13(7).</p></authorialNote> and of all other powers enabling him in that behalf, considering it appropriate in the interests of the health service to dissolve the Wakefield and Pontefract Community National Health Service Trust<authorialNote class="footnote" eId="f00003" marker="3"><p><i>See</i> paragraph 29(2) of Schedule 2 to the <abbr title="National Health Service and Community Care Act 1990 c. 19">1990 Act</abbr>.</p></authorialNote>, and having completed the consultation prescribed under section 5(2) of and paragraph 29(3) of Schedule 2 to that Act<authorialNote class="footnote" eId="f00004" marker="4"><p><i>See</i> <ref eId="c00008" href="http://www.legislation.gov.uk/id/uksi/1996/653">S.I. 1996/653</ref>.</p></authorialNote>, makes the following Order:</p></formula></preamble><body><article eId="article-1"><heading>Citation, commencement and interpretation</heading><num>1.</num><paragraph eId="article-1-1"><num>(1)</num><content><p>This Order may be cited as the South West Yorkshire Mental Health National Health Service Trust (Establishment) and the Wakefield and Pontefract Community National Health Service Trust (Dissolution) Order 2002 and shall come into force on 1st April 2002.</p></content></paragraph><paragraph eId="article-1-2"><num>(2)</num><intro><p>In this Order, unless the context otherwise requires—</p></intro><hcontainer name="definition"><content><p>“<abbr title="National Health Service and Community Care Act 1990 c. 19">the Act</abbr>” means the National Health Service and Community Care Act 1990;</p></content></hcontainer><hcontainer name="definition"><content><p>“community health services” means any services which the Secretary of State may provide under section 3(1)(d) or (e) of, or Schedule 1 to, the National Health Service Act 1977 and any service which he has a duty to provide under section 5(1) or (1A) of that Act<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00009" href="http://www.legislation.gov.uk/id/ukpga/1977/49">1977 c. 49</ref>; section 5(1) was amended by, and section 5(1A) was inserted by the Health and Medicines Act <ref eId="c00010" href="http://www.legislation.gov.uk/id/ukpga/1988/49">1988 (c. 49)</ref>, section 10(1); Schedule 1 was amended by the Education Reform Act <ref eId="c00011" href="http://www.legislation.gov.uk/id/ukpga/1988/40">1988 (c. 40)</ref>, paragraph 21 of Schedule 12, the Health and Medicines Act 1988, Schedule 2, paragraph 7 and the Education Act <ref eId="c00012" href="http://www.legislation.gov.uk/id/ukpga/1996/56">1996 (c. 56)</ref>, Schedule 37, paragraph 46.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“operational date” has the meaning assigned to it in paragraph 3(1)(e) of Schedule 2 to <abbr title="National Health Service and Community Care Act 1990 c. 19">the Act</abbr>;</p></content></hcontainer><hcontainer name="definition"><content><p>“the trust” means the South West Yorkshire Mental Health National Health Service Trust established by article 2 of this Order.</p></content></hcontainer></paragraph></article><article eId="article-2"><heading>Establishment and name of trust</heading><num>2.</num><content><p>There is established an <abbr class="acronym" title="National Health Service">NHS</abbr> trust which shall be called the South West Yorkshire Mental Health National Health Service Trust.</p></content></article><article eId="article-3"><heading>Nature and functions of the trust</heading><num>3.</num><paragraph eId="article-3-1"><num>(1)</num><content><p>The trust is established for the purposes specified in section 5(1) of <abbr title="National Health Service and Community Care Act 1990 c. 19">the Act</abbr>.</p></content></paragraph><paragraph eId="article-3-2"><num>(2)</num><content><p>The trust’s functions shall be to provide goods and services, namely hospital accommodation and services, and community health services, for the purposes of the health service at or from Fieldhead Hospital, Ouchthorpe Lane, Wakefield, WF1 3SP and at or from any associated hospitals, establishments and facilities.</p></content></paragraph></article><article eId="article-4"><heading>Directors of trust</heading><num>4.</num><content><p>The trust shall have in addition to the chairman 5 non-executive directors and 5 executive directors.</p></content></article><article eId="article-5"><heading>Operational date and accounting date of the trust</heading><num>5.</num><paragraph eId="article-5-1"><num>(1)</num><content><p>The operational date shall be 1st April 2002.</p></content></paragraph><paragraph eId="article-5-2"><num>(2)</num><content><p>The accounting date of the trust shall be 31st March.</p></content></paragraph></article><article eId="article-6"><heading>Dissolution of <abbr class="acronym" title="National Health Service">NHS</abbr> trust</heading><num>6.</num><content><p>The Wakefield and Pontefract Community National Health Service Trust established by the Wakefield and Pontefract Community National Health Service Trust (Establishment) Order 1992<authorialNote class="footnote" eId="f00006" marker="6"><p><ref eId="c00013" href="http://www.legislation.gov.uk/id/uksi/1992/2495">S.I. 1992/2495</ref>.</p></authorialNote> is hereby dissolved, and accordingly that Order is revoked.</p></content></article><hcontainer the Wakefield and Pontefract Community National Health Service Trust which is dissolved by this Order.</p></blockContainer><blockContainer ukl:Name="P"><p>The Order provides for the functions of the trust (article 3) and the number of executive and non-executive directors (article 4).
