The National Health Service Reform and Health Care Professions Act 2002 (Supplementary, Consequential etc. Provisions) Regulations 2002

11.—(1) The Public Health (Control of Disease) Act 1984 (1) is amended as follows.

(2) In section 1 (authorities administering Act), in subsection (4)(b)(2), before “Health Authorities” there is inserted “Strategic Health Authorities,”.

(3) In section 13 (regulations for control of certain diseases), in subsection (4)(a)(3), after “port health authorities,” there is inserted “Strategic Health Authorities,”.

(4) In section 37 (removal to hospital of person with notifiable disease)(4)—

(a) in subsection (1), for “of the Health Authority in whose area lies the area, or the greater part of the area, of the local authority” there is substituted “mentioned in subsection (1A) below”, and

(b) after subsection (1) there is inserted—

“(1A) The consent referred to in subsection (1) above is that of a Primary Care Trust or Health Authority—

(a) any part of whose area falls within that of the local authority, and

(b) which appears to the local authority to be an appropriate Primary Care Trust or Health Authority from whom to obtain consent.”.

(5) In section 41 (removal to hospital of inmate of common lodging-house with notifiable disease)(5), in subsection (1), for “Health Authority in whose area lies the area, or the greater part of the area, of the local authority” there is substituted “Primary Care Trust or Health Authority in whose area the common lodging-house is situated”.
