2000<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00001" href="http://www.legislation.gov.uk/id/ukpga/2000/21">2000 c. 21</ref>.</p></authorialNote>, the Secretary of State for Education and Skills hereby makes the following Order:</p></formula></preamble><body><article eId="article-1"><heading>Citation and interpretation</heading><num>1.</num><paragraph eId="article-1-1"><num>(1)</num><content><p>This Order may be cited as the Learning and Skills Act 2000 (Commencement <abbr title="Number">No.</abbr> 4) and Transitional Provisions Order 2002.</p></content></paragraph><paragraph eId="article-1-2"><num>(2)</num><content><p>In this Order “<abbr title="Learning and Skills Act 2000 c. 21">the Act</abbr>” means the Learning and Skills Act 2000.</p></content></paragraph></article><article eId="article-2"><heading>Provisions coming into force</heading><num>2.</num><paragraph eId="article-2-1"><num>(1)</num><content><p>Section 7 of <abbr title="Learning and Skills Act 2000 c. 21">the Act</abbr> shall come into force on 1st March 2002.</p></content></paragraph><paragraph eId="article-2-2"><num>(2)</num><intro><p>The following provisions of <abbr title="Learning and Skills Act 2000 c. 21">the Act</abbr> shall come into force on 1st April 2002—</p></intro><level class="para1" eId="article-2-2-a"><num>(a)</num><content><p>section 103(2) and (3) insofar as it relates to England and to the extent that it is not already in force;</p></content></level><level class="para1" eId="article-2-2-b"><num>(b)</num><content><p>section 140(1) and (2) insofar as it relates to England.</p></content></level></paragraph><paragraph eId="article-2-3"><num>(3)</num><intro><p>The following provisions of <abbr title="Learning and Skills Act 2000 c. 21">the Act</abbr> shall come into force on 1st August 2002—</p></intro><level class="para1" eId="article-2-3-a"><num>(a)</num><content><p>section 97 insofar as it relates to England;</p></content></level><level class="para1" eId="article-2-3-b"><num>(b)</num><content><p>section 110(2), (4) and (5) insofar as it relates to England and to the extent that it is not already in force.</p></content></level></paragraph></article><article eId="article-3"><heading>Transitional Provisions</heading><num>3.</num><paragraph eId="article-3-1"><num>(1)</num><content><p>Despite the provisions of article 2(2) above, the duty contained in section 140(2) of <abbr title="Learning and Skills Act 2000 c. 21">the Act</abbr> shall not apply in relation to any person if a Connexions partnership has not been established for the area of the local education authority in which the person undertakes his last year of compulsory schooling.</p></content></paragraph><paragraph eId="article-3-2"><num>(2)</num><intro><p>For the purposes of paragraph (1)—</p></intro><level class="para1" eId="article-3-2-a"><num>(a)</num><content><p>a “Connexions partnership” means a body known by that name whose functions include the provision of services such as are described in section 114 of <abbr title="Learning and Skills Act 2000 c. 21">the Act</abbr> pursuant to arrangements made by the Secretary of State; and</p></content></level><level class="para1" eId="article-3-2-b"><num>(b)</num><content><p>a Connexions partnership is “established” on the first occasion on which financial assistance is given to the body pursuant to section 114(3) of <abbr
