The Pollution Prevention and Control (England and Wales) (Amendment) Regulations 2002

The Secretary of State, in exercise of the powers conferred on her by section 2 of the Pollution Prevention and Control Act 19991, having, in accordance with subsection (4) of that section, consulted the Environment Agency, such bodies or persons appearing to her to be representative of the interests of local government, industry, agriculture and small businesses respectively as she considers appropriate and such other bodies and persons as she considers appropriate, hereby makes the following Regulations:

Citation, commencement and extent1.

(1)

These Regulations may be cited as the Pollution Prevention and Control (England and Wales) (Amendment) Regulations 2002 and shall come into force on 1st April 2002.

(2)

These Regulations extend to England and Wales only.

(3)

For the purpose of paragraph (2), “England and Wales” includes the territorial waters adjacent to England and Wales.

Amendment of the Pollution Prevention and Control (England and Wales) Regulations 20002.

(1)

The Pollution Prevention and Control (England and Wales) Regulations 20002 shall be amended as follows.

(2)

In the Table in paragraph 2(2) of Part 1 of Schedule 3, vary the entries to show that the relevant period—

(a)

for an activity falling within Part A(2) of Section 2.1, is 1st May 2003 to 31st July 2003;

(b)

for an activity falling within Part A(2) of Section 3.1, is 1st April 2003 to 30th June 2003;

(c)

for an activity falling within Part A(2) of Section 3.3, is 1st May 2003 to 31st July 2003;

(d)

for an activity falling within Part A(2) of Section 3.5, is 1st April 2003 to 30th June 2003; and

(e)

for an activity falling within Part A(2) of Section 6.1, is 1st April 2003 to 30th June 2003.

Substitute the following Table for the Table in paragraph 10 of Part 2 of Schedule 3—

Any installation where an activity falling within Part B of the following Sections of Part 1 of Schedule 1 is carried out or any mobile plant used to carry out such an activity

Sub-paragraphs (a), (b) and (c) of regulation 2(3) of the Pollution Prevention and Control (England and Wales) (Amendment) Regulations 2001 are revoked.

(This note is not part of the Regulations)

These Regulations amend the Pollution Prevention and Control (England and Wales) Regulations 2000.

Those Regulations require operators of the Part A(2) activities listed in regulation 2(2) and of all Part B activities to apply at times set out in the Regulations to local authorities for permits to continue operating. Part A(2) activities are subject to integrated pollution control by local authorities. Part B activities are subject to air pollution only control by local authorities. Regulation 2 defers by one year the periods within which or dates by which these applications for permits are to be made.

Regulation 3 revokes sub-paragraphs (a), (b) and (c) of regulation 2(3) of the Pollution Prevention and Control (England and Wales) (Amendment) Regulations 2001, those sub-paragraphs being superseded.
