The Superannuation (Admission to Schedule 1 to the Superannuation Act 1972) Order 2003

The Minister for the Civil Service in exercise of the powers conferred by sections 1(5), 1(8)(a) and 1(8)(c) of the Superannuation Act 1972(1) and now vested in him(2), hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Superannuation (Admission to Schedule 1 to the Superannuation Act 1972) Order 2003 and shall come into force on 30th April 2003, but shall have effect, where appropriate, from the dates specified in this Order.

(2) In this Order “the Act” means the Superannuation Act 1972.

Employments

2.  The following shall be included among the kinds of employment to which a scheme under Section 1 of the Act can apply:

(a)employment by Sir John Soane’s Museum, with effect from 1st February 2003,

(b)employment by the Broadcasting Standards Commission, with effect from 30th September 2002,

(c)employment by the Historic Buildings and Monuments Commission for England, with effect from 30th September 2002,

(d)employment by the Administrative Trustees of the Chequers Estate and the Chequers Trust Fund, with effect from 1st February 2003,

(e)employment by the British Library, with effect from 1st August 2002,

(f)employment by British Overseas Trade Group for Israel, with effect from 1st March 2001,

(g)employment by Committee for Middle East Trade, with effect from 1st March 2001,

(h)employment by the Countryside Council for Wales, with effect from 30th September 2002,

(i)employment by East European Trade Council, with effect from 1st March 2001,

(j)employment by English Nature, with effect from 1st September 2002,

(k)employment by the Great Britain-China Centre, with effect from 1st September 2002,

(l)employment by Latin American Trade Advisory Group, with effect from 1st March 2001,

(m)employment by National Consumer Council, with effect from 1st September 2002,

(n)employment by the Registrar of Public Lending Right, with effect from 1st September 2002,

(o)employment by Scottish Natural Heritage, with effect from 1st September 2002,

(p)employment by the Scottish Public Services Ombudsman, with effect from 30th September 2002,

(q)employment by the Westminster Foundation for Democracy Limited, with effect from 1st October 2002

and accordingly, Schedule 1 to the Act is amended by inserting at the appropriate place:

(i)in the list of “Museums and Galleries”, the entry—

Offices

3.  The following offices shall be included among the offices to which a scheme under section 1 of the Act can apply:

(a)the Registrar of Public Lending Right, with effect from 1st September 2002,

(b)the Scottish Public Services Ombudsman, with effect from 30th September 2002,

(c)the Deputy Scottish Public Services Ombudsmen, with effect from 30th September 2002

and accordingly Schedule 1 to the Act is amended by inserting at the appropriate place in the list of “Offices” the entries—

Amendment

4.  In article 4 of the Superannuation (Admission to Schedule 1 to the Superannuation Act 1972) Order 2002(3), for “the Local Government Commission” there shall be substituted “Local Government Commission for England” with effect from 12th August 2002.

Explanatory Note

(This note is not part of the Regulations)

1.  Section 1 of the Superannuation Act 1972 (the Act) (under which schemes which provide for pensions, allowances or gratuities in respect of persons in certain employment are made) applies to employments and offices listed in Schedule 1 to the Act. The Order adds employment by Sir John Soane’s Museum, the Broadcasting Standards Commission, the Historic Buildings and Monuments Commission for England, the Administrative Trustees of the Chequers Estate and the Chequers Trust Fund, the British Library, British Overseas Trade Group for Israel, Committee for Middle East Trade, the Countryside Council for Wales, East European Trade Council, English Nature, the Great Britain-China Centre, Latin American Trade Advisory Group, National Consumer Council, Public Lending Right, Scottish Natural Heritage, the Scottish Public Services Ombudsman and the Westminster Foundation for Democracy Limited to those listed in that Schedule. The Order also adds the offices of the Registrar of Public Lending Right, the Scottish Public Services Ombudsman and the Deputy Scottish Public Services Ombudsmen to those listed in that Schedule.

2.  Under the power conferred by section 1(8)(a) of the Act the Order takes effect from the various dates specified in the Order.

3.  Article 4 of the Order amends a typographical error contained in the Superannuation (Admission to Schedule 1 to the Superannuation Act 1972) Order 2002 by substituting a reference to “Local Government Commission for England” for “the Local Government Commission”.
