The Secretary of State for Education and Skills, in exercise of the powers conferred by sections 22(1) and (2), 42(6) and 43(1) of the Teaching and Higher Education Act 1998(1), hereby makes the following Regulations:
1. These Regulations may be cited as the Education (Grants for Disabled Postgraduate Students) (Amendment) Regulations 2003 and shall come into force on 1st September 2003.
2. In these Regulations, “the 2000 Regulations” means the Education (Grants for Disabled Postgraduate Students) Regulations 2000(2).
3. The 2000 Regulations shall be amended in accordance with regulations 5 and 6.
4. These Regulations shall not have effect in relation to an academic year (as defined in regulation 2(6) of the 2000 Regulations) which begins before 1st September 2003.
5.—(1) Regulation 3 shall be amended as follows.
(2) In sub-paragraph (i) of paragraph (2)(a), there shall be omitted the words “the amount of which is not calculated by reference to his income”.
(3) After sub-paragraph (iv) in paragraph (2)(a), there shall be added –
“(v)any allowance, bursary or award made by the General Social Care Council under section 67(4)(a) of the Care Standards Act 2000(3) which includes payment for meeting additional expenditure incurred by the student by reason of his disability; or”.
6.—(1) Regulation 9 shall be amended as follows.
(2) In paragraph (2) for “£5,245” there shall be substituted “£5,370”.

These Regulations amend the Education (Grants for Disabled Postgraduate Students) Regulations 2000 (“the 2000 Regulations”).
Regulation 3 of the 2000 Regulations is amended to exclude from eligibility for grants those students who are in receipt of an NHS bursary, whether or not this bursary is means tested. Previously, only recipients of means-tested bursaries were excluded. Regulation 3 is also amended to exclude from eligibility for grants under the Regulations students who are eligible for bursaries under the Care Standards Act 2000.
Regulation 9 is amended to raise the maximum level of grant from £5,245 to £5,370.
