The regulations in it are therefore exempted by section 173(5)(b) of the Social Security Administration Act 1992 from the requirement under section 172 of that Act to refer the proposals to make the regulations to the Social Security Advisory Committee and they are made without reference to the Committee.</dc:description>

Adoption Pay (Persons Abroad and Mariners) Regulations 2002 and shall come into force on 8th December 2002.</Text></P2para></P2><P2 Contributions and Benefits Act 1992 c. 4">the Act</Abbreviation>” means the Social Security Contributions and Benefits Act 1992;</Text></Para></ListItem><ListItem><Para><Text> <CommentaryRef Ref="key-af595b2559ccaabddbe313d74414b01b"/>...</Text></Para></ListItem><ListItem><Para><Text><CommentaryRef Ref="key-af595b2559ccaabddbe313d74414b01b"/>... </Text></Para></ListItem><ListItem><Para><Text> <Substitution ChangeId="key-43a87a9580a21f0a2198e7201600e0c8-1719919379617" CommentaryRef="key-43a87a9580a21f0a2198e7201600e0c8">“</Substitution><Term><Substitution ChangeId="key-43a87a9580a21f0a2198e7201600e0c8-1719919379617" CommentaryRef="key-43a87a9580a21f0a2198e7201600e0c8">adopter</Substitution></Term><Substitution ChangeId="key-43a87a9580a21f0a2198e7201600e0c8-1719919379617" CommentaryRef="key-43a87a9580a21f0a2198e7201600e0c8">”, in relation to a child, means the person with whom a child is, or is expected to be, placed for adoption under the law of the United Kingdom;</Substitution> </Text></Para></ListItem><ListItem><Para><Text>“the <Abbreviation Expansion="Social Security Contributions Regulations 2001 (S.I. 2001/1004)">Contributions Regulations</Abbreviation>” means the Social Security Contributions Regulations 2001<FootnoteRef Ref="f00003"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Abbreviation Expansion="European Economic Area">EEA</Abbreviation>” means European Economic Area;</Text></Para></ListItem><ListItem><Para><Text>“EEA Agreement” means the Agreement on the European Economic Area signed at Oporto on 2nd May 1992<FootnoteRef Ref="f00004"/> as adjusted by Protocol signed at Brussels on 17th March 1993<FootnoteRef Ref="f00005"/>;</Text></Para></ListItem><ListItem><Para><Text>“EEA State” means a State which is a contracting party to the EEA Agreement;</Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-d0cb9579e8e8699afa935132df1a06bb-1719911718973" CommentaryRef="key-d0cb9579e8e8699afa935132df1a06bb">“foreign-going ship” means any ship or vessel which is not a home-trade ship;</Addition> </Text></Para></ListItem><ListItem><Para><Text>“the <Abbreviation Expansion="Statutory Paternity Pay and Statutory Adoption Pay (General) Regulations 2002 (S.I. 2002/2822)">General Regulations</Abbreviation>” means the Statutory Paternity Pay and Statutory Adoption Pay (General) Regulations 2002<FootnoteRef Ref="f00006"/>;</Text></Para></ListItem><ListItem><Para><Text><CommentaryRef Ref="M_F_4398dc35-8d0f-4188-816f-8dddc9cf6163"/>...</Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">“home-trade ship” includes—</Addition></Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">every ship or vessel employed in trading or going within the following limits, that is to say, the United Kingdom (including for this purpose the Republic of Ireland), the Channel Islands, the Isle of Man, and the continent of Europe between the river Elbe and Brest inclusive;</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">every fishing vessel not proceeding beyond the following limits—</Addition></Text><UnorderedList Decoration="none"><ListItem><Para><Text><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">on the South, Latitude 48°30’N,</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">on the West, Longitude 12°W, and</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">on the North, Latitude 61°N;</Addition></Text></Para></ListItem></UnorderedList></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">“mariner” means a person who is or has been in employment under a contract of service either as a master or member of the crew of any ship or vessel, or in any other capacity on board any ship or vessel where—</Addition></Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">the employment in that other capacity is for the purposes of that ship or vessel or her crew or any passengers or cargo or mails carried by the ship or vessel; and</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">the contract is entered into in the United Kingdom with a view to its performance (in whole or in part) while the ship or vessel is on her voyage;</Addition></Text></Para></ListItem></OrderedList><Text><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">but does not include a person in so far as their employment is as a serving member of the forces;</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">“</Addition><CommentaryRef Ref="key-49c3fef7b25b8ab3b848b7d5f4097cb3"/><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">... statutory paternity pay (adoption)” means statutory paternity pay payable in accordance with the provisions of Part 12ZA of the Act where the conditions specified in section 171ZB(2) of the Act are satisfied;</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">“</Addition><CommentaryRef Ref="key-11688a81e50f269b72598aa9d7411dad"/><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">... statutory paternity pay (birth)” means statutory paternity pay payable in accordance with the provisions of Part 12ZA of the Act where the conditions specified in section 171ZA(2) of the Act are satisfied;</Addition></Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2"><Addition ChangeId="key-6bffc59911c9a354ee6a66216bfe0d01-1719920125562" CommentaryRef="key-6bffc59911c9a354ee6a66216bfe0d01">“</Addition></Addition><Term><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" adoption</Addition></Addition></Term><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2"><Addition ChangeId="key-6bffc59911c9a354ee6a66216bfe0d01-1719920125562" CommentaryRef="key-6bffc59911c9a354ee6a66216bfe0d01">” means—</Addition></Addition></Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2"><Addition ChangeId="key-6bffc59911c9a354ee6a66216bfe0d01-1719920125562" CommentaryRef="key-6bffc59911c9a354ee6a66216bfe0d01">placed for adoption under the Adoption and Children Act 2002  or the Adoption and Children (Scotland) Act 2007 ; or</Addition></Addition></Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2"><Addition ChangeId="key-6bffc59911c9a354ee6a66216bfe0d01-1719920125562" CommentaryRef="key-6bffc59911c9a354ee6a66216bfe0d01">placed in accordance with section 22C of the Children Act 1989  with a local authority foster parent  who is also a prospective adopter;</Addition></Addition> </Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text><Addition ChangeId="key-3d72dd956d3cd55dbd98d901af64b3a2-1719912656313" CommentaryRef="key-3d72dd956d3cd55dbd98d901af64b3a2">“serving member of the forces” means a person, other than one mentioned in Part 2 of the Schedule, who, being over the age of 16, is a member of any establishment or organisation specified in Part 1 of that Schedule (being a member who gives full pay service) but does not include any such person while absent on desertion;</Addition> </Text></Para></ListItem><ListItem><Para><Text>“week” means a period of 7 days beginning with Sunday.</Text></Para></ListItem></UnorderedList></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2002/2821/regulation/1/3" IdURI="http://www.legislation.gov.uk/id/uksi/2002/2821/regulation/1/3" id="regulation-1-3"><Pnumber><Substitution ChangeId="key-9d4fcd113ba5c8cd6629c4f145d23ffd-1719919324204" CommentaryRef="key-9d4fcd113ba5c8cd6629c4f145d23ffd">3</Substitution></Pnumber><P2para><Text><Substitution ChangeId="key-9d4fcd113ba5c8cd6629c4f145d23ffd-1719919324204" CommentaryRef="key-9d4fcd113ba5c8cd6629c4f145d23ffd">For the purposes of these Regulations—</Substitution></Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2002/2821/regulation/1/3/a" IdURI="http://www.legislation.gov.uk/id/uksi/2002/2821/regulation/1/3/a" id="regulation-1-3-a"><Pnumber><Substitution ChangeId="key-9d4fcd113ba5c8cd6629c4f145d23ffd-1719919324204" CommentaryRef="key-9d4fcd113ba5c8cd6629c4f145d23ffd">a</Substitution></Pnumber><P3para><Text><Substitution ChangeId="key-9d4fcd113ba5c8cd6629c4f145d23ffd-1719919324204" CommentaryRef="key-9d4fcd113ba5c8cd6629c4f145d23ffd">a person is matched with a child for adoption when an adoption agency decides that that person would be a suitable adoptive parent for the child;</Substitution></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2002/2821/regulation/1/3/b" IdURI="http://www.legislation.gov.uk/id/uksi/2002/2821/regulation/1/3/b" id="regulation-1-3-b"><Pnumber><Substitution ChangeId="key-9d4fcd113ba5c8cd6629c4f145d23ffd-1719919324204" CommentaryRef="key-9d4fcd113ba5c8cd6629c4f145d23ffd">b</Substitution></Pnumber><P3para><Text><Substitution ChangeId="key-9d4fcd113ba5c8cd6629c4f145d23ffd-1719919324204" CommentaryRef="key-9d4fcd113ba5c8cd6629c4f145d23ffd">in a case where paragraph (a) applies, a person is notified as having been matched with a child on the date that person receives notification of the agency's decision, under regulation 33(3)(a) of the Adoption Agencies Regulations 2005, regulation 28(3) of the Adoption Agencies (Wales) Regulations 2005 or regulation 8(5) of the Adoption Agencies (Scotland) Regulations 2009;</Substitution></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2002/2821/regulation/1/3/c" IdURI="http://www.legislation.gov.uk/id/uksi/2002/2821/regulation/1/3/c" id="regulation-1-3-c"><Pnumber><Substitution ChangeId="key-9d4fcd113ba5c8cd6629c4f145d23ffd-1719919324204" CommentaryRef="key-9d4fcd113ba5c8cd6629c4f145d23ffd">c</Substitution></Pnumber><P3para><Text><Substitution ChangeId="key-9d4fcd113ba5c8cd6629c4f145d23ffd-1719919324204" CommentaryRef="key-9d4fcd113ba5c8cd6629c4f145d23ffd">a person is also matched with a child for adoption when a decision has been made in accordance with regulation 22A of the Care Planning, Placement and Case Review (England) Regulations 2010 and an adoption agency has identified that person with whom the child is to be placed in accordance with regulation 12B of the Adoption Agencies Regulations 2005;</Substitution></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2002/2821/regulation/1/3/d" IdURI="http://www.legislation.gov.uk/id/uksi/2002/2821/regulation/1/3/d" CommentaryRef="key-9d4fcd113ba5c8cd6629c4f145d23ffd">d</Substitution></Pnumber><P3para><Text><Substitution ChangeId="key-9d4fcd113ba5c8cd6629c4f145d23ffd-1719919324204" CommentaryRef="key-9d4fcd113ba5c8cd6629c4f145d23ffd">in a case where paragraph (c) applies, a person is notified as having been matched with a child on the date on which that person receives
