Schedule 3 was amended by the Road Traffic Act 1991 (Amendment of Schedule 3) (England and Wales) Order 1996 (<abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00002" href="http://www.legislation.gov.uk/id/uksi/1996/500">1996/500</ref>).</p></authorialNote> with respect to part of their area and the Secretary of State has consulted the Chief Constable of the Essex Police in accordance with the requirements of paragraphs 1(3) and 2(3) of that Schedule and the Council on Tribunals in accordance with the requirements of section 8 of the Tribunals and Inquiries Act 1992<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/1992/53">1992 c. 53</ref>.</p></authorialNote>;</p><formula name="enactingText"><p>Now, the Secretary of State for Transport, in exercise of the powers conferred by paragraphs 1(1), 2(1) and 3(3) of Schedule 3 to the Road Traffic Act 1991 and of all other powers enabling him in that behalf, hereby makes the following Order:—</p></formula></preamble><body><hcontainer name="crossheading" ukl:Name="P1group"><heading>Citation and commencement</heading><article eId="article-1"><num>1.</num><content><p>This Order may be cited as the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Essex) (District of Epping Forest) Order 2002 and shall come into force on 1st October 2002.</p></content></article></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Interpretation</heading><article eId="article-2"><num>2.</num><intro><p>In this Order—</p></intro><hcontainer name="definition"><content><p>“the <abbr title="Road Traffic Regulation Act 1984 c. 27">1984 Act</abbr>” means the Road Traffic Regulation Act 1984<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1984/27">1984 c. 27</ref>. Section 32(4)(a) was amended, and section 45(1) was substituted, by the New Roads and Street Works Act <ref eId="c00005" href="http://www.legislation.gov.uk/id/ukpga/1991/22">1991 (c. 22)</ref>, Schedule 8, paragraph 44. Sections 46(1A), 63A and 101(4A) and (5A) were inserted by the Road Traffic Act 1991, sections 64(2), 44(1) and 67(4) and (6). Section 102(8) was amended by the Road Traffic Act 1991, section 68(3). Section 121A was inserted by the New Roads and Street Works Act <ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/1991/22">1991 (c. 22)</ref>, section 168(1) and Schedule 8, paragraph 70.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“the <abbr title="Road Traffic Act 1991 c. 40">1991 Act</abbr>” means the Road Traffic Act 1991; and</p></content></hcontainer><hcontainer name="definition"><content><p>“the parking area” means the area designated as a permitted parking area and as a special parking area by article 4 of this Order.</p></content></hcontainer></article></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Application</heading><article eId="article-3"><num>3.</num><intro><p>This Order applies to the whole of the District of Epping Forest with the exception of the following roads:</p></intro><level class="para1" eId="article-3-a"><num>(a)</num><content><p>the M11 motorway for the whole of its length within the District of Epping Forest; and</p></content></level><level class="para1" eId="article-3-b"><num>(b)</num><content><p>the M25 motorway for the whole of its length within the District of Epping Forest.</p></content></level></article><article eId="article-4"><num>4.</num><intro><p>The Secretary of State hereby designates the area to which this Order applies as—</p></intro><level class="para1" eId="article-4-a"><num>(a)</num><content><p>a permitted parking area; and</p></content></level><level class="para1" eId="article-4-b"><num>(b)</num><content><p>a special parking area.</p></content></level></article></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Modification and application of Part II of the <abbr title="Road Traffic Act 1991 c. 40">1991 Act</abbr></heading><article eId="article-5"><num>5.</num><content><p>Sections 66, 69 to 74, 78, 79 and 82 of, and Schedule 6 to, the <abbr title="Road Traffic Act 1991 c. 40">1991 Act</abbr> shall apply in relation to the parking area and as so applied shall have effect subject to the modifications specified in Schedule 1 to this Order.</p></content></article></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Modification of other provisions</heading><article eId="article-6"><num>6.</num><content><p>The <abbr title="Road Traffic Regulation Act 1984 c. 27">1984 Act</abbr> shall be modified in relation to the parking area as specified in Schedule 2 to this class="schProv1"><num>1.</num><subparagraph eId="schedule-1-paragraph-1-1"><num>(1)</num><content><p>Section 66 shall be modified as follows.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-1-2"><num>(2)</num><content><p>In subsection (1) the words “in a designated parking place” shall be omitted.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-1-3"><num>(3)</num><content><p>Subsection (2) shall be omitted.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-1-4"><num>(4)</num><intro><p>In subsection (3)—</p></intro><level class="para1" eId="schedule-1-paragraph-1-4-a"><num>(a)</num><content><p>in paragraph (d) for the words “the specified proportion” there shall be substituted “one half”; and</p></content></level><level class="para1" eId="schedule-1-paragraph-1-4-b"><num>(b)</num><content><p>in paragraph (e) for the words “the London authority” there shall be substituted “the parking authority”.</p></content></level></subparagraph><subparagraph eId="schedule-1-paragraph-1-5"><num>(5)</num><content><p>Subsection (4) shall be omitted.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-1-6"><num>(6)</num><content><p><mod>In subsection (5) for paragraph (b) there shall be substituted—<quotedStructure startQuote="“" endQuote="”" uk:context="body" eId="schedule-1-paragraph-2-1"><num>(1)</num><content><p>Section 69 shall be modified as follows.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-2-2"><num>(2)</num><content><p><mod>For subsection (1) there shall be substituted—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><paragraph><num>(1)</num><content><p>Where, in the case of a stationary vehicle, a parking attendant has reason to believe that it has been allowed to remain at rest in any of the circumstances in which a penalty charge is payable under this Act, he or another person acting under his direction may fix an immobilisation device to the vehicle.</p></content></paragraph></quotedStructure></mod></p></content></subparagraph><subparagraph eId="schedule-1-paragraph-2-3"><num>(3)</num><content><p><mod>For subsection (8) there shall be substituted—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><paragraph><num>(8)</num><content><p>In this section “relevant authority” means the parking authority.</p></content></paragraph></quotedStructure></mod></p></content></subparagraph></paragraph><paragraph eId="schedule-1-paragraph-3" class="schProv1"><num>3.</num><subparagraph eId="schedule-1-paragraph-3-1"><num>(1)</num><content><p>Section 71 shall be modified as follows.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-3-2"><num>(2)</num><content><p>In subsection (1) for the words “a London authority” there shall be substituted “the parking authority”.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-3-3"><num>(3)</num><content><p><mod>For subsection (4) there shall be substituted—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><paragraph><num>(4)</num><intro><p>The grounds are—</p></intro><level class="para1"><num>(a)</num><content><p>that there were no reasonable grounds for the parking attendant concerned to believe that the vehicle had been permitted to remain at rest in the parking area in circumstances in which a penalty charge was payable;</p></content></level><level class="para1"><num>(b)</num><content><p>that the vehicle had been permitted to remain at rest in the place where it was by a person who was in control of the vehicle without the consent of the owner;</p></content></level><level class="para1"><num>(c)</num><content><p>that the place where the vehicle was at rest was not in the parking area;</p></content></level><level class="para1"><num>(d)</num><content><p>in a case within subsection (1)(d) above, that, by virtue of an exemption given by section 70 of this Act, section 69 did not apply to the vehicle in question; or</p></content></level><level class="para1"><num>(e)</num><content><p>that the penalty or other charge in question exceeded the amount applicable in the circumstances of the case.</p></content></level></paragraph></quotedStructure></mod></p></content></subparagraph></paragraph><paragraph eId="schedule-1-paragraph-4" class="schProv1"><num>4.</num><subparagraph eId="schedule-1-paragraph-4-1"><num>(1)</num><content><p>Section 73 shall be modified as follows.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-4-2"><num>(2)</num><content><p><mod>For subsections (1) to (3) there shall be substituted—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><paragraph><num>(1)</num><content><p>The functions conferred on the parking authorities by this section shall be discharged by them through a joint committee (“the Joint Committee”) which has been set up in pursuance of arrangements entered into under section 101(5) of the Local Government Act 1972<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00007" href="http://www.legislation.gov.uk/id/ukpga/1972/70">1972 c. 70</ref>.</p></authorialNote> and of which the parking authorities and at least two other local authorities are constituent authorities.</p></content></paragraph><paragraph><num>(2)</num><content><p>In subsection (1) “local authorities” means authorities which are county or district councils in England or county or county borough councils in Wales in whose areas permitted parking areas or special parking areas have been designated under Schedule 3 to this Act.</p></content></paragraph><paragraph><num>(3)</num><intro><p>The parking authorities shall—</p></intro><level class="para1"><num>(a)</num><content><p>with the consent of the Lord Chancellor appoint persons to act as parking adjudicators for the purposes of this Act in relation to the parking area;</p></content></level><level class="para1"><num>(b)</num><content><p>provide or secure the provision of accommodation and administrative staff for parking adjudicators so appointed; and</p></content></level><level class="para1"><num>(c)</num><content><p>determine the places at which such parking adjudicators are to sit.</p></content></level></paragraph></quotedStructure></mod></p></content></subparagraph><subparagraph eId="schedule-1-paragraph-4-3"><num>(3)</num><content><p>In subsection (5) for the words “the appointing authorities” there shall be substituted “the parking authorities”.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-4-4"><num>(4)</num><content><p>Subsections (8) to (10) shall be omitted.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-4-5"><num>(5)</num><content><p><mod>After subsection (12) there shall be inserted the following subsection—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><paragraph><num>(12A)</num><content><p>The Road Traffic (Parking Adjudicators) (England and Wales) Regulations 1999<authorialNote class="footnote" eId="f00005" marker="5"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00008" href="http://www.legislation.gov.uk/id/uksi/1999/1918">1999/1918</ref>.</p></authorialNote> shall apply to the parking area as they apply to the areas designated by the Orders listed in Schedule to those Regulations.</p></content></paragraph></quotedStructure></mod></p></content></subparagraph></paragraph><paragraph eId="schedule-1-paragraph-5" class="schProv1"><num>5.</num><content><p><mod>For section 74 there shall be substituted the following section—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><section><num>74.</num><subsection><num>(1)</num><content><p>It shall be the duty of the parking authority to set the levels of additional parking charges to apply in the parking area.</p></content></subsection><subsection><num>(2)</num><content><p>Different levels may be set for different parts of the parking area.</p></content></subsection><subsection><num>(3)</num><content><p>The levels of additional parking charges set by the parking authority under this section shall accord with guidance given by the Secretary of State whether such guidance is given specifically to the parking authority or to local authorities generally.</p></content></subsection><subsection><num>(4)</num><content><p>Guidance given by the Secretary of State under subsection (3) above may be varied at any time by the Secretary of State.</p></content></subsection><subsection><num>(5)</num><content><p>The parking authority shall publish, in such manner as the Secretary of State may determine, the levels of additional parking charges which have been set under this section.</p></content></subsection><subsection><num>(6)</num><content><p>In this section “additional parking charges” means penalty charges, charges made by the parking authority for the removal, storage and disposal of vehicles and charges for the release of vehicles from immobilisation devices fixed under section 69 of this Act.</p></content></subsection></section></quotedStructure></mod></p></content></paragraph><paragraph eId="schedule-1-paragraph-6" class="schProv1"><num>6.</num><subparagraph eId="schedule-1-paragraph-6-1"><num>(1)</num><content><p>Section 78 shall be modified as follows.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-6-2"><num>(2)</num><content><p><mod>After subsection (7) there shall be inserted the following subsection—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><paragraph><num>(8)</num><content><p>Any order made under subsection (2), and any regulations made under subsection (4), of this section shall apply with necessary modifications, including in particular the substitution for references to a London authority of references to the parking authority, in relation to the recovery of Part II debts payable in relation to the parking area.</p></content></paragraph></quotedStructure></mod></p></content></subparagraph></paragraph><paragraph eId="schedule-1-paragraph-7" class="schProv1"><num>7.</num><subparagraph eId="schedule-1-paragraph-7-1"><num>(1)</num><content><p>Section 82 shall be modified as follows.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-7-2"><num>(2)</num><content><p><mod>For subsection (1) there shall be substituted—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><paragraph><num>(1)</num><content><p>In this section and sections 66, 69 to 74, 78 and 79 of, and Schedule 6 to, this Act—</p><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>“immobilisation device” has the same meaning as in section 104(9) of the Road Traffic Regulation Act 1984;</p></item><item><p>“the Joint Committee” has the meaning given by section 73(1) of this Act;</p></item><item><p>“the parking area” means the area designated as a permitted parking area and as a special parking area by the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Essex) (District of Epping Forest) Order 2002;</p></item><item><p>“parking attendant” has the same meaning as in section 63A of the Road Traffic Regulation Act 1984;</p></item><item><p>“parking authority” means—</p><blockList class="ordered alpha parens" ukl:Name="OrderedList" ukl:Type="alpha" ukl:Decoration="parens"><item><num>(a)</num><p>in relation to a parking place which was provided or authorised under section 32(1) of the Road Traffic Regulation Act 1984, the local authority as defined by section 32(4)(a) in relation to the parking place;</p></item><item><num>(b)</num><p>in any other case, the traffic authority (other than the Secretary of State) as defined by section 121A of that Act;</p></item></blockList><p>and references to “the parking authorities” are to the Essex County Council and the Epping Forest District Council;</p></item><item><p>“penalty charge” means a penalty charge which is payable by virtue of paragraph 3(1) and (2) of Schedule 3 to this Act;</p></item><item><p>“prescribed” means prescribed by regulations made by the Secretary of State; and</p></item><item><p>“vehicle hiring agreement” and “vehicle-hire firm” have the same meanings as in section 66 of the Road Traffic Offenders
