In exercise of the powers conferred upon the Secretary of State by section 48(1) of the School Standards and Framework Act 1998(1), the Secretary of State for Education and Skills hereby makes the following Regulations:
1.—(1) These Regulations may be cited as the Financing of Maintained Schools (England) (Amendment) Regulations 2002 and shall come into force on 2nd September 2002.
(2) These Regulations shall apply only in relation to England.
2.—(1) The Financing of Maintained Schools (England) Regulations 2002(2) shall be amended as follows.
(2) The following shall be added to Schedule 4:—
“28. Expenditure incurred by a governing body in the exercise of the power conferred by section 27 of the Education Act 2002.”

These Regulations amend the Financing of Maintained Schools (England) Regulations 2002, by adding a provision to Schedule 4 to enable local education authority schemes for financing schools to include provisions in relation to the expenditure by governing bodies on community facilities under section 27 of the Education Act 2002.
1998 c. 31. By virtue of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) the powers conferred by these provisions are exercisable by the Secretary of State only in relation to England. For the meaning of “prescribed” and “regulations” see section 142(1). Section 48(1) is amended by paragraph 2(2) of Schedule 3 to the Education Act 2002 (c. 53).
