The Queen’s Most Excellent Majesty in Council
Her Majesty, in exercise of the powers conferred upon Her by sections 60(3)(d) and (h) and 102 of and Schedule 13 to the Civil Aviation Act 1982(1), as extended to the Bailiwick of Jersey by the Civil Aviation Act 1982 (Jersey) Order 1990(2), is pleased by and with the advice of Her Privy Council to order, and it is hereby ordered as follows:—
1. This Order may be cited as the Air Navigation (Jersey) (Amendment No. 2) Order 2002 and shall come into force on 24th April 2002.
2. The Schedule to the Air Navigation (Jersey) Order 2000(3) (which modifies provisions of the Air Navigation (No. 2) Order 1995(4) as they extend to Jersey) shall be amended by inserting the following new paragraph after paragraph 57:—
“57A. In Schedule 9 (Air Traffic Controllers-Ratings), for paragraph 2(3) substitute—
“(3) An Approach Radar Control Rating shall, subject to article 81(4) of this Order, entitle the holder of the licence to act as an air traffic controller in the course of the provision of an approach control service, with the aid of any type of surveillance radar equipment either within the Channel Islands Control Zone or outside that Zone, in accordance with the provisions of any agreement in that respect made between the United Kingdom Civil Aviation Authority or the Direction Générale d'Aviation Civile of the Republic of France and the Committee.””.

This Order amends the Air Navigation (Jersey) Order 2000 that extended the Air Navigation (No. 2) Order 1995 to Jersey. A further modification is added to those contained in the Schedule to the 2000 Order to alter the Approach Radar Control Rating. The effect is that approach control services may be provided, with the aid of surveillance radar equipment, in an area within or outside the Channel Islands Control Zone in accordance with any agreement made by the relevant authorities in the United Kingdom or France, and Jersey.
