The Lord Chancellor, in exercise of the powers conferred upon him by sections 173(4) and 197(1) of the Transport Act 20001, hereby makes the following Regulations:—

Citation, commencement and extent1

These Regulations may be cited as the Road User Charging (Enforcement of Charging Scheme Penalty Charges) (England and Wales) Regulations 2002 and shall come into force on 1st January 2003.

Recovery of charging scheme penalty charges payable under a road user charging scheme2

In respect of a charging scheme specified in the Schedule to these Regulations, any charging scheme penalty charges which are payable to a charging authority shall, if a county court so orders, be recoverable by that authority, as if they were payable under a county court order.

SCHEDULE

Regulation 2

The County Council of Durham (Market Place leading to Saddler Street, Durham City) (Road User Charging Scheme) Order 2002.

(This note is not part of the Regulations)

These Regulations relate to road user charging schemes in areas of England and Wales under Part III of the Transport Act 2000. They provide that, in respect of charging schemes specified in the Schedule to the Regulations, any charging scheme penalty charges payable to a charging authority under a road user charging scheme shall, if a county court so orders, be recoverable by the charging authority, as if they were payable under a county court order. The Schedule specifies the County Council of Durham (Market Place leading to Saddler Street, Durham City) (Road User Charging Scheme) Order 2002.
