39.—(1) These Regulations are without prejudice to—
(a)sections 58 to 60 of the School Standards and Framework Act 1998(1) (appointment and dismissal of teachers in schools with a religious character etc); and
(b)section 21 of the Education (Scotland) Act 1980(2) (management of denominational schools).
(2) Schedule 5 (amendments to legislation) shall have effect.

1980 c. 44; section 21(2) to (2B) was amended by the Self-Governing Schools etc (Scotland) Act 1989 (c. 39), Schedule 10, paragraph 8(7), and section 21(2A) to (4) and (6) is applied by section 12 of that Act.
