The Secretary of State, in exercise of the powers conferred upon her by section 153(4) of the Environmental Protection Act 1990(1), hereby makes the following Order:

Citation and commencementU.K.

1.  This Order may be cited as the Financial Assistance for Environmental Purposes (No. 2) Order 2002 and shall come into force on 27th August 2002.

Variation of section 153(1) of the Environmental Protection Act 1990U.K.

2.  In section 153(1) of the Environmental Protection Act 1990(2) (purposes for which financial assistance may be given), after paragraph (pp) there shall be inserted—

(qq)the fund known as the Aggregates Levy Sustainability Fund;.

Explanatory Note

(This note is not part of the Order)

This Order varies section 153(1) of the Environmental Protection Act 1990 so as to confer power to give financial assistance to, or for the purposes of, the Aggregates Levy Sustainability Fund.

1990 c. 43. The relevant functions of the Secretary of State in so far as they relate to Scotland were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). In relation to Wales the Secretary of State has concurrent powers with the National Assembly for Wales (see article 2 of, and the entry relating to the Environmental Protection Act 1990 in Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672)).
