Coming into force

The Lord Chancellor, in exercise of the powers conferred upon him by section 144(1) of the Magistrates' Courts Act 19801 as extended by section 18(1) of the Maintenance Orders (Reciprocal Enforcement) Act 19722, and after consultation with the Rule Committee, appointed under the said section 144(1), makes the following Rules:

These Rules may be cited as the Magistrates' Courts (Reciprocal Enforcement of Maintenance Orders) (Amendment) Rules 2002 and shall come into force on 20th August 2002.

Schedule 1 to the Magistrates' Courts (Reciprocal Enforcement of Maintenance Orders) Rules 19743 shall be amended by inserting after the word “Zimbabwe” the word “Nunavut”.

These Rules amend the Magistrates' Courts (Reciprocal Enforcement of Maintenance Orders) Rules 1974. Rule 2 adds to Schedule 1 (reciprocating countries to which documents are transmitted via the Secretary of State) the territory of Nunavut. Nunavut was designated as a reciprocating country for the purposes of Part I of the Maintenance Orders (Reciprocal Enforcement) Act 1972 by the Reciprocal Enforcement of Maintainence Orders (Designation of Reciprocating Countries) Order 2001 (S.I.2001/3501).
