made by the appellant for a direction under section 24 or 25(1)(b), or</p></content></level><level class="para2" eId="regulation-24-a-ii"><num>(ii)</num><content><p>any representations made by the appellant on being consulted by the authority under section 27(5) or the review under section 27(3),</p></content></level><wrapUp><p>where a decision not to act in any respect in accordance with such application or representations is or are the subject of the appeal; and</p></wrapUp></level><level class="para1" eId="regulation-24-b"><num>(b)</num><content><p>any correspondence between the appellant and the relevant authority relating to such application or representations made by the appellant.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-25"><heading>Submission of statements of case <abbr title="et cetera" xml:lang="la">etc.</abbr></heading><num>25.</num><intro><p>Within six weeks of the start date—</p></intro><level class="para1" eId="regulation-25-a"><num>(a)</num><content><p>the relevant authority shall ensure that the Secretary of State has received two copies of their statement of case;</p></content></level><level class="para1" eId="regulation-25-b"><num>(b)</num><content><p>the appellant shall ensure that the Secretary of State has received two copies of his statement of case; and</p></content></level><level class="para1" eId="regulation-25-c"><num>(c)</num><content><p>any other person who wishes to make representations to the Secretary of State in respect of the appeal shall ensure that the Secretary of State has received three copies of such representations.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-26"><heading>Copies of documents <abbr title="et cetera" xml:lang="la">etc.</abbr></heading><num>26.</num><paragraph eId="regulation-26-1"><num>(1)</num><intro><p>The Secretary of State shall, as soon as practicable after receipt of copies of the documents referred to in regulation 25—</p></intro><level class="para1" eId="regulation-26-1-a"><num>(a)</num><content><p>send to the appellant a copy of any statement of case submitted by the relevant authority under regulation 25(a);</p></content></level><level class="para1" eId="regulation-26-1-b"><num>(b)</num><content><p>send to the relevant authority a copy of any statement of case submitted by the appellant under regulation 25(b); and</p></content></level><level class="para1" eId="regulation-26-1-c"><num>(c)</num><content><p>send to the appellant and the relevant authority a copy of any representations submitted by any interested person.</p></content></level></paragraph><paragraph eId="regulation-26-2"><num>(2)</num><intro><p>The Secretary of State shall, as soon as practicable after the receipt of any further information required under regulation 28, send a copy of the documents received—</p></intro><level class="para1" eId="regulation-26-2-a"><num>(a)</num><content><p>in the case of information received from the appellant or the relevant authority, to the other party; and</p></content></level><level class="para1" eId="regulation-26-2-b"><num>(b)</num><content><p>in the case of information received from any interested person, to the appellant and the relevant authority.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-27"><heading>Comments on statement of case <abbr title="et cetera" xml:lang="la">etc.</abbr></heading><num>27.</num><intro><p>Within nine weeks of the start date—</p></intro><level class="para1" eId="regulation-27-a"><num>(a)</num><intro><p>the appellant shall ensure that the Secretary of State has received any comments which he may wish to make on—</p></intro><level class="para2" eId="regulation-27-a-i"><num>(i)</num><content><p>the relevant authority’s statement of case, or</p></content></level><level class="para2" eId="regulation-27-a-ii"><num>(ii)</num><content><p>any representations made by any interested person; and</p></content></level></level><level class="para1" eId="regulation-27-b"><num>(b)</num><content><p>the relevant authority shall ensure the Secretary of State has received any comments which they may wish to make on the appellant’s statement of case or any such representations.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-28"><heading>Provision of further information</heading><num>28.</num><intro><p>The Secretary of State, or the inspector, may require such further information as she or he may specify from—</p></intro><level class="para1" eId="regulation-28-a"><num>(a)</num><content><p>the appellant or the relevant authority in respect of their statement of case;</p></content></level><level class="para1" eId="regulation-28-b"><num>(b)</num><content><p>any interested person,</p></content></level><wrapUp><p>and all such information shall be provided in writing within such period as the Secretary of State, or the inspector, may reasonably require.</p></wrapUp></hcontainer></chapter><chapter eId="part-III-chapter-II"><num>CHAPTER II</num><heading><i>Appeals to be determined on the basis of written representations</i></heading><hcontainer name="regulation" eId="regulation-29"><heading>Site inspections</heading><num>29.</num><paragraph eId="regulation-29-1"><num>(1)</num><content><p>Where it appears to the Secretary of State necessary or expedient to do so she may arrange for an inspection of the appeal land to be made by an inspector <noteRef href="#key-faf1c10828ce3666494b479d94961fb1" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>....</p></content></paragraph><paragraph eId="regulation-29-2"><num>(2)</num><content><p>Where the inspector intends to make an inspection under paragraph (1), the Secretary of State shall ask the appellant and the relevant authority whether they wish to be present or be represented.</p></content></paragraph><paragraph eId="regulation-29-3"><num>(3)</num><content><p>Where the appellant or the relevant authority has indicated that he or they wish to be present or be represented the inspector shall give the appellant and the authority reasonable notice of the date and time of the inspection and shall afford the appellant and the authority, or their representatives, the opportunity of being present during the inspection.</p></content></paragraph><paragraph eId="regulation-29-4"><num>(4)</num><content><p>The inspector shall not be bound to defer an inspection if the appellant or the authority, or their representative, is not present at the appointed time.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-30"><heading>Decision on appeal</heading><num>30.</num><content><p>The Secretary of State or, as the case may be, the inspector may proceed to a decision on an appeal taking into account only such statements of case, representations and comments as have been provided within the time limits prescribed by or under these Regulations.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-31"><heading>Notification of decision</heading><num>31.</num><intro><p>The Secretary of State, or as the case may be, the inspector shall notify their decision on an appeal, and their reasons for it, in writing to—</p></intro><level class="para1" eId="regulation-31-a"><num>(a)</num><content><p>the appellant;</p></content></level><level class="para1" eId="regulation-31-b"><num>(b)</num><content><p>the relevant authority; and</p></content></level><level class="para1" eId="regulation-31-c"><num>(c)</num><content><p>any interested person;</p></content></level><wrapUp><p>and the Secretary of State shall ensure that, as soon as practicable after such decision has been made, a copy of the decision is made available for inspection on a  <ins class="substitution first last" ukl:ChangeId="key-d895a251d02810abcc6064780dbd5a97-1534326471557" ukl:CommentaryRef="key-d895a251d02810abcc6064780dbd5a97"><noteRef uk:name="commentary" href="#key-d895a251d02810abcc6064780dbd5a97" class="commentary"/>relevant website</ins>  for a period of three months starting with the date of the decision.</p></wrapUp></hcontainer></chapter><chapter eId="part-III-chapter-III"><num>CHAPTER III</num><heading><i>Appeals determined by way of a hearing</i></heading><hcontainer name="regulation" eId="regulation-32"><heading>Date and notification of hearing</heading><num>32.</num><paragraph eId="regulation-32-1"><num>(1)</num><content><p>The date fixed by the Secretary of State for a hearing shall be the earliest date after the expiry of the appeal period which she considers to be practicable having regard to the desirability of arranging for consecutive or concurrent hearings to be held in connection with appeals against a decision of a relevant authority.</p></content></paragraph><paragraph eId="regulation-32-2"><num>(2)</num><intro><p>If the Secretary of State does not consider it desirable to arrange consecutive or concurrent hearings in connection with appeals against a decision of a relevant authority, the date fixed for the holding of a hearing shall be—</p></intro><level class="para1" eId="regulation-32-2-a"><num>(a)</num><content><p>not later than twenty-two weeks after the start date, unless she considers such a date impracticable; or</p></content></level><level class="para1" eId="regulation-32-2-b"><num>(b)</num><content><p>the earliest date after that period which she considers to be practicable.</p></content></level></paragraph><paragraph eId="regulation-32-3"><num>(3)</num><content><p>Unless the Secretary of State agrees a lesser period of notice with the appellant and the relevant authority, she shall give the appellant, the authority and any interested person not less than four weeks' written notice of the date, time and place fixed by her for the holding of a hearing.</p></content></paragraph><paragraph eId="regulation-32-4"><num>(4)</num><content><p>The Secretary of State may at any time change the date fixed for the holding of a hearing (whether or not the new date is within the period mentioned in paragraph (2)) and paragraph (3) shall apply to the new date.</p></content></paragraph><paragraph eId="regulation-32-5"><num>(5)</num><content><p>The Secretary of State may at any time change the time or place for the holding of a hearing and shall give such notice of any change to the persons mentioned in paragraph (3) as appears to her to be reasonable.</p></content></paragraph><paragraph eId="regulation-32-6"><num>(6)</num><content><p>The Secretary of State may require the relevant authority to publish, not less than two weeks before the date fixed for the hearing, a notice of the hearing in one or more newspapers circulating in the locality in which the appeal land is situated; and the Secretary of State shall ensure that  <ins class="substitution first last" ukl:ChangeId="key-684f80306ff765828980a5e9f66ae57c-1534326585637" ukl:CommentaryRef="key-684f80306ff765828980a5e9f66ae57c"><noteRef uk:name="commentary" href="#key-684f80306ff765828980a5e9f66ae57c" class="commentary"/>a copy of such notice is available for inspection on a relevant website</ins>  until the appeal is determined.</p></content></paragraph><paragraph eId="regulation-32-7"><num>(7)</num><intro><p>Every notice of a hearing published pursuant to paragraph (6) shall contain—</p></intro><level class="para1" eId="regulation-32-7-a"><num>(a)</num><content><p>a statement of the date, time and place of the hearing and of the powers enabling the Secretary of State to determine the appeal in question; and</p></content></level><level class="para1" eId="regulation-32-7-b"><num>(b)</num><content><p>a brief description of the appeal land and of the grounds of appeal.</p></content></level></paragraph><paragraph eId="regulation-32-8"><num>(8)</num><content><p>A notice referred to in paragraph (6) may relate to more than one hearing.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-33"><heading>Consecutive and concurrent hearings</heading><num>33.</num><content><p>The Secretary of State may arrange for two or more appeals to be heard consecutively or concurrently where they relate to the same area of land or to areas of land which she considers to be in such proximity as to make it expedient for the hearings to be held consecutively or concurrently.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-34"><heading>Appearances at hearing</heading><num>34.</num><paragraph eId="regulation-34-1"><num>(1)</num><intro><p>The persons entitled to appear at the hearing are—</p></intro><level class="para1" eId="regulation-34-1-a"><num>(a)</num><content><p>the appellant; and</p></content></level><level class="para1" eId="regulation-34-1-b"><num>(b)</num><content><p>the relevant authority;</p></content></level><wrapUp><p>but the inspector may permit any other person to appear at a hearing, and such permission shall not be unreasonably withheld.</p></wrapUp></paragraph><paragraph eId="regulation-34-2"><num>(2)</num><content><p>Any person entitled or permitted to appear may appear in person or be represented by any other person.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-35"><heading>Notification of name of inspector</heading><num>35.</num><content><p>The inspector shall, at the commencement of the hearing, announce his name and the fact of his appointment.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-36"><heading>Procedure at hearing</heading><num>36.</num><paragraph eId="regulation-36-1"><num>(1)</num><content><p>The inspector shall determine the procedure at a hearing.</p></content></paragraph><paragraph eId="regulation-36-2"><num>(2)</num><content><p>A hearing shall take the form of a discussion led by an inspector, and cross-examination shall not be permitted unless the inspector considers that cross-examination is required to ensure a thorough examination of the main issues.</p></content></paragraph><paragraph eId="regulation-36-3"><num>(3)</num><content><p>Where the inspector considers that cross-examination is required under paragraph (2), he shall consider, after consulting the appellant and the relevant authority, whether the hearing should be closed and an inquiry held instead.</p></content></paragraph><paragraph eId="regulation-36-4"><num>(4)</num><content><p>At the start of the hearing the inspector shall identify what are, in his opinion, the main issues to be considered at the hearing and any matters on which he requires further explanation from any person appearing at the hearing; but this shall not preclude the addition in the course of the hearing of other issues for consideration or any persons appearing at the hearing from referring to issues which they consider relevant to the consideration of the appeal but which were not issues so identified by the inspector.</p></content></paragraph><paragraph eId="regulation-36-5"><num>(5)</num><content><p>The appellant and the relevant authority shall be entitled to give, or to call another person to give, oral evidence, and any other person may give, or call another person to give, oral evidence if so permitted by an inspector at his discretion, but notwithstanding any such entitlement or permission, the inspector may, at any stage in the proceedings, refuse to permit the giving of evidence or presentation of any other matter which he considers to be irrelevant or repetitious.</p></content></paragraph><paragraph eId="regulation-36-6"><num>(6)</num><content><p>Where the inspector refuses to permit the giving of oral evidence, the person wishing to give, or call any other person to give, evidence may submit to him any evidence or other matter in writing before the close of the hearing.</p></content></paragraph><paragraph eId="regulation-36-7"><num>(7)</num><content><p>The inspector may require any person appearing or present at a hearing who, in his opinion, is behaving in a disruptive manner to leave the hearing; and the inspector may then refuse to permit that person to return or permit him to return only on such conditions as he may specify, but any such person may submit to the inspector any evidence or other matter in writing before the close of the hearing.</p></content></paragraph><paragraph eId="regulation-36-8"><num>(8)</num><content><p>The inspector may allow the appellant or the relevant authority to alter or make any addition to a statement of case submitted under regulation 25 (a) or (b) so far as may be necessary for the purposes of the hearing.</p></content></paragraph><paragraph eId="regulation-36-9"><num>(9)</num><intro><p>The inspector may—</p></intro><level class="para1" eId="regulation-36-9-a"><num>(a)</num><content><p>proceed with a hearing in the absence of any person entitled to appear at it;</p></content></level><level class="para1" eId="regulation-36-9-b"><num>(b)</num><content><p>take into account any written representations or evidence or any other document received by him from any person before a hearing opens or during the hearing provided he discloses it at the hearing; and</p></content></level><level class="para1" eId="regulation-36-9-c"><num>(c)</num><content><p>from time to time adjourn a hearing, and, if the date, time and place of the adjourned hearing are announced at the hearing before the adjournment, no further notice shall be required.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-37"><heading>Site inspections</heading><num>37.</num><paragraph eId="regulation-37-1"><num>(1)</num><intro><p>Where it appears to an inspector that one or more matters would be more satisfactorily resolved by adjourning the hearing to the site of the appeal land he may adjourn the hearing to that site and conclude the hearing there provided he is satisfied that—</p></intro><level class="para1" eId="regulation-37-1-a"><num>(a)</num><content><p>the hearing would proceed satisfactorily and that no party would be placed at a disadvantage;</p></content></level><level class="para1" eId="regulation-37-1-b"><num>(b)</num><content><p>all parties present at the hearing would have the opportunity to attend the adjourned hearing; and</p></content></level><level class="para1" eId="regulation-37-1-c"><num>(c)</num><content><p>neither the appellant nor the relevant authority has raised any reasonable objections to its being continued at the site of the appeal land.</p></content></level></paragraph><paragraph eId="regulation-37-2"><num>(2)</num><content><p>Unless the hearing is to be adjourned to the appeal land pursuant to paragraph (1), the inspector may, where it appears to him necessary or expedient to do so, arrange to make an inspection of the appeal land in the company of the appellant and the relevant authority or their representatives <noteRef href="#key-f7acb393087f34252091294280085fba" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>....</p></content></paragraph><paragraph eId="regulation-37-3"><num>(3)</num><content><p>In all cases where the inspector intends to make a site inspection he shall announce during the hearing the date and time at which he proposes to make it.</p></content></paragraph><paragraph eId="regulation-37-4"><num>(4)</num><content><p>The inspector shall not be bound to defer an inspection if the appellant or the relevant authority is not present at the appointed time.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-38"><heading>Procedure after hearing—appeals determined by the Secretary of State</heading><num>38.</num><paragraph eId="regulation-38-1"><num>(1)</num><content><p>This regulation applies where a hearing has been held for the purposes of any appeal determined by the Secretary of State.</p></content></paragraph><paragraph eId="regulation-38-2"><num>(2)</num><content><p>After the close of the hearing, the inspector shall make a report in writing to the Secretary of State which shall include his conclusions and his recommendations or his reasons for not making any recommendations.</p></content></paragraph><paragraph eId="regulation-38-3"><num>(3)</num><content><p>Where an assessor has been appointed, he shall, after the close of the hearing, make a report in writing to the inspector in respect of the matters on which he was appointed to advise.</p></content></paragraph><paragraph eId="regulation-38-4"><num>(4)</num><content><p>Where an assessor makes such a report, the inspector shall append it to his own report and shall state in his own report how far he agrees or disagrees with the assessor’s report and, where he disagrees with the assessor, his reasons for that disagreement.</p></content></paragraph><paragraph eId="regulation-38-5"><num>(5)</num><content><p>When making her determination the Secretary of State may disregard any written representations, evidence or other document received after the hearing is closed.</p></content></paragraph><paragraph eId="regulation-38-6"><num>(6)</num><intro><p>If, after the close of the hearing, the Secretary of State—</p></intro><level class="para1" eId="regulation-38-6-a"><num>(a)</num><content><p>differs from an inspector on any matter of fact mentioned in, or appearing to her to be material to, a conclusion reached by the inspector; or</p></content></level><level class="para1" eId="regulation-38-6-b"><num>(b)</num><content><p>takes into consideration any new evidence or new matter of fact,</p></content></level><wrapUp><p>and is, for that reason, disposed to disagree with a recommendation made by the inspector, she shall not come to a decision which is at variance with that recommendation without first notifying the appellant, the relevant authority and any other person who appeared at the hearing of her disagreement and the reasons for it, and affording them an opportunity of making written representations to her or, if the Secretary of State has taken into consideration any new evidence or new matter of fact, of asking for the re-opening of the hearing.</p></wrapUp></paragraph><paragraph eId="regulation-38-7"><num>(7)</num><content><p>Those persons making written representations or requesting the re-opening of the hearing pursuant to paragraph (6) shall ensure that such representations or requests are received by the Secretary of State within three weeks of the date of the Secretary of State’s notification under that paragraph.</p></content></paragraph><paragraph eId="regulation-38-8"><num>(8)</num><intro><p>The Secretary of State may, if she thinks fit, cause a hearing to be re-opened, and she shall do so if asked by the appellant or the relevant authority in the circumstances mentioned in paragraph (6) and within the period mentioned in paragraph (7); and where a hearing is re-opened (whether by the same or a different inspector)—</p></intro><level class="para1" eId="regulation-38-8-a"><num>(a)</num><content><p>the Secretary of State shall send to the persons mentioned in paragraph (6) a written statement of the matters with respect to which further evidence is invited; and</p></content></level><level class="para1" eId="regulation-38-8-b"><num>(b)</num><content><p>paragraphs (3) to (8) of regulation 32 shall apply as if the references to a hearing were references to a re-opened hearing.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-39"><heading>Procedure after hearing—transferred appeals</heading><num>39.</num><paragraph eId="regulation-39-1"><num>(1)</num><content><p>This regulation applies where a hearing has been held for the purposes of a transferred appeal.</p></content></paragraph><paragraph eId="regulation-39-2"><num>(2)</num><content><p>Where an assessor has been appointed he shall, after the close of the hearing, make a report in writing to the inspector of the matters on which he was appointed to advise, and the inspector shall state in the notification of his decision pursuant to regulation 41 that such a report was made.</p></content></paragraph><paragraph eId="regulation-39-3"><num>(3)</num><content><p>When making his decision the inspector may disregard any written representations, or evidence or any other document received after the hearing has closed.</p></content></paragraph><paragraph eId="regulation-39-4"><num>(4)</num><intro><p>If, after the close of the hearing, an inspector proposes to take into account any new evidence or matter of fact which was not raised at the hearing and which he considers to be material to his decision, he shall not come to a decision without first—</p></intro><level class="para1" eId="regulation-39-4-a"><num>(a)</num><content><p>notifying the appellant and the relevant authority and any other person who appeared at the hearing; and</p></content></level><level class="para1" eId="regulation-39-4-b"><num>(b)</num><content><p>affording them an opportunity of making written representations to him or of asking for the re-opening of the hearing,</p></content></level><wrapUp><p>and they shall ensure that such written representations or request to re-open the hearing are received by the Secretary of State within three weeks of the date of notification.</p></wrapUp></paragraph><paragraph eId="regulation-39-5"><num>(5)</num><intro><p>An inspector may, if he thinks fit, cause a hearing to be re-opened and he shall do so if asked by the appellant or the relevant authority in the circumstances and within the period mentioned in paragraph (4); and where a hearing is re-opened—</p></intro><level class="para1" eId="regulation-39-5-a"><num>(a)</num><content><p>the inspector shall send to the appellant, the relevant authority and any other person who appeared at the hearing a written statement of the matters with respect to which further evidence is invited; and</p></content></level><level class="para1" eId="regulation-39-5-b"><num>(b)</num><content><p>paragraphs (3) to (8) of regulation 32 shall apply as if the references to a hearing were references to a re-opened hearing.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-40"><heading>Notification of decision—appeals determined by the Secretary of State</heading><num>40.</num><paragraph eId="regulation-40-1"><num>(1)</num><content><p>This regulation applies where a hearing has been held for the purposes of any appeal determined by the Secretary of State.</p></content></paragraph><paragraph eId="regulation-40-2"><num>(2)</num><intro><p>The Secretary of State shall notify her decision on an appeal, and her reasons for reaching it, in writing to—</p></intro><level class="para1" eId="regulation-40-2-a"><num>(a)</num><content><p>the appellant and the relevant authority; and</p></content></level><level class="para1" eId="regulation-40-2-b"><num>(b)</num><intro><p>any other person who—</p></intro><level class="para2" eId="regulation-40-2-b-i"><num>(i)</num><content><p>appeared at the hearing, or</p></content></level><level class="para2" eId="regulation-40-2-b-ii"><num>(ii)</num><content><p>is an interested person.</p></content></level></level></paragraph><paragraph eId="regulation-40-3"><num>(3)</num><content><p>Where a copy of the inspector’s report is not sent with the notification of the decision, the notification shall be accompanied by a statement of his conclusions and of any recommendations made by him; and if a person entitled to be notified of the decision has not received a copy of that report, he shall be supplied with a copy of it on written application to the Secretary of State.</p></content></paragraph><paragraph eId="regulation-40-4"><num>(4)</num><content><p>In this regulation, “report” does not include any documents appended to the inspector’s report; but any person who has received a copy of the report may apply to the Secretary of State in writing for an opportunity to inspect any such documents and the Secretary of State shall afford him that opportunity.</p></content></paragraph><paragraph eId="regulation-40-5"><num>(5)</num><content><p>A person applying to the Secretary of State under paragraph (3) or (4) shall ensure that his application is received by the Secretary of State within four weeks and six weeks, respectively, of the date of the decision of the Secretary of State.</p></content></paragraph><paragraph eId="regulation-40-6"><num>(6)</num><content><p>The Secretary of State shall ensure that, as soon as practicable after any notification has been given under paragraph (2), a copy of the notification is made available for inspection on  <ins class="substitution first last" ukl:ChangeId="key-89fe1e4abfdf33099ea102171fd21fb0-1534326803289" ukl:CommentaryRef="key-89fe1e4abfdf33099ea102171fd21fb0"><noteRef uk:name="commentary" href="#key-89fe1e4abfdf33099ea102171fd21fb0" class="commentary"/>a relevant website</ins>  for a period of three months.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-41"><heading>Notification of decision—transferred appeals</heading><num>41.</num><paragraph eId="regulation-41-1"><num>(1)</num><content><p>This regulation applies where a hearing has been held for the purposes of a transferred appeal.</p></content></paragraph><paragraph eId="regulation-41-2"><num>(2)</num><intro><p>An inspector shall notify his decision on an appeal, and his reasons for it, in writing to—</p></intro><level class="para1" eId="regulation-41-2-a"><num>(a)</num><content><p>the appellant and the relevant authority; and</p></content></level><level class="para1" eId="regulation-41-2-b"><num>(b)</num><intro><p>any other person who—</p></intro><level class="para2" eId="regulation-41-2-b-i"><num>(i)</num><content><p>appeared at the hearing, or</p></content></level><level class="para2" eId="regulation-41-2-b-ii"><num>(ii)</num><content><p>is an interested person.</p></content></level></level></paragraph><paragraph eId="regulation-41-3"><num>(3)</num><content><p>Any person entitled to be notified of the inspector’s decision under paragraph (2) may apply to the Secretary of State in writing for an opportunity of inspecting any documents listed in the notification and the Secretary of State shall afford him that opportunity.</p></content></paragraph><paragraph eId="regulation-41-4"><num>(4)</num><content><p>Any person making an application under paragraph (3) shall ensure that it is received by the Secretary of State within six weeks of the date of the inspector’s decision.</p></content></paragraph><paragraph eId="regulation-41-5"><num>(5)</num><content><p>The Secretary of State shall ensure that, as soon as practicable after any notification has been given under paragraph (2), a copy of the notification is made available for inspection on a  <ins class="substitution first last" ukl:ChangeId="key-b258b9ed1273f2827fc3e7f8b70f23b2-1534326886820" ukl:CommentaryRef="key-b258b9ed1273f2827fc3e7f8b70f23b2"><noteRef uk:name="commentary" href="#key-b258b9ed1273f2827fc3e7f8b70f23b2" class="commentary"/>relevant website</ins>  for a period of three months.</p></content></paragraph></hcontainer></chapter><chapter eId="part-III-chapter-IV"><num>CHAPTER IV</num><heading><i>Appeals to be determined by way of an inquiry</i></heading><hcontainer name="regulation" eId="regulation-42"><heading>Statements of case</heading><num>42.</num><content><p>The appellant and the relevant authority may each in writing require the other to provide a copy of any document referred to in the list of documents comprised in their statement of case, and any such document (or relevant part of it) shall be sent, as soon as practicable, to the party who required it.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-43"><heading>Procedure where the Secretary of State or inspector causes a pre-inquiry meeting to be held</heading><num>43.</num><paragraph eId="regulation-43-1"><num>(1)</num><content><p>The Secretary of State or the inspector shall hold a pre-inquiry meeting if it appears to them to be necessary, and any such meeting (or, where there is more than one, the first such meeting) shall be held within sixteen weeks of the start date or at the earliest practicable time thereafter.</p></content></paragraph><paragraph eId="regulation-43-2"><num>(2)</num><content><p>Where the Secretary of State or the inspector decides to hold such a meeting he or she shall notify in writing the appellant and the relevant authority of their intention to hold such a meeting.</p></content></paragraph><paragraph eId="regulation-43-3"><num>(3)</num><intro><p>The Secretary of State or the inspector shall give not less than two weeks' written notice of the pre-inquiry meeting to—</p></intro><level class="para1" eId="regulation-43-3-a"><num>(a)</num><content><p>the appellant and the relevant authority; and</p></content></level><level class="para1" eId="regulation-43-3-b"><num>(b)</num><content><p>any other person whose presence at the pre-inquiry meeting she or they consider desirable.</p></content></level></paragraph><paragraph eId="regulation-43-4"><num>(4)</num><intro><p>The inspector—</p></intro><level class="para1" eId="regulation-43-4-a"><num>(a)</num><content><p>shall preside at the pre-inquiry meeting;</p></content></level><level class="para1" eId="regulation-43-4-b"><num>(b)</num><content><p>shall determine the matters to be discussed and the procedure to be followed;</p></content></level><level class="para1" eId="regulation-43-4-c"><num>(c)</num><content><p>may require any person present at the pre-inquiry meeting who he considers is behaving in a disruptive manner to leave; and</p></content></level><level class="para1" eId="regulation-43-4-d"><num>(d)</num><content><p>may refuse to permit that person to return or to attend any further pre-inquiry meeting or may permit him to return or attend only on such conditions as he may specify.</p></content></level></paragraph><paragraph eId="regulation-43-5"><num>(5)</num><content><p>Where a pre-inquiry meeting is held pursuant to paragraph (1), the inspector may hold a further pre-inquiry meeting and he shall arrange for such notice to be given of a further pre-inquiry meeting as appears to him necessary; and paragraph (4) shall apply to such a pre-inquiry meeting.</p></content></paragraph><paragraph eId="regulation-43-6"><num>(6)</num><content><p>If the Secretary of State or the inspector requests any further information at the pre-inquiry meeting from the appellant, the relevant authority or any other person present at that meeting, the person required to provide the information shall ensure that two copies of it have been received by the Secretary of State or the inspector, as the case may be, within four weeks of the conclusion of the pre-inquiry meeting; and the Secretary of State shall, as soon as practicable after receipt of any such information, send a copy of it to the other parties entitled to appear at the inquiry.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-44"><heading>Inquiry timetable</heading><num>44.</num><paragraph eId="regulation-44-1"><num>(1)</num><content><p>Where a pre-inquiry meeting is held pursuant to regulation 43, the inspector shall arrange a timetable for the proceedings at, or at part of, the inquiry.</p></content></paragraph><paragraph eId="regulation-44-2"><num>(2)</num><content><p>The inspector shall specify in a timetable arranged pursuant to this regulation a date by which any proof of evidence sent in accordance with regulation 47 shall be received by the Secretary of State.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-45"><heading>Date and notification of inquiry</heading><num>45.</num><paragraph eId="regulation-45-1"><num>(1)</num><intro><p>The date fixed by the Secretary of State for the holding of an inquiry shall, unless she considers such a date to be impracticable, be not later than—</p></intro><level class="para1" eId="regulation-45-1-a"><num>(a)</num><content><p>subject to sub-paragraph (b), twenty-two weeks after the start date; or</p></content></level><level class="para1" eId="regulation-45-1-b"><num>(b)</num><content><p>where a pre-inquiry meeting is held pursuant to regulation 43, eight weeks after the conclusion of that meeting.</p></content></level></paragraph><paragraph eId="regulation-45-2"><num>(2)</num><content><p>Where the Secretary of State considers it impracticable to fix a date in accordance with paragraph (1), the date fixed shall be the earliest date which she considers to be practicable after the expiry of the relevant period mentioned in that paragraph.</p></content></paragraph><paragraph eId="regulation-45-3"><num>(3)</num><content><p>Unless the Secretary of State agrees a lesser period of notice with the appellant and the relevant authority, she shall give to the appellant, the relevant authority and any interested person not less than four weeks' written notice of the date, time and place fixed by her for the holding of an inquiry.</p></content></paragraph><paragraph eId="regulation-45-4"><num>(4)</num><intro><p>The Secretary of State may—</p></intro><level class="para1" eId="regulation-45-4-a"><num>(a)</num><content><p>change the date fixed for the holding of an inquiry (whether or not the date as changed is within the relevant period mentioned in paragraph (1)); or</p></content></level><level class="para1" eId="regulation-45-4-b"><num>(b)</num><content><p>change the time or place for the holding of an inquiry.</p></content></level></paragraph><paragraph eId="regulation-45-5"><num>(5)</num><content><p>Where, under paragraph (4)(a), the Secretary of State changes the date for the holding of an inquiry, paragraph (3) shall apply to the new date as it applied to the date originally fixed, and where, under paragraph (4)(b), she changes the time or place for the holding of an inquiry, she shall give such notice of such change as appears to her to be reasonable.</p></content></paragraph><paragraph eId="regulation-45-6"><num>(6)</num><content><p>The Secretary of State may require the relevant authority to publish, not less than two weeks before the date fixed for the holding of an inquiry, a notice of the inquiry in one or more newspapers circulating in the locality in which the appeal land is situated; and the Secretary of State shall ensure that  <ins class="substitution first last" ukl:ChangeId="key-8355e40b59c8dd14447c253410117aac-1534327008315" ukl:CommentaryRef="key-8355e40b59c8dd14447c253410117aac"><noteRef uk:name="commentary" href="#key-8355e40b59c8dd14447c253410117aac" class="commentary"/>a copy of such notice is available for inspection on a relevant website</ins>  until the appeal is determined.</p></content></paragraph><paragraph eId="regulation-45-7"><num>(7)</num><intro><p>Every notice of an inquiry published pursuant to paragraph (6) shall contain—</p></intro><level class="para1" eId="regulation-45-7-a"><num>(a)</num><content><p>a statement of the date, time and place of the inquiry and of the powers enabling the Secretary of State to determine the appeal in question; and</p></content></level><level class="para1" eId="regulation-45-7-b"><num>(b)</num><content><p>a brief description of the appeal land and of the grounds of appeal.</p></content></level></paragraph><paragraph eId="regulation-45-8"><num>(8)</num><content><p>A notice referred to in paragraph (6) may relate to more than one inquiry.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-46"><heading>Notification of name of inspector</heading><num>46.</num><content><p>The inspector shall, at the commencement of the inquiry, announce his name and the fact of his appointment.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-47"><heading>Proofs of evidence</heading><num>47.</num><paragraph eId="regulation-47-1"><num>(1)</num><content><p>Subject to paragraph (2), where the appellant or the relevant authority propose to give, or to call another person to give, evidence at the inquiry by reading a proof of evidence he or they shall send two copies of the proof of evidence, together with any written summary accompanying it, to the Secretary of State; and the Secretary of State shall, as soon as practicable after receipt, send to the appellant or the authority, as appropriate, a copy of the other’s proof of evidence together with any written summary accompanying it.</p></content></paragraph><paragraph eId="regulation-47-2"><num>(2)</num><content><p>A written summary shall be required where the proof of evidence in question exceeds one thousand five hundred words.</p></content></paragraph><paragraph eId="regulation-47-3"><num>(3)</num><intro><p>The appellant and the relevant authority shall ensure that the proof of evidence and any summary shall be received by the Secretary of State no later than—</p></intro><level class="para1" eId="regulation-47-3-a"><num>(a)</num><content><p>four weeks before the date fixed for the holding of the inquiry; or</p></content></level><level class="para1" eId="regulation-47-3-b"><num>(b)</num><content><p>where a timetable has been arranged pursuant to regulation 44 which specifies a date by which the proof of evidence and any summary shall be received by the Secretary of State, that date.</p></content></level></paragraph><paragraph eId="regulation-47-4"><num>(4)</num><content><p>Where a written summary is provided in accordance with paragraph (1), only that summary shall be read at the inquiry, unless the inspector permits or requires otherwise.</p></content></paragraph><paragraph eId="regulation-47-5"><num>(5)</num><content><p>Any person required by this regulation to send copies of a proof of evidence to the Secretary of State shall send with them the same number of copies of the whole (or the relevant part) of any document referred to in the proof of evidence.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-48"><heading>Statement of common ground</heading><num>48.</num><content><p>The appellant and the relevant authority shall together prepare a statement of common ground and the authority shall ensure that the Secretary of State receives it not less than four weeks before the date fixed for the holding of the inquiry.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-49"><heading>Appearances at inquiry</heading><num>49.</num><paragraph eId="regulation-49-1"><num>(1)</num><intro><p>The persons entitled to appear at an inquiry are—</p></intro><level class="para1" eId="regulation-49-1-a"><num>(a)</num><content><p>the appellant; and</p></content></level><level class="para1" eId="regulation-49-1-b"><num>(b)</num><content><p>the relevant authority;</p></content></level><wrapUp><p>but the inspector may permit any other person to appear at an inquiry, and such permission shall not be unreasonably withheld.</p></wrapUp></paragraph><paragraph eId="regulation-49-2"><num>(2)</num><content><p>Any person entitled or permitted to appear may appear in person or be represented by any other person.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-50"><heading>Procedure at inquiry</heading><num>50.</num><paragraph eId="regulation-50-1"><num>(1)</num><content><p>The inspector shall determine the procedure at an inquiry.</p></content></paragraph><paragraph eId="regulation-50-2"><num>(2)</num><content><p>At the start of the inquiry the inspector shall identify what are, in his opinion, the main issues to be considered at the inquiry and any matters on which he requires further explanation from any person appearing at the inquiry.</p></content></paragraph><paragraph eId="regulation-50-3"><num>(3)</num><content><p>Nothing in paragraph (2) shall preclude the addition in the course of the inquiry of other issues for consideration or preclude any person entitled or permitted to appear from referring to issues which that person considers relevant to the consideration of the appeal but which were not issues identified by the inspector pursuant to that paragraph.</p></content></paragraph><paragraph eId="regulation-50-4"><num>(4)</num><content><p>Unless in a particular case the inspector otherwise determines, the relevant authority shall begin and the appellant shall have the right of final reply; and any other persons appearing at the inquiry shall be heard in such order as the inspector shall determine.</p></content></paragraph><paragraph eId="regulation-50-5"><num>(5)</num><content><p>Subject to paragraph (6), a person appearing at an inquiry shall be entitled to give, or call any other person to give, oral evidence and the appellant and the relevant authority shall be entitled to cross-examine persons giving evidence, and any other person, if so permitted by the inspector at his discretion, may give or call another person to give evidence, and may cross-examine any person giving evidence.</p></content></paragraph><paragraph eId="regulation-50-6"><num>(6)</num><intro><p>The inspector may at any stage in the proceedings refuse to permit—</p></intro><level class="para1" eId="regulation-50-6-a"><num>(a)</num><content><p>the giving or production of evidence;</p></content></level><level class="para1" eId="regulation-50-6-b"><num>(b)</num><content><p>the cross-examination of persons giving evidence; or</p></content></level><level class="para1" eId="regulation-50-6-c"><num>(c)</num><content><p>the presentation of any matter,</p></content></level><wrapUp><p>which he considers to be irrelevant or repetitious.</p></wrapUp></paragraph><paragraph eId="regulation-50-7"><num>(7)</num><content><p>Where under paragraph (5) or (6) the inspector refuses to permit the giving of oral evidence, the person wishing to give the evidence may submit to him any evidence or other matter in writing before the close of the inquiry.</p></content></paragraph><paragraph eId="regulation-50-8"><num>(8)</num><intro><p>Where a person gives evidence at an inquiry by reading a summary of his proof of evidence—</p></intro><level class="para1" eId="regulation-50-8-a"><num>(a)</num><content><p>the proof of evidence referred to in regulation 47(1) shall be treated as tendered in evidence, unless the person required to provide the summary notifies the inspector that he now wishes to rely on the contents of that summary alone; and</p></content></level><level class="para1" eId="regulation-50-8-b"><num>(b)</num><content><p>the person whose evidence the proof of evidence contains shall then be subject to cross-examination on it to the same extent as if it were evidence he had given orally.</p></content></level></paragraph><paragraph eId="regulation-50-9"><num>(9)</num><intro><p>The inspector may—</p></intro><level class="para1" eId="regulation-50-9-a"><num>(a)</num><content><p>require any person appearing at an inquiry who, in his opinion, is behaving in a disruptive manner to leave; and</p></content></level><level class="para1" eId="regulation-50-9-b"><num>(b)</num><content><p>refuse to permit that person to return or permit him to return only on such conditions as he may specify;</p></content></level><wrapUp><p>but any such person may submit to the inspector any evidence or other matter in writing before the close of the inquiry.</p></wrapUp></paragraph><paragraph eId="regulation-50-10"><num>(10)</num><content><p>The inspector may allow any person to alter or add to a statement of case received by the Secretary of State under regulation 25 or a proof of evidence or summary sent to the Secretary of State under regulation 47(1) so far as may be necessary for the purposes of the inquiry; but he shall (if necessary by adjourning the inquiry) give every other person appearing at the inquiry an adequate opportunity of considering any fresh matter or document.</p></content></paragraph><paragraph eId="regulation-50-11"><num>(11)</num><content><p>The inspector may proceed with an inquiry in the absence of any person entitled to appear at it.</p></content></paragraph><paragraph eId="regulation-50-12"><num>(12)</num><content><p>The inspector may take into account any written representations, or evidence or any other document received by him from any person before an inquiry opens or during the inquiry provided he discloses it at the inquiry.</p></content></paragraph><paragraph eId="regulation-50-13"><num>(13)</num><content><p>The inspector may from time to time adjourn an inquiry, and if the date, time and place of the adjourned inquiry are announced at the inquiry before the adjournment, no further notice shall be required.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-51"><heading>Site inspections</heading><num>51.</num><paragraph eId="regulation-51-1"><num>(1)</num><content><p>During an inquiry or after its close, the inspector may, where it appears to him necessary or expedient to do so, arrange to make an inspection of the appeal land <noteRef href="#key-2e959bd1d5f7b1e88d7963e12219c840" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>... .</p></content></paragraph><paragraph eId="regulation-51-2"><num>(2)</num><content><p>Where the inspector intends to make an inspection under paragraph (1), he shall ask the appellant and the relevant authority whether they wish to be present or be represented.</p></content></paragraph><paragraph eId="regulation-51-3"><num>(3)</num><content><p>Where the appellant or the relevant authority have indicated that they wish to be present, or be represented, the inspector shall give the appellant and the authority reasonable notice of the date and time of the inspection and shall afford the appellant and the authority, or their representatives, the opportunity of being present during the inspection.</p></content></paragraph><paragraph eId="regulation-51-4"><num>(4)</num><content><p>The inspector shall not be bound to defer an inspection if the appellant or the relevant authority (or their representative) is not present at the appointed time.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-52"><heading>Procedure after inquiry—appeals to be determined by the Secretary of State</heading><num>52.</num><paragraph eId="regulation-52-1"><num>(1)</num><content><p>This regulation applies where an inquiry has been held for the purposes of any appeal determined by the Secretary of State.</p></content></paragraph><paragraph eId="regulation-52-2"><num>(2)</num><content><p>After the close of an inquiry the inspector shall make a report in writing to the Secretary of State which shall include his conclusions and his recommendations or his reasons for not making any recommendations.</p></content></paragraph><paragraph eId="regulation-52-3"><num>(3)</num><content><p>Where an assessor has been appointed, he shall, after the close of the inquiry, make a report in writing to the inspector in respect of the matters on which he was appointed to advise.</p></content></paragraph><paragraph eId="regulation-52-4"><num>(4)</num><content><p>Where an assessor makes such a report, the inspector shall append it to his own report and shall state in his own report how far he agrees or disagrees with the assessor’s report and, where he disagrees with the assessor, his reasons for that disagreement.</p></content></paragraph><paragraph eId="regulation-52-5"><num>(5)</num><content><p>When making her determination the Secretary of State may disregard any written representations, evidence or other document received after the close of the inquiry.</p></content></paragraph><paragraph eId="regulation-52-6"><num>(6)</num><intro><p>If, after the close of the inquiry, the Secretary of State—</p></intro><level class="para1" eId="regulation-52-6-a"><num>(a)</num><content><p>differs from the inspector on any matter of fact mentioned in, or appearing to her to be material to, a conclusion reached by the inspector; or</p></content></level><level class="para1" eId="regulation-52-6-b"><num>(b)</num><content><p>takes into consideration any new evidence or new matter of fact,</p></content></level><wrapUp><p>and is for that reason disposed to disagree with a recommendation made by the inspector, she shall not come to a decision which is at variance with that recommendation without first notifying the appellant and the relevant authority and any other person who appeared at the inquiry of her disagreement and the reasons for it, and affording them an opportunity of making written representations to her or of asking for the re-opening of the inquiry.</p></wrapUp></paragraph><paragraph eId="regulation-52-7"><num>(7)</num><content><p>Those persons making written representations or requesting that the inquiry be re-opened under paragraph (6) shall ensure that such representations or requests are received by the Secretary of State within three weeks of the date of the Secretary of State’s notification under that paragraph.</p></content></paragraph><paragraph eId="regulation-52-8"><num>(8)</num><intro><p>The Secretary of State may, if she thinks fit, cause an inquiry to be re-opened, and she shall do so if asked by the appellant or the relevant authority in the circumstances mentioned in paragraph (6) and within the period mentioned in paragraph (7); and where an inquiry is re-opened (whether by the same or a different inspector)—</p></intro><level class="para1" eId="regulation-52-8-a"><num>(a)</num><content><p>the Secretary of State shall send to the persons who appeared at the inquiry a written statement of the matters with respect to which further evidence is invited; and</p></content></level><level class="para1" eId="regulation-52-8-b"><num>(b)</num><content><p>paragraphs (3) to (8) of regulation 45 shall apply as if the references to an inquiry were references to a re-opened inquiry.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-53"><heading>Procedure after inquiry—transferred appeals</heading><num>53.</num><paragraph eId="regulation-53-1"><num>(1)</num><content><p>This regulation applies for the purposes of an inquiry held for the purposes of a transferred appeal.</p></content></paragraph><paragraph eId="regulation-53-2"><num>(2)</num><content><p>Where an assessor has been appointed he shall, after the close of the inquiry, make a report in writing to the inspector in respect of the matters on which he was appointed to advise, and the inspector shall state in the notification of his decision pursuant to regulation 55 that such a report was made.</p></content></paragraph><paragraph eId="regulation-53-3"><num>(3)</num><content><p>When making his decision the inspector may disregard any written representations or evidence or other document received after the close of the inquiry.</p></content></paragraph><paragraph eId="regulation-53-4"><num>(4)</num><intro><p>If, after the close of the inquiry, an inspector proposes to take into consideration any new evidence or any new matter of fact which was not raised at the inquiry, and which he considers to be material to his decision, he shall not come to a decision without first—</p></intro><level class="para1" eId="regulation-53-4-a"><num>(a)</num><content><p>notifying the persons entitled to appear at the inquiry who appeared at it of the matter in question; and</p></content></level><level class="para1" eId="regulation-53-4-b"><num>(b)</num><content><p>affording them an opportunity of making written representations to him or of asking for the inquiry to be re-opened;</p></content></level><wrapUp><p>and they shall ensure that such written representations are received by the Secretary of State within three weeks of the date of the notification.</p></wrapUp></paragraph><paragraph eId="regulation-53-5"><num>(5)</num><intro><p>An inspector may, if he thinks fit, cause an inquiry to be re-opened, and he shall do so if asked by the appellant or the relevant authority in the circumstances and within the period mentioned in paragraph (4); and where an inquiry is re-opened—</p></intro><level class="para1" eId="regulation-53-5-a"><num>(a)</num><content><p>the inspector shall send to the persons entitled to appear at the inquiry who appeared at it a written statement of the matters with respect to which further evidence is invited; and</p></content></level><level class="para1" eId="regulation-53-5-b"><num>(b)</num><content><p>paragraphs (3) to (8) of regulation 45 shall apply as if the references to an inquiry were references to a re-opened inquiry.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-54"><heading>Notification of decision—appeals determined by the Secretary of State</heading><num>54.</num><paragraph eId="regulation-54-1"><num>(1)</num><content><p>This regulation applies where an inquiry has been held for the purposes of any appeal to be determined by the Secretary of State.</p></content></paragraph><paragraph eId="regulation-54-2"><num>(2)</num><intro><p>The Secretary of State shall, as soon as practicable, notify her decision on an appeal, and her reasons for it, in writing to—</p></intro><level class="para1" eId="regulation-54-2-a"><num>(a)</num><content><p>the appellant and the relevant authority; and</p></content></level><level class="para1" eId="regulation-54-2-b"><num>(b)</num><intro><p>any other person who—</p></intro><level class="para2" eId="regulation-54-2-b-i"><num>(i)</num><content><p>appeared at the inquiry, or</p></content></level><level class="para2" eId="regulation-54-2-b-ii"><num>(ii)</num><content><p>is an interested person.</p></content></level></level></paragraph><paragraph eId="regulation-54-3"><num>(3)</num><content><p>Where a copy of the inspector’s report is not sent with the notification of the decision, the notification shall be accompanied by a statement of the inspector’s conclusions and of any recommendations made by him, and if a person entitled to be notified of the decision has not received a copy of that report, he shall be supplied with a copy of it on written application to the Secretary of State.</p></content></paragraph><paragraph eId="regulation-54-4"><num>(4)</num><content><p>In this regulation, “report” includes any assessor’s report appended to the inspector’s report but not any other documents so appended; but any person who has received a copy of the report may apply to the Secretary of State, in writing, within six weeks of the date of the Secretary of State’s decision, for an opportunity of inspecting such documents, and the Secretary of State shall afford him such an opportunity.</p></content></paragraph><paragraph eId="regulation-54-5"><num>(5)</num><content><p>Any person applying to the Secretary of State under paragraph (3) or (4) shall ensure that his application is received by the Secretary of State within four weeks of the Secretary of State’s decision.</p></content></paragraph><paragraph eId="regulation-54-6"><num>(6)</num><content><p>The Secretary of State shall ensure that, as soon as practicable after any notification has been given under paragraph (2), a copy of the notification is made available for inspection on  <ins class="substitution first last" ukl:ChangeId="key-ac91120ffca48d18d76631a65458abbe-1534327189322" ukl:CommentaryRef="key-ac91120ffca48d18d76631a65458abbe"><noteRef uk:name="commentary" href="#key-ac91120ffca48d18d76631a65458abbe" class="commentary"/>a relevant website</ins>  for a period of three months.</p></content></paragraph><paragraph eId="regulation-54-7"><num>(7)</num><content><p>An inspector may, in place of the Secretary of State, take such steps as the Secretary of State is required or enabled to take under or by virtue of this regulation.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-55"><heading>Notification of decision—transferred appeals</heading><num>55.</num><paragraph eId="regulation-55-1"><num>(1)</num><content><p>This regulation applies where an inquiry has been held for the purposes of a transferred appeal.</p></content></paragraph><paragraph eId="regulation-55-2"><num>(2)</num><intro><p>The inspector shall, as soon as practicable, notify his decision on an appeal, and his reasons for it, in writing to—</p></intro><level class="para1" eId="regulation-55-2-a"><num>(a)</num><content><p>the appellant and the relevant authority; and</p></content></level><level class="para1" eId="regulation-55-2-b"><num>(b)</num><intro><p>any other person who—</p></intro><level class="para2" eId="regulation-55-2-b-i"><num>(i)</num><content><p>appeared at the inquiry, or</p></content></level><level class="para2" eId="regulation-55-2-b-ii"><num>(ii)</num><content><p>is an interested person.</p></content></level></level></paragraph><paragraph eId="regulation-55-3"><num>(3)</num><content><p>Any person entitled to be notified of the inspector’s decision under paragraph (2) may apply to the Secretary of State in writing for an opportunity to inspect any documents listed in the notification and any report made by an assessor, and the Secretary of State shall afford him that opportunity.</p></content></paragraph><paragraph eId="regulation-55-4"><num>(4)</num><content><p>Any person making an application pursuant to paragraph (3) shall ensure that it is received by the Secretary of State within six weeks of the date of the decision.</p></content></paragraph><paragraph eId="regulation-55-5"><num>(5)</num><content><p>The Secretary of  <ins class="substitution first last" ukl:ChangeId="key-17d37a99075bb6cfa2ade286623c674e-1534327266844" ukl:CommentaryRef="key-17d37a99075bb6cfa2ade286623c674e"><noteRef uk:name="commentary" href="#key-17d37a99075bb6cfa2ade286623c674e" class="commentary"/>State</ins>  shall ensure that, as soon as practicable after any notification has been given under paragraph (2), a copy of the notification is made available for inspection on  <ins class="substitution first last" ukl:ChangeId="key-64afd24335bc688593fc7fda429bef1a-1534327324642" ukl:CommentaryRef="key-64afd24335bc688593fc7fda429bef1a"><noteRef uk:name="commentary" href="#key-64afd24335bc688593fc7fda429bef1a" class="commentary"/>a relevant website</ins>  for a period of three months.</p></content></paragraph></hcontainer></chapter><chapter eId="part-III-chapter-V"><num>CHAPTER V</num><heading><i>Appeal against a decision of a relevant authority not to act in accordance with an application for a direction under section 25(1)(a)</i></heading><hcontainer name="regulation" eId="regulation-56"><heading>Notice of appeal <abbr title="et cetera" xml:lang="la">etc.</abbr></heading><num>56.</num><paragraph eId="regulation-56-1"><num>(1)</num><content><p>An appeal to the Secretary of State under section 30 against a decision of the relevant authority not to act in any respect in accordance with an application for a direction under section 25(1)(a) shall be made by notice given to the Secretary of State, on a form obtained from her, within six weeks of the date on which the authority issued the decision.</p></content></paragraph><paragraph eId="regulation-56-2"><num>(2)</num><content><p>If the appellant wishes to withdraw the appeal before it is determined, he shall do so by giving notice to the Secretary of State in writing before the appeal is determined, and the Secretary of State shall, as soon as practicable, send a copy of that notice to the relevant authority.</p></content></paragraph><paragraph eId="regulation-56-3"><num>(3)</num><content><p>The Secretary of State shall, on the day on which she receives notice of an appeal (or on the first working day thereafter where she receives it on a day which is not a working day) send a copy of the notice to the relevant authority by electronic communication or facsimile transmission, except that where it is not reasonably practicable for the Secretary of State to comply with this requirement within the specified time she shall do so as soon as reasonably practicable thereafter.</p></content></paragraph><paragraph eId="regulation-56-4"><num>(4)</num><content><p>Where a relevant authority receives a notice of appeal pursuant to paragraph (3) they shall submit their statement of case by completing the relevant section of the notice and shall then send the notice, as amended, to the Secretary of State by electronic communication or facsimile transmission before the end of the second working day after the day on which they received it.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-57"><heading>Arrangement and notification of hearing</heading><num>57.</num><intro><p>The Secretary of State shall, before the end of the next working day after the day on which she has received an amended notice of appeal from a relevant authority pursuant to regulation 56(4) or, where it is not reasonably practicable to do so, as soon as reasonably practicable thereafter—</p></intro><level class="para1" eId="regulation-57-a"><num>(a)</num><content><p>make appropriate arrangements for a hearing to be held;</p></content></level><level class="para1" eId="regulation-57-b"><num>(b)</num><content><p>notify the appellant and the authority, by telephone, electronic communication, facsimile transmission or first class post, of the date, time and place of the hearing; and</p></content></level><level class="para1" eId="regulation-57-c"><num>(c)</num><content><p>ensure that the information referred to in sub-paragraph (b) and a copy of the amended notice of appeal are available for inspection on a  <ins class="substitution first last" ukl:ChangeId="key-4846240512dba1b1f61fb90ad7bb2b7c-1534327411821" ukl:CommentaryRef="key-4846240512dba1b1f61fb90ad7bb2b7c"><noteRef uk:name="commentary" href="#key-4846240512dba1b1f61fb90ad7bb2b7c" class="commentary"/>relevant website</ins>  until the appeal is determined.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-58"><heading>Consecutive and concurrent hearings</heading><num>58.</num><content><p>The Secretary of State may arrange for two or more appeals to be heard consecutively or concurrently where they relate to the same area of land or to areas of land which she considers to be in such proximity as to make it expedient for the hearings to be held consecutively or concurrently.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-59"><heading>Appearances at hearing</heading><num>59.</num><paragraph eId="regulation-59-1"><num>(1)</num><intro><p>The persons entitled to appear at the hearing are—</p></intro><level class="para1" eId="regulation-59-1-a"><num>(a)</num><content><p>the appellant; and</p></content></level><level class="para1" eId="regulation-59-1-b"><num>(b)</num><content><p>the relevant authority;</p></content></level><wrapUp><p>but the inspector may permit any other person to appear in person or be represented by any other person.</p></wrapUp></paragraph><paragraph eId="regulation-59-2"><num>(2)</num><content><p>Any person entitled or permitted to appear may appear in person or be represented by any other person.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-60"><heading>Procedure at hearing</heading><num>60.</num><paragraph eId="regulation-60-1"><num>(1)</num><content><p>The inspector shall determine the procedure at a hearing.</p></content></paragraph><paragraph eId="regulation-60-2"><num>(2)</num><content><p>A hearing shall take the form of a discussion led by an inspector, and cross-examination shall not be permitted unless the inspector considers that cross-examination is required to ensure a thorough examination of the main issues.</p></content></paragraph><paragraph eId="regulation-60-3"><num>(3)</num><content><p>At the start of the hearing the inspector, after announcing his name and the fact of his appointment and requiring the relevant authority to sign the amended notice of appeal, shall identify what are, in his opinion, the main issues to be considered at the hearing and any matters on which he requires further explanation from any person appearing at the hearing; but this shall not preclude the addition in the course of the hearing of other issues for consideration or any person appearing at the hearing from referring to issues which they consider relevant to the consideration of the appeal but which were not issues so identified by the inspector.</p></content></paragraph><paragraph eId="regulation-60-4"><num>(4)</num><content><p>The appellant and the relevant authority shall be entitled to give, or to call another person to give, oral evidence, and any other person may give, or call another person to give, oral evidence if so permitted by an inspector at his discretion, but notwithstanding any such entitlement or permission, the inspector may, at any stage in the proceedings refuse to permit the giving of evidence or presentation of any other matter which he considers to be irrelevant or repetitious.</p></content></paragraph><paragraph eId="regulation-60-5"><num>(5)</num><content><p>Where the inspector refuses to permit the giving of oral evidence, the person wishing to give, or call any other person to give, evidence may submit to him any evidence or other matter in writing before the close of the hearing.</p></content></paragraph><paragraph eId="regulation-60-6"><num>(6)</num><content><p>The inspector may require any person appearing or present at the hearing who, in his opinion, is behaving in a disruptive manner to leave the hearing; and the inspector may then refuse to permit that person to return or permit him to return only on such conditions as he may specify, but any such person may submit to the inspector any evidence or other matter in writing before the close of the hearing.</p></content></paragraph><paragraph eId="regulation-60-7"><num>(7)</num><intro><p>The inspector may—</p></intro><level class="para1" eId="regulation-60-7-a"><num>(a)</num><content><p>proceed with a hearing in the absence of any person entitled to appear at it;</p></content></level><level class="para1" eId="regulation-60-7-b"><num>(b)</num><content><p>take into account any written representations or evidence or any other document received by him from any person before a hearing opens or during the hearing provided he discloses it at the hearing; and</p></content></level><level class="para1" eId="regulation-60-7-c"><num>(c)</num><content><p>at any time adjourn a hearing, and, if the date, time and place of the adjourned hearing are announced at the hearing before the adjournment, no further notice shall be required.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-61"><heading>Notification of decision—appeals determined by the Secretary of State</heading><num>61.</num><paragraph eId="regulation-61-1"><num><ins class="first last" ukl:ChangeId="key-4075e1a03d289899c7edbd5de39c3388-1534323246830" ukl:CommentaryRef="key-4075e1a03d289899c7edbd5de39c3388"><noteRef uk:name="commentary" href="#key-4075e1a03d289899c7edbd5de39c3388" class="commentary"/>(1) </ins></num><content><p>Where a hearing has been held for the purposes of an appeal determined by the Secretary of State she shall, within forty-eight hours of the close of the hearing, notify her decision on the appeal to the appellant, the relevant authority and any <noteRef href="#key-0402060d02b33845172a8ca2002d03d2" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>... other person who appeared at the hearing by sending to them a copy of the amended notice of appeal with her decision endorsed on it.</p></content></paragraph><paragraph eId="regulation-61-2"><num><ins class="first" ukl:ChangeId="key-a6e37b49d99139b9d040915ed189d318-1534323280105" ukl:CommentaryRef="key-a6e37b49d99139b9d040915ed189d318"><noteRef uk:name="commentary" href="#key-a6e37b49d99139b9d040915ed189d318" class="commentary"/>(2)</ins></num><content><p><ins period of three months.</ins></p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-62"><heading>Notification of decision—transferred appeals</heading><num>62.</num><paragraph eId="regulation-62-1"><num>(1)</num><intro><p>Where a hearing has been held for the purposes of a transferred appeal the inspector shall—</p></intro><level class="para1" eId="regulation-62-1-a"><num>(a)</num><content><p>unless it is not reasonably practicable to do so, announce his decision on the appeal at the close of the hearing; and</p></content></level><level class="para1" eId="regulation-62-1-b"><num>(b)</num><content><p>within forty-eight hours of the close of the hearing, notify his decision on the appeal to the appellant, the relevant authority and any other person who appeared at the hearing, by sending to them a copy of the amended notice of appeal with his decision endorsed on it.</p></content></level></paragraph><paragraph eId="regulation-62-2"><num>(2)</num><content><p>The Secretary of State shall ensure that, as soon as practicable after any notification has been given under paragraph (1), a copy of the amended notice of appeal <ins class="first last" ukl:ChangeId="key-d58fd804721b2ef33323f155a6f64c6f-1534323458061" ukl:CommentaryRef="key-d58fd804721b2ef33323f155a6f64c6f"><noteRef uk:name="commentary" href="#key-d58fd804721b2ef33323f155a6f64c6f" class="commentary"/>with the inspector’s decision endorsed on it</ins>  is made available for inspection on <ins class="substitution first last" ukl:ChangeId="key-f77dfff7a034294abc4437b8f974ddd9-1534327566718" ukl:CommentaryRef="key-f77dfff7a034294abc4437b8f974ddd9"><noteRef uk:name="commentary" href="#key-f77dfff7a034294abc4437b8f974ddd9" class="commentary"/>a relevant website</ins>  for a period of three months.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-63"><heading>Extension of time</heading><num>63.</num><content><p>The Secretary of State may, at any time and in any particular case, extend the time within which any of the requirements in regulation 56 must be complied with.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-64"><heading>Changes of procedure</heading><num>64.</num><paragraph eId="regulation-64-1"><num>(1)</num><content><p>The Secretary of State may, at any time before the close of a hearing held under this Chapter, notify the appellant and the relevant authority that the appeal is no longer to be determined in accordance with the provisions of this Chapter but instead by way of written representations, or by way of a hearing or inquiry, in accordance with the provisions of Chapters I to <abbr class="acronym" title="4">IV</abbr> of this Part as if the appeal were an appeal against a decision of a relevant authority not to grant a direction under section 24 or 25(1)(b).</p></content></paragraph><paragraph eId="regulation-64-2"><num>(2)</num><intro><p>Where the appeal procedure is changed by the Secretary of State under this regulation the Secretary of State shall—</p></intro><level class="para1" eId="regulation-64-2-a"><num>(a)</num><content><p>notify the appellant, the relevant authority and any interested person of such change, and</p></content></level><level class="para1" eId="regulation-64-2-b"><num>(b)</num><content><p>ensure that a copy of such notice is available for inspection on a  <ins class="substitution first last" ukl:ChangeId="key-16f9516472d9d65290e9e5ae3d95ebc3-1534327657614" ukl:CommentaryRef="key-16f9516472d9d65290e9e5ae3d95ebc3"><noteRef uk:name="commentary" href="#key-16f9516472d9d65290e9e5ae3d95ebc3" class="commentary"/>relevant website</ins> until the appeal is determined; and</p></content></level><wrapUp><p>the Secretary of State may give any consequential directions as to the procedure to be applied in relation to the appeal as she may consider necessary.</p></wrapUp></paragraph></hcontainer></chapter><chapter eId="part-III-chapter-VI"><num>CHAPTER VI</num><heading><i>General</i></heading><hcontainer name="regulation" eId="regulation-65"><heading>Notification of appointment of assessor</heading><num>65.</num><content><p>Where the Secretary of State has appointed an assessor in respect of a hearing or inquiry, the inspector shall, at the commencement of the hearing or inquiry, announce the name of the assessor and the fact of his appointment.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-66"><heading>Further time and additional copies</heading><num>66.</num><paragraph eId="regulation-66-1"><num>(1)</num><content><p>The Secretary of State may, at any time and in any particular case, give directions setting later time limits than those prescribed by Part III of these Regulations for the taking of any step or the doing of any thing which is required or enabled to be taken or done by virtue of these Regulations; and references in these Regulations to a period within which any step or thing is required or enabled to be taken or done shall be construed accordingly.</p></content></paragraph><paragraph eId="regulation-66-2"><num>(2)</num><intro><p>The Secretary of State or an inspector, may, at any time before the notification of her or his decision in the case of an appeal to be determined by way of written representations or (in the case of a hearing or inquiry) before the close of a hearing or inquiry, request from any person making written representations or appearing at the hearing or inquiry (as the case may be)—</p></intro><level class="para1" eId="regulation-66-2-a"><num>(a)</num><content><p>further written representations or evidence, or (in the case of a hearing or inquiry) oral evidence with regard to any matter on which she or he requires further information; and</p></content></level><level class="para1" eId="regulation-66-2-b"><num>(b)</num><intro><p>copies of (as appropriate)—</p></intro><level class="para2" eId="regulation-66-2-b-i"><num>(i)</num><content><p>a statement of case or comments sent in accordance with regulation 25 or 27;</p></content></level><level class="para2" eId="regulation-66-2-b-ii"><num>(ii)</num><content><p>a proof of evidence sent in accordance with regulation 47; or</p></content></level><level class="para2" eId="regulation-66-2-b-iii"><num>(iii)</num><content><p>any other document or information sent to the Secretary of State or inspector before or during a hearing or inquiry;</p></content></level></level><wrapUp><p>and may specify a reasonable time within which such representations or copies must be received by her or him, and any person so requested shall ensure that the representations or copies are received within the period specified.</p></wrapUp></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-67"><heading>Inspection and copying of documents</heading><num>67.</num><intro><p>The relevant authority shall afford any person who so requests, an opportunity, at such time and place as the relevant authority may reasonably determine, to inspect and, where practicable, take copies of—</p></intro><level class="para1" eId="regulation-67-a"><num>(a)</num><content><p>the notice of appeal submitted by the appellant pursuant to regulation 20(1) or 56(1);</p></content></level><level class="para1" eId="regulation-67-b"><num>(b)</num><content><p>the questionnaire completed by the authority pursuant to regulation 22(a) together with any documents referred to in it;</p></content></level><level class="para1" eId="regulation-67-c"><num>(c)</num><content><p>any representations made to the authority in respect of matters mentioned in regulation 22(b)(i) or (ii);</p></content></level><level class="para1" eId="regulation-67-d"><num>(d)</num><content><p>the notice given by the Secretary of State pursuant to regulation 23;</p></content></level><level class="para1" eId="regulation-67-e"><num>(e)</num><content><p>all documents submitted by the authority pursuant to regulation 24, 25(a), 27(b) and 56(4);</p></content></level><level class="para1" eId="regulation-67-f"><num>(f)</num><content><p>the statement of case submitted by the appellant pursuant to regulation 25 (b), the comments submitted by the appellant pursuant to regulation 27(a) and the further information provided by the appellant, the authority or an interested person pursuant to regulation 28;</p></content></level><level class="para1" eId="regulation-67-g"><num>(g)</num><content><p>any representations made to the Secretary of State in respect of the appeal under regulation 25(c);</p></content></level><level class="para1" eId="regulation-67-h"><num>(h)</num><content><p>any proof of evidence (together with any written summary) sent by or to the authority pursuant to regulation 47; or</p></content></level><level class="para1" eId="regulation-67-i"><num>(i)</num><content><p>any statement of common ground prepared by the appellant and the authority pursuant to regulation 48.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-68"><heading>Changes of procedure</heading><num>68.</num><paragraph eId="regulation-68-1"><num>(1)</num><content><p>If, at any time before the Secretary of State or the inspector, in either case under regulation 31, notifies her or (as the case may be) his decision on an appeal, the appellant, the relevant authority or the Secretary of State wishes the appeal to be determined no longer by way of written representations but instead by way of a hearing or inquiry, the Secretary of State shall arrange for the appeal to proceed by way of a hearing or inquiry.</p></content></paragraph><paragraph eId="regulation-68-2"><num>(2)</num><content><p>Paragraphs (3) and (4) apply at any time before the Secretary of State, under regulation 40 or 54, or an inspector, under regulation 41 or 55, notifies her or (as the case may be) his decision on an appeal.</p></content></paragraph><paragraph eId="regulation-68-3"><num>(3)</num><content><p>If the appellant or the relevant authority wishes an appeal to be determined no longer by way of a hearing or inquiry but instead by way of written representations, the Secretary of State shall consult the other party, and, if both that party and the Secretary of State agree to such a change in procedure, the Secretary of State shall arrange for the appeal to be determined by way of written representations.</p></content></paragraph><paragraph eId="regulation-68-4"><num>(4)</num><intro><p>If the appellant, the relevant authority or the Secretary of State wishes an appeal to be determined—</p></intro><level class="para2" eId="regulation-68-4-i"><num>(i)</num><content><p>no longer by way of a hearing but instead by way of an inquiry, or</p></content></level><level class="para2" eId="regulation-68-4-ii"><num>(ii)</num><content><p>no longer by way of an inquiry but instead by way of a hearing,</p></content></level><wrapUp><p>the Secretary of State shall, after consulting the other party or, where the Secretary of State wishes the appeal procedure to be changed, both the parties, decide whether the hearing or inquiry (as the case may be) should be no longer proceed and an inquiry or hearing (as appropriate) be held instead.</p></wrapUp></paragraph><paragraph eId="regulation-68-5"><num>(5)</num><intro><p>Where the appeal procedure is changed by the Secretary of State under this regulation—</p></intro><level class="para1" eId="regulation-68-5-a"><num>(a)</num><intro><p>the Secretary of State shall—</p></intro><level class="para2" eId="regulation-68-5-a-i"><num>(i)</num><content><p>notify the appellant, the relevant authority and any interested person in respect of the appeal of such change, and</p></content></level><level class="para2" eId="regulation-68-5-a-ii"><num>(ii)</num><content><p>ensure that a copy of such notice is available for inspection on a  <ins class="substitution first last" ukl:ChangeId="key-15864d92de55b75acfb82b6126ca3adc-1534327735261" ukl:CommentaryRef="key-15864d92de55b75acfb82b6126ca3adc"><noteRef uk:name="commentary" href="#key-15864d92de55b75acfb82b6126ca3adc" class="commentary"/>relevant website</ins>  until the appeal is determined; and</p></content></level></level><level class="para1" eId="regulation-68-5-b"><num>(b)</num><intro><p>in relation to the conduct of the appeal thereafter—</p></intro><level class="para2" eId="regulation-68-5-b-i"><num>(i)</num><content><p>any step taken or thing done under these Regulations in relation to the former appeal procedure which could have been taken done under any corresponding provision of these Regulations relating to the new appeal procedure shall have effect as if taken or done under that corresponding provision, and</p></content></level><level class="para2" eId="regulation-68-5-b-ii"><num>(ii)</num><content><p>the Secretary of State may give any consequential directions as to the procedure to be applied in relation to the appeal as she may consider necessary.</p></content></level></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-69"><heading>Recovery of jurisdiction</heading><num>69.</num><content><p>Where the appointment of an appointed person is revoked under paragraph 2(c) of Schedule 3 to <abbr title="Countryside and Rights of Way Act 2000 c. 37">the Act</abbr> and no new appointment is made at the time of such revocation, the appeal shall proceed as an appeal which falls to be determined by the Secretary of State instead of as a transferred appeal, and any step taken or thing done under these Regulations in relation to the transferred appeal which could have been taken or done in relation to an appeal which falls to be determined by the Secretary of State shall have effect as if it had been taken or done in relation to such an appeal.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-70"><heading>Procedure following quashing of a decision</heading><num>70.</num><paragraph eId="regulation-70-1"><num>(1)</num><intro><p>Where the decision of the Secretary of State or an inspector in respect of an appeal is quashed in proceedings before any court, the Secretary of State—</p></intro><level class="para1" eId="regulation-70-1-a"><num>(a)</num><content><p>shall send to the appellant, the relevant authority and any interested person a written statement of the matters with respect to which further representations are invited for the purposes of her further consideration of the appeal;</p></content></level><level class="para1" eId="regulation-70-1-b"><num>(b)</num><content><p>shall afford to those persons the opportunity of making written representations to her in respect of those matters or of asking for the re-opening of the hearing or the inquiry, and</p></content></level><level class="para1" eId="regulation-70-1-c"><num>(c)</num><content><p>may, as she thinks fit, cause the hearing or inquiry to be re-opened and, if she re-opens the hearing or inquiry, paragraphs (3) to (8) of regulation 32 and paragraphs (3) to (8) of regulation 45 shall apply as if the references to a hearing or inquiry were references to a re-opened hearing or inquiry respectively.</p></content></level></paragraph><paragraph eId="regulation-70-2"><num>(2)</num><content><p>Those persons making representations or asking for the inquiry to be re-opened under paragraph (1)(b) shall ensure that such representations or requests are received by the Secretary of State within three weeks of the date of the written statement part of the Regulations)</subheading><blockContainer ukl:Name="P"><p>The Countryside and Rights of Way Act 2000 (“<abbr title="Countryside and Rights of Way Act 2000 c. 37">the Act</abbr>”) creates a public right of access to certain types of land, subject to certain conditions. The Act also provides for the exclusion or restriction of this right in certain circumstances.</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations, which extend to England only, contain provisions relating to the exclusion or restriction of such right of access to land. and by the Secretary of State of decisions made by her with regard to directions under section 28 of <abbr title="Countryside and Rights of Way Act 2000 c. 37">the Act</abbr> (regulations 11 and 12);</p></blockContainer><blockContainer ukl:Name="P2" class="prov2"><num>(9)</num><p>requiring relevant authorities, before revoking or varying a direction given under section 24, 25 or 26 of <abbr title="Countryside and Rights of Way Act 2000 c. 37">the Act</abbr>, to provide certain specified information to certain persons and bodies (regulation 13);</p></blockContainer><blockContainer ukl:Name="P2" class="prov2"><num>(10)</num><p>relating to the consultation required by relevant authorities and by the Secretary of State on reviews of directions given by them under <abbr title="Countryside and Rights of Way Act 2000 c. 37">the Act</abbr> excluding or restricting the right of access to any land indefinitely, for part of every year or for part of each of six or more consecutive years or for a specified period of more than five years (regulations 15 and 16);</p></blockContainer><blockContainer ukl:Name="P2" class="prov2"><num>(11)</num><p>relating to steps to be taken by the Countryside Agency (“<abbr title="Countryside Agency">the Agency</abbr>”) for informing the public about the exclusion or restriction of the right of access to any land in accordance with the provisions of <abbr title="Countryside and Rights of Way Act 2000 c. 37">the Act</abbr> and these Regulations (regulation 17).</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><p>Part III of these Regulations relates to appeals under <abbr title="Countryside and Rights of Way Act 2000 c. 37">the Act</abbr> against a decision of a relevant authority not to grant an application for a direction under section 24 or 25 or not to act in accordance with any representations made by an appellant before deciding whether to revoke or vary certain directions given under section 24 or 25. It is divided into six chapters.</p></blockContainer><blockContainer ukl:Name="P"><p>Chapter I (regulations 19 to 28) sets out the initial procedures which have effect irrespective of whether such an appeal is to be determined on the basis of written representations or by way of a hearing or local inquiry. These procedures require the appeal to be made to the Secretary of State, on a form obtained from her, within six weeks of the date of the relevant authority issuing their decision and require the Secretary of State to notify the appellant and the relevant authority of the method by which the appeal is to be determined and of various other procedural matters. The relevant authority and the appellant are each required to submit a statement containing full particulars of their case to the Secretary of State and are entitled to submit comments to the Secretary of State on each other’s statement and on any representations made to the Secretary of State by any other person in respect of the appeal. Time limits are prescribed for the submission of all such documents.</p></blockContainer><blockContainer ukl:Name="P"><p>Chapter <abbr class="acronym" title="2">II</abbr> (regulations 29 to 31) sets out procedures to be followed where such an appeal is to be determined on the basis of written representations, and includes a requirement relating to the notification by the Secretary of State or an inspector of their decision on the appeal and the reasons for it.</p></blockContainer><blockContainer ukl:Name="P"><p>Chapter <abbr class="acronym" title="3">III</abbr> (regulations 32 to 41) sets out procedures to be followed where such an appeal is to be determined by way of a hearing and includes provisions relating to the giving of notice in respect of a hearing, the procedures to be followed during and after the hearing and the notification by the Secretary of State or an inspector of their decision on the appeal and the reasons for it.</p></blockContainer><blockContainer ukl:Name="P"><p>Chapter <abbr class="acronym" title="4">IV</abbr> (regulations 42 to 55) sets out the procedures to be followed where such an appeal is to be determined by way of a local inquiry and includes provisions relating to pre-inquiry meetings, the giving of notice in respect of an inquiry, proofs of evidence, statements of common ground, the procedure to be followed during and after the inquiry and the notification by the Secretary of State or an inspector of their decision on the appeal and the reasons for it.</p></blockContainer><blockContainer ukl:Name="P"><p>Chapter V (regulations 56 to 64) contains provisions relating to an appeal against a decision of a relevant authority not to grant an application for a direction under section 25(1)(a) for the purpose of fire prevention. It provides for such an appeal to be determined by way of a hearing, and includes provisions relating to the giving of notice in respect of the hearing, the procedures to be followed during and after the hearing and the notification by the Secretary of State or an inspector of their decision on the appeal and the reasons for it. The time limits for the submission of documents relating to such an appeal are shorter than in the case of an appeal to be determined by way of a hearing in accordance with Chapter III.</p></blockContainer><blockContainer ukl:Name="P"><p>Chapter <abbr class="acronym" title="6">VI</abbr> (regulations 65 to 70) contains general provisions, including power for the Secretary of State to set later time limits than those prescribed by the Regulations for the taking of any step required by the Regulations and a requirement for the relevant authority to afford persons an opportunity to inspect and take copies of various documents relating to appeals.</p></blockContainer><blockContainer ukl:Name="P"><p>Provision is also made for the method of appeal to be changed by the Secretary of State in certain circumstances during the course of an appeal. Where a decision of the Secretary of State or an inspector on an appeal is quashed by a court, provision is made for any person who appeared at the hearing or local inquiry, or who made representations in respect of the appeal, to make further written representations for the purpose of further consideration of the appeal by the Secretary of State or to ask for the re-opening of the hearing or local inquiry.</p></blockContainer><blockContainer ukl:Name="P"><p>The use of electronic communications is permitted for the purposes of these Regulations.
