These Regulations replace the existing Regulations relating to the functions of Health Authorities and Primary Care Trusts in England in the light of the provisions of the National Health Service Reform and Health Care Professions Act 2002 (c. 17) which rename Health Authorities in England as Strategic Health Authorities and allow for direct delegation of the Secretary of State’s functions to Primary Care Trusts.

Functions not to be exercisable by Primary Care Trusts5

The functions exercisable by a Strategic Health Authority under the enactments specified in column (1) of Schedule 3 to these Regulations (the subject matter of the relevant functions being indicated in column (2) of that Schedule) are not to be exercisable by Primary Care Trusts.

Any function conferred on a Strategic Health Authority concerning the giving of any directions is not to be exercisable by a Primary Care Trust.
