The Secretary of State, in exercise of the powers conferred upon him by sections 12(2), 16(3), 31(7) and 118(5) to (7) of the Care Standards Act 20001, and of all other powers enabling him in that behalf, hereby makes the following Regulations:—
Citation, commencement and application1

These Regulations may be cited as the National Care Standards Commission (Fees and Frequency of Inspections) Amendment (No. 2) Regulations 2002 and shall come into force on 1st September 2002.

These Regulations apply to England only.
Amendment of the National Care Standards Commission (Fees and Frequency of Inspections) Regulations 20012

The National Care Standards Commission (Fees and Frequency of Inspections) Regulations 20012 shall be amended in accordance with the following provisions of this regulation.

In regulation 2(1) (interpretation), in the definition of “new provider”, in paragraph (a) for “1st September 2002” substitute “1st January 2003”.

In regulation 3(3)(a) (registration fees), for “1st September 2002” substitute “1st January 2003”.

In regulation 5 (annual fees), in the Table, in column (5) of the entry for “Nurses agency”, for “1st September 2002” substitute “1st January 2003”.

In regulation 6 (frequency of inspections), for paragraph (5) substitute—

In this regulation “12 month period” means a period commencing on 1st April in any year and ending on 31st March in the following year except that, for the purposes of paragraph (1)(g) and (h), the first 12 month period shall be treated as commencing on 1st January 2003 and ending on 31st March 2004.
