Citation and Commencement1.
These Regulations may be cited as the Education (Grants in respect of Voluntary Aided Schools) (Amendment) (England) Regulations 2002 and shall come into force on 1st August 2002.

In regulation 2(1)—
(a)
in the definition of “eligible expenditure” for “qualifying expenditure” there shall be substituted “capital expenditure”;
(b)
““relevant percentage” is a percentage determined by the Secretary of State being not less than 85%”.

In regulation 3(1)—
(a)
for “qualifying expenditure” there shall be substituted “capital expenditure”; and
(b)
for “85%” there shall be substituted “the relevant percentage”.
(4)
In regulation 3(2) for “qualifying expenditure” there shall be substituted “capital expenditure”.
The Regulations amend the Education (Grants in respect of Voluntary Aided Schools) Regulations 1999 in respect of England, which are as a consequence of amendments to the School Standards and Framework Act 1998 made by the Regulatory Reform (Voluntary Aided Schools Liabilities and Funding) (England) Order 2002.
