Regulations—</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation, commencement and extent</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the National Health Service (General Dental Services) Amendment Regulations 2002 and shall come into force on 1st April 2002.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations extend to England only.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Amendment of the National Health Service (General Dental Services) Regulations 1992</heading><num>2.</num><content><p>The National Health Service (General Dental Services) Regulations 1992<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00012" href="http://www.legislation.gov.uk/id/uksi/1992/661">S.I. 1992/661</ref>; relevant amending instruments are S.I.s <ref eId="c00013" href="http://www.legislation.gov.uk/id/uksi/1992/1509">1992/1509</ref>, <ref eId="c00014" href="http://www.legislation.gov.uk/id/uksi/1995/3092">1995/3092</ref>, <ref eId="c00015" href="http://www.legislation.gov.uk/id/uksi/1996/2051">1996/2051</ref>, <ref eId="c00016" href="http://www.legislation.gov.uk/id/uksi/1998/1648">1998/1648</ref>, <ref eId="c00017" href="http://www.legislation.gov.uk/id/uksi/2001/705">2001/705</ref>, <ref eId="c00018" href="http://www.legislation.gov.uk/id/uksi/2001/3741">2001/3741</ref> and <ref eId="c00019" href="http://www.legislation.gov.uk/id/uksi/2001/3963">2001/3963</ref>.</p></authorialNote> shall be amended in accordance with the following provisions of these Regulations.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Amendment of regulation 5</heading><num>3.</num><content><p><mod>In regulation 5 (application for inclusion in the dental list), for paragraph (3ZA)(a), substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="uksi" ukl:TargetClass="secondary" ukl:TargetSubClass="regulation" ukl:Context="main" ukl:Format="default"><level class="para1"><num>(a)</num><content><p>the information provided by the dentist in accordance with paragraphs 5B and 14 of Schedule 2 and the references provided by the referees nominated by the dentist in accordance with paragraph 11A of that Schedule.</p></content></level></quotedStructure></mod></p></content></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Amendment of regulation 5ZA</heading><num>4.</num><intro><p>In regulation 5ZA (grounds for refusal)—</p></intro><level class="para1" eId="regulation-4-a"><num>(a)</num><content><p><mod>for paragraph (1)(c) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><level class="para1"><num>(c)</num><content><p>that having contacted the referees nominated by the dentist in accordance with paragraph 11A of Schedule 2, they are not satisfied with the references given.</p></content></level></quotedStructure></mod></p></content></level><level class="para1" eId="regulation-4-b"><num>(b)</num><content><p><mod>in paragraph (3)(g) for the words from “what the facts were” to the end, substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><p>the facts relating to the matter which led to such action and the reasons given by the Health Authority or equivalent body for such action;</p></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Amendment of regulation 5ZB</heading><num>5.</num><intro><p>In regulation 5ZB (deferment of decision)—</p></intro><level class="para1" eId="regulation-5-a"><num>(a)</num><content><p><mod>in paragraph (1)(a) for the words from “legal proceedings” to “in the United Kingdom” substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><p>proceedings in respect of conduct which, if it had occurred in the United Kingdom, would constitute a criminal offence,</p></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="regulation-5-b"><num>(b)</num><content><p>in paragraph (1)(b) for “successful” substitute “adverse”;</p></content></level><level class="para1" eId="regulation-5-c"><num>(c)</num><content><p><mod>in paragraph (4) for “must notify the dentist” to the end, substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>shall notify the dentist in writing that he must—</p><blockList class="ordered alpha parens" ukl:Name="OrderedList" ukl:Type="alpha" ukl:Decoration="parens"><item><num>(a)</num><p>update his application within 28 days of the date of the notification (or such longer period as the Health Authority may agree);</p></item><item><num>(b)</num><p>confirm in writing within the period mentioned in sub-paragraph (a) that he wishes to proceed with his application.</p></item></blockList></item></blockList></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Amendment of regulation 5ZD</heading><num>6.</num><intro><p>In regulation 5ZD (conditional inclusion)—</p></intro><level class="para1" eId="regulation-6-a"><num>(a)</num><content><p><mod>for paragraph (16) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><paragraph><num>(16)</num><content><p>The Health Authority shall notify any person or body of the information specified in paragraph (14) if that person or body can establish that it is employing the dentist in a professional capacity and the Health Authority receives a written request (including an electronic request) from that person or body to do so.</p></content></paragraph></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="regulation-6-b"><num>(b)</num><content><p>at the end of paragraph (17) add “relating to that information”.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-7"><heading>Amendment of regulation 8B</heading><num>7.</num><intro><p>Regulation 8B (criteria for decisions on removal) shall be amended as follows—</p></intro><level class="para1" eId="regulation-7-a"><num>(a)</num><content><p><mod>For paragraph (2)(b) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><level class="para1"><num>(b)</num><content><p>the length of time since any offence, incident, conviction or investigation;</p></content></level></quotedStructure></mod></p></content></level><level class="para1" eId="regulation-7-b"><num>(b)</num><content><p><mod>for paragraph (2)(g) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><level class="para1"><num>(g)</num><content><p>whether the dentist has been refused admittance to, conditionally included in, contingently removed, removed or is currently suspended from other Health Authority lists or equivalent lists, and if so, the facts relating to the matter which led to such action and the reasons given by the Health Authority or equivalent body for such action;</p></content></level></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="regulation-7-c"><num>(c)</num><content><p><mod>for paragraph (4)(b) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><level class="para1"><num>(b)</num><content><p>the length of time since the last incident of fraud occurred, and since any investigation into that incident of fraud was concluded;</p></content></level></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="regulation-7-d"><num>(d)</num><content><p>in paragraph (4)(e) for “the investigation” substitute “any investigation into the incident of fraud”;</p></content></level><level class="para1" eId="regulation-7-e"><num>(e)</num><content><p><mod>for paragraph (4)(f) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><level class="para1"><num>(f)</num><content><p>whether he has been refused admittance to, conditionally included in, contingently removed, removed or is currently suspended from other Health Authority lists or equivalent lists, and if so, the facts relating to the matter which led to such action and the reasons given by the Health Authority or equivalent body for such action;</p></content></level></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="regulation-7-f"><num>(f)</num><content><p><mod>for paragraph (6)(a) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><level class="para1"><num>(a)</num><content><p>the nature of any incident which was prejudicial to the efficiency of the General Dental Services provided by him;</p></content></level></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="regulation-7-g"><num>(g)</num><content><p><mod>for paragraph (6)(b) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><level class="para1"><num>(b)</num><content><p>the length of time since the last such incident occurred, and since any investigation into that incident was concluded;</p></content></level></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-8"><heading>Amendment of regulation 8D</heading><num>8.</num><intro><p>In Regulation 8D (notifications by Health Authorities)—</p></intro><level class="para1" eId="regulation-8-a"><num>(a)</num><content><p>in paragraph (1), for “they shall notify the persons or bodies” to the end, substitute “they shall notify the persons and bodies specified in paragraph (2), and shall additionally notify those specified in paragraph (3) if so requested by those persons or bodies in writing (including electronically), of the matters set out in paragraph (4).”.</p></content></level><level class="para1" eId="regulation-8-b"><num>(b)</num><content><p><mod>for paragraph (3) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><paragraph><num>(3)</num><content><p>The persons or bodies to be additionally notified in accordance with paragraph (1) are persons or bodies that can establish that they are considering employing the dentist in a professional capacity.</p></content></paragraph></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="regulation-8-c"><num>(c)</num><content><p>at the end of paragraph (5) add “relating to that information”.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-9"><heading>Amendment of regulation 8E</heading><num>9.</num><content><p>In regulation 8E (procedure on removal), in paragraph (3)(c), omit “calendar”.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-10"><heading>Amendment of regulation 8G</heading><num>10.</num><content><p>In regulation 8G (procedure on review of Health Authority decision), omit paragraph (1)(e).</p></content></hcontainer><hcontainer name="regulation" eId="regulation-11"><heading>Amendment of Schedule 4</heading><num>11.</num><content><p>In Schedule 4 (prior approval treatment), in each of paragraphs 1 and 2 of Part II, for “£260” substitute “£375”.</p></content></hcontainer><hcontainer (General Dental Services) Regulations (“the principal Regulations”).
