<Text>These Rules may be cited as the Family Proceedings Courts (Children Act 1989) (Amendment) Rules 2001 and shall come into force on 1st April 2001.</Text>

<Text>The Family Proceedings Courts (Children Act 1989) Rules 1991<FootnoteRef Ref="f00002"/> (“the <Abbreviation Expansion="Family Proceedings Courts (Children Act 1989) Rules 1991 (S.I. 1991/1395 (L. 17))">1991 Rules</Abbreviation>”) shall be amended in accordance with the following provisions of these Rules and, in those provisions, any reference to a rule or Schedule by number alone shall be construed as a reference to the rule or Schedule so numbered in the 1991 Rules.</Text>

<Text>A children’s guardian appointed by the justices' chief executive or by the court under this rule shall not—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>be a member, officer or servant of a local authority which, or an authorised person (within the meaning of section 31(9)) who, is a party to the proceedings;</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>be, or have been, a member, officer or servant of a local authority or voluntary organisation (within the meaning of section 105(1)) who has been directly concerned in that capacity in arrangements relating to the care, accommodation or welfare of the child during the five years prior to the commencement of the proceedings; or</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>be a serving probation officer who has, in that capacity, been previously concerned with the child or his family.</Text>
</P3para>
</P3>

<Title>Powers and duties of officers of the service</Title>
<P1>

<Text>In carrying out his duty under section 7(1)(a) or section 41(2), the officer of the service shall have regard to the principle set out in section 1(2) and the matters set out in section 1(3)(a) to (f) as if for the word “court” in that section there were substituted the words “officer of the service”.</Text>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>The officer of the service shall make such investigations as may be necessary for him to carry out his duties and shall, in particular—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>contact or seek to interview such persons as he thinks appropriate or as the court directs;</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>obtain such professional assistance as is available to him which he thinks appropriate or which the justices' clerk or the court directs him to obtain.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>3</Pnumber>
<P2para>
<Text>In addition to his duties, under other paragraphs of this rule, or rules 11A or 11B, the officer of the service shall provide to the justices' chief executive, the justices' clerk and the court such other assistance as he or it may require.</Text>
</P2para>
</P2>
<P2>
<Pnumber>4</Pnumber>
<P2para>
<Text>A party may question the officer of the service about oral or written advice tendered by him to the justices' chief executive, the justices' clerk or the court.</Text>
</P2para>
</P2>

<Text>After rule 11, insert new rules as follows—</Text>

<Title>Additional powers and duties of children’s guardian</Title>
<P1>
<Pnumber>11A</Pnumber>
<P1para>
<P2>
<Pnumber>1</Pnumber>
<P2para>
<Text>The children’s guardian shall—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>appoint a solicitor to represent the child unless such a solicitor has already been appointed; and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>give such advice to the child as is appropriate having regard to his understanding and, subject to rule 12(1)(a), instruct the solicitor representing the child on all matters relevant to the interests of the child including possibilities for appeal, arising in the course of proceedings.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>Where it appears to the children’s guardian that the child—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>is instructing his solicitor direct; or</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>intends to conduct and is capable of conducting the proceedings on his own behalf,</Text>
</P3para>
</P3>
<Text>he shall inform the court through the justices' chief executive and from then he—</Text>
<P4>
<Pnumber>i</Pnumber>
<P4para>
<Text>shall perform all of his duties set out in rule 11 and this rule, other than those duties under paragraph (1)(a) of this rule, and such other duties as the justices' clerk or the court may direct;</Text>
</P4para>
</P4>
<P4>
<Pnumber>ii</Pnumber>
<P4para>
<Text>shall take such part in the proceedings as the justices' clerk or the court may direct; and</Text>
</P4para>
</P4>
<P4>
<Pnumber>iii</Pnumber>
<P4para>
<Text>may, with the leave of the justices' clerk or the court, have legal representation in the conduct of those duties.</Text>
</P4para>
</P4>
</P2para>
</P2>
<P2>
<Pnumber>3</Pnumber>
<P2para>
<Text>Unless excused by the justices' clerk or the court, the children’s guardian shall attend all directions appointments in and hearings of the proceedings and shall advise the court on the following matters—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>whether the child is of sufficient understanding for any purpose including the child’s refusal to submit to a medical or psychiatric examination or other assessment that the court has the power to require, direct or order;</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>the wishes of the child in respect of any matter relevant to the proceedings including his attendance at court;</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>the appropriate forum for the proceedings;</Text>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para>
<Text>the appropriate timing of the proceedings or any part of them;</Text>
</P3para>
</P3>
<P3>
<Pnumber>e</Pnumber>
<P3para>
<Text>the options available to it in respect of the child and the suitability of each such option including what order should be made in determining the application; and</Text>
</P3para>
</P3>
<P3>
<Pnumber>f</Pnumber>
<P3para>
<Text>any other matter concerning which the justices' chief executive, the justices' clerk or the court seeks his advice or concerning which he considers that the justices' chief executive, the justices' clerk or the court should be informed.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>4</Pnumber>
<P2para>
<Text>The advice given under paragraph (3) may, subject to any order of the court, be given orally or in writing; and if the advice be given orally, a note of it shall be taken by the justices' clerk or the court.</Text>
</P2para>
</P2>
<P2>
<Pnumber>5</Pnumber>
<P2para>
<Text>The children’s guardian shall, where practicable, notify any person whose joinder as a party to those proceedings would be likely, in the opinion of the officer of the service, to safeguard the interests of the child of that person’s right to apply to be joined under rule 7(2) and shall inform the justices' chief executive or the court—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>of any such notification given;</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>of anyone whom he attempted to notify under this paragraph but was unable to contact; and</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>of anyone whom he believes may wish to be joined to the proceedings.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>6</Pnumber>
<P2para>
<Text>The children’s guardian shall, unless the justices' clerk or the court otherwise directs, not less than 14 days before the date fixed for the final hearing of the proceedings—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>file a written report advising on the interests of the child;</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>serve a copy of the filed report on the other parties.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>7</Pnumber>
<P2para>
<Text>The children’s guardian shall serve and accept service of documents on behalf of the child in accordance with rule 8(3)(b) and (4)(b) and, where the child has not himself been served, and has sufficient understanding, advise the child of the contents of any document so served.</Text>
</P2para>
</P2>
<P2>
<Pnumber>8</Pnumber>
<P2para>
<Text>If the children’s guardian inspects records of the kinds referred to in section 42<FootnoteRef Ref="f00006"/>, he shall bring to the attention of—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>the court, through the justices' chief executive; and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>unless the court or the justices' clerk otherwise directs, the other parties to the proceedings,</Text>
</P3para>
</P3>
<Text>all records and documents which may, in his opinion, assist in the proper determination of the proceedings.</Text>
</P2para>
</P2>
<P2>
<Pnumber>9</Pnumber>
<P2para>
<Text>The children’s guardian shall ensure that, in relation to a decision made by the justices' clerk or the court in the proceedings—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>if he considers it appropriate to the age and understanding of the child, the child is notified of that decision; and</Text>

<Text>These Rules amend the Family Proceedings Courts (Children Act 1989) Rules 1991 following the establishment of the Children and Family Court Advisory and Support Service (‘<Abbreviation Expansion="Children and Family Court Advisory and Support Service">CAFCASS</Abbreviation>’) by the Criminal Justice and Court Services Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/2000/43" id="c00001" Class="UnitedKingdomPublicGeneralAct" Year="2000" Number="0043">2000 (c. 43)</Citation>. The term ‘guardian ad litem’ is replaced in proceedings under Children Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/1989/41" id="c00002" Class="UnitedKingdomPublicGeneralAct" Year="1989" Number="0041">1989 (c. 41)</Citation> by ‘children’s guardian’, and in proceedings for a parental order under section 30 of the Human Fertilisation and Embryology Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/1990/37" id="c00003" Class="UnitedKingdomPublicGeneralAct" Year="1990" Number="0037">1990 (c. 37)</Citation> by ‘parental order reporter’. A person appointed by a local authority under section 7(1)(b) of that Act will continue to be known as a welfare officer.</Text>

<Text>The Rules permit more than one children’s guardian to be appointed if the court considers it appropriate. They set out clearly the powers and duties of officers of the service. The provisions relating to disclosure of documents have been amended to facilitate inspection of CAFCASS and also to allow disclosure where this would assist an officer of the service to perform any of his functions. They also permit disclosure within CAFCASS save where a conflict of interest arises and disclosure without the leave of the court to an expert whose instruction by a party has been authorised by the court.</Text>
