The Enterprise Act 2002 (Part 8 Notice to OFT of Intended Prosecution Specified Enactments, Revocation and Transitional Provision) Order 2003

The Secretary of State, in exercise of her powers under sections 230(1) and (7) and 277 of the Enterprise Act 2002(1) hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Enterprise Act 2002 (Part 8 Notice to OFT of Intended Prosecution Specified Enactments, Revocation and Transitional Provision) Order 2003 and shall come into force on 20th June 2003.

Specified enactments

2.  The enactments and subordinate legislation contained in the Schedule to this Order are hereby specified for the purposes of section 230 of the Enterprise Act 2002 (notice to OFT of intended prosecution).

Revocation

3.  In the Package Travel, Package Holidays and Package Tours Regulations 1992(2) paragraph 2 of Schedule 3 (notice of intended prosecution) is revoked.

Transitional

4.  Where a local weights and measures authority has before the date when this Order comes into force given notice that it intends to institute proceedings for an offence, as required by section 161(2) of the Consumer Credit Act 1974(3), section 26(2) of the Estate Agents Act 1979(4), section 130 of the Fair Trading Act 1973(5), or paragraph 2 of Schedule 3 to the Package Travel, Package Holidays and Package Tours Regulations 1992(6), then the provisions of the Act or Regulation in accordance with which the notice was given shall continue to apply in respect of the intended proceedings.

Explanatory Note

(This note is not part of the Order)

Section 230 of the Enterprise Act 2002 requires local weights and measures authorities in England and Wales to give notice to the OFT of intended prosecutions and their outcome under specified enactments and secondary legislation. This Order specifies the enactments and secondary legislation to which the requirement applies. It revokes a similar requirement in the Package Travel, Package Holidays and Package Tours Regulations 1992 (S.I. 1992/3288) and in article 4 makes transitional provisions where a local authority has, before this Order comes into force, given notice that it intends to institute proceedings for an offence under those Regulations or the other legislation there listed that imposes a similar requirement.
