Licensing Act 2003 (Commencement) Order 2003

The Secretary of State, in exercise of the powers conferred upon her by section 201(2) of the Licensing Act 2003 (1), hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Licensing Act 2003 (Commencement) Order 2003.

(2) In this Order, “the Act” means the Licensing Act 2003.

(3) In this Order, “the 1964 Act” means the Licensing Act 1964 (2).

Commencement

2.  Section 199 of and Schedule 7 (repeals) to the Act, so far as relating to section 66 (Sunday closing in Wales and Monmouthshire) and section 67 (supplementary provisions for Welsh Sunday polls) of and Schedule 8 (polls in Wales and Monmouthshire) to the 1964 Act, shall come into force on the day after the day on which this Order is made.

Explanatory Note

(This note is not part of the Order)

This Order brings into force repeal provisions of the Licensing Act 2003. Those provisions repeal sections 66 and 67 of and Schedule 8 to the Licensing Act 1964, which cease to have effect on the day after the day on which this Order is made. This means that the local government electorate in the counties and county boroughs of Wales and Monmouthshire can no longer requisition polls to decide whether licensed premises should be permitted to open on Sundays. Since the polls taken on 13 November 1996, Sunday opening has been adopted throughout Wales and Monmouthshire.
