Section 175(1) and (4) was amended by the Social Security Contributions (Transfer of Functions, <abbr title="et cetera" xml:lang="la">etc.</abbr>) Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1999/2">1999 (c. 2)</ref>, section 2 and Schedule 3, paragraph 29(1), (2) and (4).</p></authorialNote> and section 9(1)(a) of the Social Security Act 1998<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00005" href="http://www.legislation.gov.uk/id/ukpga/1998/14">1998 c. 14</ref>.</p></authorialNote> and of all other powers enabling him in that behalf, after agreement by the Social Security Advisory Committee that proposals in respect of these Regulations should not be referred to it<authorialNote class="footnote" eId="f00004" marker="4"><p><i>See</i> section 173(1)(b) of the Social Security Administration Act <ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/1992/5">1992 (c. 5)</ref>.</p></authorialNote>, hereby makes the following Regulations:</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation, commencement and interpretation</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Social Fund Maternity and Funeral Expenses (General) Amendment Regulations 2002 and shall come into force on 31st March 2002.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>In these Regulations “the <abbr title="Social Fund Maternity and Funeral Expenses (General) Regulations 1987 (S.I. 1987/481)">General Regulations</abbr>” means the Social Fund Maternity and Funeral Expenses (General) Regulations 1987<authorialNote class="footnote" eId="f00005" marker="5"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00007" href="http://www.legislation.gov.uk/id/uksi/1987/481">1987/481</ref>. Relevant amending instruments are <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00008" href="http://www.legislation.gov.uk/id/uksi/2000/528">2000/528</ref> and <ref eId="c00009" href="http://www.legislation.gov.uk/id/uksi/2000/2229">2000/2229</ref>.</p></authorialNote>.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Amendment of the <abbr title="Social Fund Maternity and Funeral Expenses (General) Regulations 1987 (S.I. 1987/481)">General Regulations</abbr></heading><num>2.</num><content><p>In regulation 5(2) of the <abbr title="Social Fund Maternity and Funeral Expenses (General) Regulations 1987 (S.I. 1987/481)">General Regulations</abbr> (amount of a Sure Start Maternity Grant), in each place where the amount “£300” appears there shall be substituted the amount “£500”.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Transitional arrangements</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><intro><p>Subject to paragraph (2) of this regulation, the <abbr title="Social Fund Maternity and Funeral Expenses (General) Regulations 1987 (S.I. 1987/481)">General Regulations</abbr> shall have effect as if regulation 2 of these Regulations had not been made where—</p></intro><level class="para1" eId="regulation-3-1-a"><num>(a)</num><content><p>the expected date of confinement;</p></content></level><level class="para1" eId="regulation-3-1-b"><num>(b)</num><content><p>the expected date of birth of the child (including any still-born);</p></content></level><level class="para1" eId="regulation-3-1-c"><num>(c)</num><content><p>the date of the adoption order; or</p></content></level><level class="para1" eId="regulation-3-1-d"><num>(d)</num><content><p>in the case of a child in respect of whom an order has been granted pursuant to section 30 of the Human Fertilisation and Embryology Act 1990<authorialNote class="footnote" eId="f00006" marker="6"><p><ref eId="c00010" href="http://www.legislation.gov.uk/id/ukpga/1990/37">1990 c. 37</ref>.</p></authorialNote>, the date of the order,</p></content></level><wrapUp><p>is before 16th June 2002.</p></wrapUp></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><content><p>Subject to paragraph (3), where a claim is made for a Sure Start Maternity Grant before 16th June 2002 in respect of a child born (including any still-born) on or after that date, regulation 5(2) of the <abbr title="Social Fund Maternity and Funeral Expenses (General) Regulations 1987 (S.I. 1987/481)">General Regulations</abbr> shall have effect as if the amount of the Sure Start Maternity Grant in that case were £500.</p></content></paragraph><paragraph eId="regulation-3-3"><num>(3)</num><intro><p>Where a decision is made in a case to which paragraph (2) applies on the basis that the amount of a Sure Start Maternity Grant is £300—</p></intro><level class="para1" eId="regulation-3-3-a"><num>(a)</num><intro><p>that decision may be revised under section 9 of the Social Security Act 1998 (revision of decisions)—</p></intro><level class="para2" eId="regulation-3-3-a-i"><num>(i)</num><content><p>within 13 months of that decision; or</p></content></level><level class="para2" eId="regulation-3-3-a-ii"><num>(ii)</num><content><p>where the Secretary of State receives an application for a revision of that decision made within 13 months of that decision;
