The Distress for Rent (Amendment No. 2) Rules 2003

The Lord Chancellor, in exercise of the powers conferred upon him by section 8 of the Law of Distress Amendment Act 18881 hereby makes the following Rules:

Citation and commencement1

These Rules may be cited as the Distress for Rent (Amendment No. 2) Rules 2003 and shall come into force on 15th August 2003.

Amendments to Distress for Rent Rules 19882

In Appendix 1 to the Distress for Rent Rules 19882, for paragraph 1 substitute—

For levying distress—

i

on any debt up to and including £100 a fixed fee of

£21.65

ii

on any debt which exceeds £100 a scale fee calculated as follows:

on the first £100 of that debt

£21.65

on the next £100

12½%

on the next £400

4%

on the next £1,500

2½%

on the next £8,000

1%

and on any additional sum

¼%.

These Rules which apply to England and Wales, amend the Distress for Rent Rules 1988 which relate to distress for rent and (by virtue of the modification effected by the Enforcement of Road Traffic Debts (Certificated Bailiffs) Regulations 1993) for debts under section 78 of the Road Traffic Act 1991.

These Rules clarify the amendments proposed by S.I. 2003/1858.

For levying distress a fixed fee of £21.65 will be payable on any debt up to and including £100.

On any debt which exceeds £100, a scale fee will apply as follows:

on the first £100 of that debt

£21.65

on the next £100

12½%

on the next £400

4%

on the next £1,500

2½%

on the next £8,000

1%

and on any additional sum

¼%.
