The Secretary of State, in exercise of the powers conferred upon her by section 33(10) of the National Heritage Act 1983(1) hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the National Heritage (Territorial Waters Adjacent to England) Order 2002, and shall come into force on 15th October 2002.

Interpretation

2.  In this Order—

“co-ordinate” means a co-ordinate on the Ordnance Survey of Great Britain 1936 Datum;

“line”, in relation to any list of co-ordinates in this Order, means a loxodromic line.

Boundaries—internal waters and territorial sea—Scotland

3.  For the purposes of section 33(9) of the National Heritage Act 1983, the boundaries between waters which are to be treated as internal waters or territorial sea of the United Kingdom adjacent to England and those which are not shall be—

(a)off the east coast of Great Britain, a line joining the co-ordinates set out in Part I of the Schedule to this Order; and,

(b)off the west coast of Great Britain, a line joining the co-ordinates set out in Part II of that Schedule.

Boundaries—internal waters and territorial sea—Wales

4.  For the purposes of section 33(9) of the National Heritage Act 1983 the boundary between those parts of the sea within the Severn and Dee Estuaries which are to be treated as adjacent to England and those which are not shall be, in each case, a line drawn between the co-ordinates set out in Part III of the Schedule to this Order.

Explanatory Note

(This note is not part of the Order)

Sections 33(9) and 33(10) of the National Heritage Act 1983, which were inserted by the National Heritage Act 2002, give the Historic Buildings and Monuments Commission for England (English Heritage) power to preserve and to promote the public’s enjoyment of ancient monuments which are in, on or under the sea bed, within the seaward limits of the United Kingdom territorial waters which are adjacent to England, such boundaries to be determined by the Secretary of State. The Order determines for the purposes of section 33(9) the boundaries between waters which are to be treated as internal waters or territorial sea of the United Kingdom adjacent to England and those which are not.
