					<dc:description>This Order provides for the regulation of a number of health professions (arts therapists; chiropodists; clinical scientists; dietitians; medical laboratory technicians; occupational therapists; orthoptists; paramedics; physiotherapists; prosthetists and orthotists; radiographers; and speech and language therapists) it creates a regulatory body, the Health Professions Council, which is required to set standards of education, training, conduct and performance and to put in place arrangements to ensure that they are met (article 3). It provides for the Council to keep a register of qualified members of the professions and creates four statutory committees: the Investigating Committee, Conduct and Competence Committee, Health Committee and Education and Training Committee (article 3(9)). The Order replaces the regulatory system provided for by the Professions Supplementary to Medicine Act 1960.</dc:description>

IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/1" id="article-33-1"><Pnumber>1</Pnumber><P2para><Text>Where a person who has been struck off the register by virtue of an order made by a Practice Committee or the court wishes to be restored to the register, he shall make an application for restoration to the Registrar.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/2" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/2" id="article-33-2"><Pnumber>2</Pnumber><P2para><Text>Subject to article 30(7), no such application may be made—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/2/a" id="article-33-2-a"><Pnumber>a</Pnumber><P3para><Text>before the end of the period of five years beginning with the date on which the order under article 29, 30 or 38 took effect; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/2/b" id="article-33-2-b"><Pnumber>b</Pnumber><P3para><Text>in any period of twelve months in which an application for restoration to the register has already been made by the person who has been struck off.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/3" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/3" id="article-33-3"><Pnumber>3</Pnumber><P2para><Text>Any application for restoration shall be referred by the Registrar for determination to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/3/a" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/3/a" id="article-33-3-a"><Pnumber>a</Pnumber><P3para><Text>the Committee which made the striking-off order; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/3/b" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/3/b" id="article-33-3-b"><Pnumber>b</Pnumber><P3para><Text>where any previous applications have been made in connection with the same striking-off order, the Committee which last gave a decision on such an application.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/4" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/4" id="article-33-4" RestrictStartDate="2003-03-14"><Pnumber><CommentaryRef Ref="key-c43445f1af898698a68dd26c60815563"/>4</Pnumber><P2para><Text>Before making any decision on the application the Committee shall give the applicant an opportunity to appear before it and to argue his case in accordance with rules made by <Abbreviation Expansion="the Health Professions Council">the Council</Abbreviation> which shall include the matters referred to in article 32(2)(b), (g), (i), (j), (k), (m), (n) and (o).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/5" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/5" id="article-33-5"><Pnumber>5</Pnumber><P2para><Text>The Committee shall not grant an application for restoration unless it is satisfied, on such evidence as it may require, that the applicant not only satisfies the requirements of article 9(2)(a) and (b) but, having regard in particular to the circumstances which led to the making of the order under article 29, 30 or 38, is also a fit and proper person to practise the relevant profession.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/6" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/6" id="article-33-6"><Pnumber>6</Pnumber><P2para><Text>The Committee may make the granting of an application subject to the applicant satisfying such requirements as to additional education or training and experience as the Council has specified under article 19(3) and which apply to him.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/7" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/7" id="article-33-7" RestrictStartDate="2003-03-14"><Pnumber>7</Pnumber><P2para><Text>On granting an application for restoration, the Committee—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/7/a" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/7/a" id="article-33-7-a" RestrictStartDate="2003-03-14"><Pnumber><CommentaryRef Ref="key-c43445f1af898698a68dd26c60815563"/>a</Pnumber><P3para><Text>shall direct the Registrar to register the applicant in the relevant part of the register <Addition ChangeId="key-d0875eb777728c012a8c2efcbadb0ab9-1747061628991" CommentaryRef="key-d0875eb777728c012a8c2efcbadb0ab9">on his satisfying the Registrar as mentioned in article 10(4)(aa),</Addition>  on his satisfying any requirements imposed under paragraph (6) and on payment of the prescribed fee; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/7/b" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/7/b" id="article-33-7-b"><Pnumber>b</Pnumber><P3para><Text>may make a conditions of practice order with respect to him.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/8" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/8" id="article-33-8"><Pnumber>8</Pnumber><P2para><Text>The provisions of article 29 shall have effect in relation to a conditions of practice order made under paragraph (7) as they have effect in relation to a conditions of practice order made under that article and article 30 shall apply as if the order made under paragraph (7) were an order made under article 29.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/9" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/9" id="article-33-9"><Pnumber>9</Pnumber><P2para><Text>If, while a striking-off order is in force, a second or subsequent application for restoration to the register, made by the person who has been struck off, is unsuccessful, the Committee which determined that application may direct that that person’s right to make any further such applications shall be suspended indefinitely.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/10" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/10" id="article-33-10"><Pnumber>10</Pnumber><P2para><Text>A person in respect of whom a direction is made under paragraph (9) may, after the expiration of three years from the date on which the direction was made, apply to the Registrar for that direction to be reviewed and, thereafter, may make further applications for review but no such application may be made before the expiration of three years from the date of the most recent review decision.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/11" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/11" id="article-33-11"><Pnumber>11</Pnumber><P2para><Text>The Registrar shall refer an application made under paragraph (10) to the Committee which made the direction under paragraph (9).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/12" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/12" id="article-33-12"><Pnumber>12</Pnumber><P2para><Text>A person whose application under paragraph (10) or whose application for restoration is refused or made subject to his satisfying requirements under paragraph (6) may appeal to the appropriate Court and article 38 shall apply to that appeal.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2002/254/article/33/13" IdURI="http://www.legislation.gov.uk/id/uksi/2002/254/article/33/13" id="article-33-13"><Pnumber>13</Pnumber><P2para><Text>The appeal must be brought before the end of the period of 28 days beginning with the date on which notice of the decision rejecting the application, or granting it but imposing conditions under paragraph
