The School Budget Shares (Prescribed Purposes) (England) Regulations 2002

These Regulations may be cited as the School Budget Shares (Prescribed Purposes) (England) Regulations 2002 and shall come into force on 1st April 2002.

These Regulations shall apply for the purposes of the expenditure of budget shares of maintained schools in England.

In these Regulations “maintained school” means a community, foundation or voluntary school or a community or foundation special school.

The following purposes are hereby prescribed for the expenditure of the budget share of a maintained school by its governing body—
(a)
the provision of teaching to pupils registered at other maintained schools;
(b)
the provision of learning materials, educational resources, transport, meals and accommodation for pupils registered at other maintained schools.

These purposes are prescribed subject to the condition that the governing body by 30th June each year submits to the local education authority maintaining the school a statement, in a form determined and published by the local education authority, setting out details of the provision made in the preceding financial year in accordance with these Regulations, and the expenditure on that provision.
These regulations prescribe the categories of expenditure which the governing bodies of maintained schools may incur in respect of pupils registered at maintained schools other than the school undertaking the expenditure. The purpose of the regulations is to enable a maintained school to supply educational services and associated items to pupils of other schools using its own budget share rather than having to receive recompense from those other schools for such supply.
Under regulations made concurrently under section 47 of the School Standards and Framework Act 1998, local education authorities may include sums in a maintained school’s budget share in respect of provision made in accordance with these regulations.
