The Education (Information as to Provision of Education) (England) (Amendment) Regulations 2003

In exercise of the powers conferred on the Secretary of State by sections 29(3) and 569(4) of the Education Act 19961, the Secretary of State for Education and Skills hereby makes the following Regulations:

Citation and commencement1.

(1)

These Regulations may be cited as the Education (Information as to Provision of Education) (England) (Amendment) Regulations 2003 and shall come into force on 7th March 2003.

Interpretation2.

In these Regulations any reference to “the regulations” is a reference to the Education (Information as to Provision of Education) (England) Regulations 19992.

Determination of capacity of a school3.

(1)

The regulations shall be amended as follows.

For regulation 4 there shall be substituted the following regulation:–

“4.

The capacity of a school is to be determined in accordance with the method of assessment provided in the Department for Education and Skills Guidance “Assessing the Net Capacity of Schools” (reference number DfES/0739/2001 REV) issued in August 2002 (ISBN 1 84185 610 X)”

Schedule 2 to the regulations is hereby revoked.

These regulations provide for the method for determining the capacity of a school and provide for the method of assessing the net capacity of schools provided in the Department for Education and Skills Guidance “Assessing the Net capacity of Schools” (reference number DfES/0739/2001 REV) issued in August 2002 (ISBN 1 84185 610 X) to replace the method of determining a school found at Schedule 2 to the 1999 regulations.
