(Foot-and-Mouth Disease) Regulations 2001; they extend to England and Northern Ireland and come into force on 2nd March 2001 at 6.00 p.m.</Text></P2para></P2><P2 id="regulation-1-2"><Pnumber>2</Pnumber><P2para><Text>These Regulations shall apply until midnight on 9th March 2001.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2001-03-02"><Title> Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/2" id="regulation-2"><Pnumber>2</Pnumber><P1para><Text>In these Regulations, unless the context otherwise requires—</Text><UnorderedList Decoration="none"><ListItem><Para><Text>“the Decision" means Commission Decision <Citation URI="http://www.legislation.gov.uk/european/decision/2001/0172" id="c00001" Class="EuropeanUnionDecision" Year="2001" Number="172">2001/172/EC</Citation> of 1st March 2001 concerning certain protection measures with regard to foot-and-mouth disease in the United Kingdom and repealing Decision <Citation URI="http://www.legislation.gov.uk/european/decision/2001/0145" id="c00002" Class="EuropeanUnionDecision" Year="2001" Number="145">2001/145/EC</Citation> <CommentaryRef Ref="c15872471"/>;</Text></Para></ListItem><ListItem><Para><Text>“export" means export outside the British Islands;</Text></Para></ListItem><ListItem><Para><Text>“inspector" means a person appointed to be an inspector for the purposes of these Regulations by the Minister (in England), or the Department of Agriculture and Rural Development (in Northern Ireland) or a local authority, and includes a veterinary inspector;</Text></Para></ListItem><ListItem><Para><Text>“local authority" means—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>in any part of England where there is, within the meaning of the Local Government Changes for England Regulations 1994 <CommentaryRef Ref="c15872481"/>, a unitary authority for that local government area, that authority;</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>in any part of England where there is not a unitary authority—</Text></Para><OrderedList Type="roman" Decoration="parens"><ListItem NumberOverride="i"><Para><Text>in a metropolitan district, the council of that district;</Text></Para></ListItem><ListItem NumberOverride="ii"><Para><Text>in a non-metropolitan county, the council of that county;</Text></Para></ListItem><ListItem NumberOverride="iii"><Para><Text>in each London borough (except in relation to imported animals) the council of that borough; or</Text></Para></ListItem><ListItem NumberOverride="iv"><Para><Text>in the City of London, and for all London boroughs in relation to imported animals, the Common Council;</Text></Para></ListItem></OrderedList></ListItem></OrderedList></ListItem><ListItem><Para><Text>“meat products" means meat products as defined in Article 2 of Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1977/0099" id="c00003" Class="EuropeanEconomicCommunityDirective" Year="1977" Number="99">77/99/EEC</Citation> on health problems affecting the production and marketing of meat products and certain other products of animal origin <CommentaryRef Ref="c15872491"/>;</Text></Para></ListItem><ListItem><Para><Text>“Minister" means the Minister of Agriculture, Fisheries and Food;</Text></Para></ListItem><ListItem><Para><Text>“milk" and “milk products" have the meaning given in Article 2 of Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1992/0046" id="c00004" Class="EuropeanUnionDirective" Year="1992" Number="46">92/46/EC</Citation> (laying down the health rules for the production and placing on the market of raw milk, heat-treated milk and milk-based products <CommentaryRef Ref="c15872501"/>);</Text></Para></ListItem><ListItem><Para><Text>“veterinary inspector" means a person appointed as a veterinary inspector by the Minister (in England), or the Department of Agriculture and Rural Development (in Northern Ireland).</Text></Para></ListItem></UnorderedList></P1para></P1></P1group><P1group RestrictStartDate="2001-03-02"><Title> Import and export of live animals</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/3" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/3" id="regulation-3"><Pnumber>3</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/3/1" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/3/1" id="regulation-3-1"><Pnumber>1</Pnumber><P2para><Text>No person shall export any live animal of the bovine, ovine, caprine or porcine species or any other biungulate.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/3/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/3/2" id="regulation-3-2"><Pnumber>2</Pnumber><P2para><Text>By way of derogation from the preceding paragraph, the Minister (in England) or the Department of Agriculture and Rural Development (in Northern Ireland) may by licence in writing authorise the export of biungulate animals originating outside the United Kingdom if the animals travelled through the United Kingdom in direct and uninterrupted transit on main roads or by rail or sea.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/3/3" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/3/3" id="regulation-3-3"><Pnumber>3</Pnumber><P2para><Text>No person shall import any live animal of species susceptible to foot-and-mouth disease into England Northern Ireland from another member State.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2001-03-02"><Title> Export of fresh meat</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/4" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/4" id="regulation-4"><Pnumber>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/4/1" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/4/1" id="regulation-4-1"><Pnumber>1</Pnumber><P2para><Text>No person shall export any fresh meat of animals of the bovine, ovine, caprine or porcine species or other biungulate.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/4/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/4/2" id="regulation-4-2"><Pnumber>2</Pnumber><P2para><Text>The prohibition in paragraph (1) shall not apply in relation to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/4/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/4/2/a" id="regulation-4-2-a"><Pnumber>a</Pnumber><P3para><Text>fresh meat obtained before 1st February 2001 provided that the meat is clearly identified and since that date has been transported and stored separately from meat which is not destined for dispatch outside the United Kingdom; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/4/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/4/2/b" id="regulation-4-2-b"><Pnumber>b</Pnumber><P3para><Text>fresh meat obtained from cutting plants situated in the United Kingdom under the following conditions—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/4/2/b/i" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/4/2/b/i" id="regulation-4-2-b-i"><Pnumber>i</Pnumber><P4para><Text>the only meat processed in the establishment is fresh meat described in sub-paragraph (a) or fresh meat from animals reared outside the United Kingdom, transported directly and under official control in sealed means of transport to a slaughterhouse for immediate slaughter;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/4/2/b/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/4/2/b/ii" id="regulation-4-2-b-ii"><Pnumber>ii</Pnumber><P4para><Text>all the meat must bear the health mark in accordance with Chapter XI of Annex I to Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1964/0433" id="c00005" Class="EuropeanEconomicCommunityDirective" Year="1964" Number="433">64/433/EEC</Citation> (on animal health problems affecting intra-Community trade in fresh meat <CommentaryRef Ref="c15872511"/>);</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/4/2/b/iii" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/4/2/b/iii" id="regulation-4-2-b-iii"><Pnumber>iii</Pnumber><P4para><Text>the plant is operated under strict veterinary control; and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/4/2/b/iv" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/4/2/b/iv" id="regulation-4-2-b-iv"><Pnumber>iv</Pnumber><P4para><Text>the meat is clearly identified and transported and stored separately from meat which is not destined for export.</Text></P4para></P4></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/4/3" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/4/3" id="regulation-4-3"><Pnumber>3</Pnumber><P2para><Text>Meat consigned to another member State shall be accompanied by a certificate issued by a veterinary inspector which bears the following words—</Text><BlockAmendment TargetClass="unknown" TargetSubClass="unknown" Context="unknown" Format="default"><P2para><Text>Meat conforming to Commission Decision <Citation URI="http://www.legislation.gov.uk/european/decision/2001/0172" id="c00006" Class="EuropeanUnionDecision" Year="2001" Number="172">2001/172/EC</Citation> of 1st March 2001 concerning certain protection measures with regard to foot-and-mouth disease in the United Kingdom</Text></P2para></BlockAmendment><AppendText>.</AppendText></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2001-03-02"><Title> Export of meat products</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/5" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/5" id="regulation-5"><Pnumber>5</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/5/1" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/5/1" id="regulation-5-1"><Pnumber>1</Pnumber><P2para><Text>No person shall export meat products of animals of the bovine, ovine, caprine or porcine species or any other biungulate coming from the United Kingdom.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/5/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/5/2" id="regulation-5-2"><Pnumber>2</Pnumber><P2para><Text>The prohibition in paragraph (1) shall not apply to meat products which have undergone one of the treatments laid down in Article 4(1) of Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1980/0215" id="c00007" Class="EuropeanEconomicCommunityDirective" Year="1980" Number="215">80/215/EEC</Citation> (on animal health problems affecting intra-Community trade in meat products <CommentaryRef Ref="c15872521"/>), or to meat products as defined in Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1977/0099" id="c00008" Class="EuropeanEconomicCommunityDirective" Year="1977" Number="99">77/99/EEC</Citation> which have been subjected during preparation uniformly throughout the substance to a pH value of less than 6.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/5/3" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/5/3" id="regulation-5-3"><Pnumber>3</Pnumber><P2para><Text>The prohibition in paragraph (1) shall not apply to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/5/3/a" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/5/3/a" id="regulation-5-3-a"><Pnumber>a</Pnumber><P3para><Text>meat products prepared from meat derived from biungulate animals slaughtered before 1st February 2001 provided that the meat products are clearly identified and since that date have been transported and stored separately from meat products which are not destined for export; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/5/3/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/5/3/b" id="regulation-5-3-b"><Pnumber>b</Pnumber><P3para><Text>meat products prepared in establishments under the following conditions—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/5/3/b/i" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/5/3/b/i" id="regulation-5-3-b-i"><Pnumber>i</Pnumber><P4para><Text>all fresh meat used in the establishment must be from animals reared outside the United Kingdom, transported directly and under official control in sealed means of transport to a slaughterhouse for immediate slaughter;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/5/3/b/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/5/3/b/ii" id="regulation-5-3-b-ii"><Pnumber>ii</Pnumber><P4para><Text>all meat products used in the final product must conform to the public health requirements governing trade in and imports into the Community of products not subject to the said requirements laid down in specific Community rules referred to in Annex A(I) to Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1989/0662" id="c00012" Class="EuropeanEconomicCommunityDirective" Year="1989" Number="662">1989/662/EEC</Citation> and, as regards pathogens, to Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1990/0425" id="c00013" Class="EuropeanEconomicCommunityDirective" Year="1990" Number="425">1990/425/EEC</Citation> <CommentaryRef Ref="c15872531"/>) followed by a second heat treatment by high temperature pasteurisation, UHT, sterilisation or by a drying process which includes id="regulation-6-3-d"><Pnumber>d</Pnumber><P3para><Text>transport of raw milk from outside the United Kingdom to the establishment must be carried out in vehicle which were cleansed and disinfected prior to operation and had no subsequent contact with holdings in the United Kingdom keeping animals of species susceptible to foot-and-mouth disease.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/6/4" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/6/4" id="regulation-6-4"><Pnumber>4</Pnumber><P2para><Text>Milk consigned to another member State shall be accompanied by a certificate issued by a veterinary inspector which bears the following DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/7/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/7/2/b" id="regulation-7-2-b"><Pnumber>b</Pnumber><P3para><Text>milk products prepared from milk which complies with paragraphs (2) or (3) of regulation 6; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/7/2/c" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/7/2/c" id="regulation-7-2-c"><Pnumber>c</Pnumber><P3para><Text>milk products subjected to heat treatment at a temperature of at least 71.7°C for 15 seconds or an equivalent treatment, on the understanding that such treatment was not necessary for finished products the ingredients of which comply with the respective animal health conditions laid down in these regulations.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/7/3" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/7/3" id="regulation-7-3"><Pnumber>3</Pnumber><P2para><Text>The prohibition described in paragraph (1) shall not apply to milk products prepared in establishments under the following conditions—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/7/3/a" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/7/3/a" id="regulation-7-3-a"><Pnumber>a</Pnumber><P3para><Text>all milk used in the establishment will either conform to the conditions of regulation 6(2) of be obtained from animals outside the United Kingdom;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/7/3/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/7/3/b" id="regulation-7-3-b"><Pnumber>b</Pnumber><P3para><Text>all milk products used in the final product will either conform to the conditions of paragraph (2) or be made from milk obtained from animals id="regulation-10"><Pnumber>10</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/1" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/1" id="regulation-10-1"><Pnumber>1</Pnumber><P2para><Text>No person shall send animal products of the bovine, ovine, caprine and porcine species and other biungulates not otherwise mentioned in these Regulations produced after 1st February 2001.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/2" id="regulation-10-2"><Pnumber>2</Pnumber><P2para><Text>The prohibition in paragraph (1) shall not apply in relation to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/2/a" id="regulation-10-2-a"><Pnumber>a</Pnumber><P3para><Text>animal products which have been subjected to—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/2/a/i" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/2/a/i" id="regulation-10-2-a-i"><Pnumber>i</Pnumber><P4para><Text>heat treatment in a hermetically sealed container with a Fo value of 3,00 or more; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/2/a/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/2/a/ii" id="regulation-10-2-a-ii"><Pnumber>ii</Pnumber><P4para><Text>heat treatment in which the centre temperature is raised to at least 70°C;</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/2/b" id="regulation-10-2-b"><Pnumber>b</Pnumber><P3para><Text>blood and blood products as defined in Chapter 7 of Annex I to Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1992/0118" id="c00029" Class="EuropeanEconomicCommunityDirective" Year="1992" Number="118">92/118/EEC</Citation> which have been subjected to—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/2/b/i" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/2/b/i" id="regulation-10-2-b-i"><Pnumber>i</Pnumber><P4para><Text>heat treatment at a temperature of 65°C for at least three hours followed by an effectiveness check;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/2/b/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/2/b/ii" id="regulation-10-2-b-ii"><Pnumber>ii</Pnumber><P4para><Text>irradication at 2.5 megarads or gamma rays followed by an effectiveness check; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/2/b/iii" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/2/b/iii" id="regulation-10-2-b-iii"><Pnumber>iii</Pnumber><P4para><Text>change of pH to pH5 or lower for at least two hours, followed by an effectiveness check;</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/2/c" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/2/c" id="regulation-10-2-c"><Pnumber>c</Pnumber><P3para><Text>lard and rendered fats which have been subjected to the heat treatment prescribed in paragraph 2(A) of chapter 9 of Annex I to Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1992/0118" id="c00030" Class="EuropeanEconomicCommunityDirective" Year="1992" Number="118">92/118/EEC</Citation>;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/2/d" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/2/d" id="regulation-10-2-d"><Pnumber>d</Pnumber><P3para><Text>animal casings to which the provisions of paragraph B Chapter 2 of Annex I to Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1992/0118" id="c00031" Class="EuropeanEconomicCommunityDirective" Year="1992" Number="118">92/118/EEC</Citation> apply adapted as necessary to suit the case;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/2/e" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/2/e" id="regulation-10-2-e"><Pnumber>e</Pnumber><P3para><Text>unprocessed sheep wool and ruminant hair which is securely enclosed in packaging and dry;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/2/f" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/2/f" id="regulation-10-2-f"><Pnumber>f</Pnumber><P3para><Text>semi-moist and dried petfood conforming to the requirements of paragraph 2 and 3 respectively of Chapter 4 of Annex I to Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1992/0118" id="c00032" Class="EuropeanEconomicCommunityDirective" Year="1992" Number="118">92/118/EEC</Citation>; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/2/g" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/2/g" id="regulation-10-2-g"><Pnumber>g</Pnumber><P3para><Text>composite products which are not subjected to further treatment containing products of animal origin on the understanding that the treatment was not necessary for finished products the ingredients of which comply with the respective animal health conditions laid down in these Regulations.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/10/3" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/10/3" id="regulation-10-3"><Pnumber>3</Pnumber><P2para><Text>The animal products must be accompanied by a certificate stating—</Text><BlockAmendment TargetClass="unknown" TargetSubClass="unknown" Context="unknown" Format="default"><P2para><Text>Animal products conforming to Commission Decision <Citation URI="http://www.legislation.gov.uk/european/decision/2001/0172" id="c00033" Class="EuropeanUnionDecision" Year="2001" Number="172">2001/172/EC</Citation> of 1st March 2001 concerning certain protection measures with regard to foot-and-mouth disease in the United Kingdom</Text></P2para></BlockAmendment><AppendText>.</AppendText></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2001-03-02"><Title> Endorsement of commercial documents</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/11" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/11" id="regulation-11"><Pnumber>11</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/11/1" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/11/1" id="regulation-11-1"><Pnumber>1</Pnumber><P2para><Text>Where reference is made to a commercial document being endorsed in accordance with this regulation, the document must have attached to it an official certificate prepared by the Minister (or in Northern Ireland the Department of Agriculture and Rural Development) stating that the production process has been audited and found to be in accordance with these Regulations and suitable to destroy the foot-and-mouth disease virus and that provisions are in place to avoid possible re-contamination with the foot-and-mouth disease virus after treatment.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/11/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/11/2" id="regulation-11-2"><Pnumber>2</Pnumber><P2para><Text>The certificate shall bear a reference to the Decision, shall be valid for 30 days, shall state the expiry date and shall be renewable after inspection of the establishment.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2001-03-02"><Title> Powers of inspectors</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/12" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/12" id="regulation-12"><Pnumber>12</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/12/1" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/12/1" id="regulation-12-1"><Pnumber>1</Pnumber><P2para><Text>An inspector shall, on producing, if required to do so, some duly authenticated document showing his authority, have the right at all reasonable hours to enter any land or premises for the purposes of ascertaining whether there is or has been on the premises any contravention of these Regulations; and in this regulation “premises" includes any place, installation, vehicle, ship, vessel, boat, craft, hovercraft or aircraft.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/12/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/12/2" id="regulation-12-2"><Pnumber>2</Pnumber><P2para><Text>An inspector shall have powers to carry out all checks and examinations necessary for the enforcement of the Decision, and in particular may—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/12/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/12/2/a" id="regulation-12-2-a"><Pnumber>a</Pnumber><P3para><Text>carry out inspections of any processes used for the marking and identification of animals, any premises and any installation;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/12/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/12/2/b" id="regulation-12-2-b"><Pnumber>b</Pnumber><P3para><Text>examine documentary or data processing material relevant to the checks carried out under these Regulations; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/12/2/c" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/12/2/c" id="regulation-12-2-c"><Pnumber>c</Pnumber><P3para><Text>take with him a representative of the European Commission acting for the purposes of the Decision.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2001-03-02"><Title> Illegal consignments</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/13" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/13" id="regulation-13"><Pnumber>13</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/13/1" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/13/1" id="regulation-13-1"><Pnumber>1</Pnumber><P2para><Text>Where an inspector knows or suspects that animals or animals products are intended for export and do not comply with the requirements of these Regulations he may by notice served on the person in charge of those animals or products require that person at his own expense—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/13/1/a" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/13/1/a" id="regulation-13-1-a"><Pnumber>a</Pnumber><P3para><Text>without delay to detain the animals or animal products, and any animals or products which have been in contact with them, at such place as may be specified in the notice, and to take such further action in relation to them as may be specified in the notice; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/13/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/13/1/b" id="regulation-13-1-b"><Pnumber>b</Pnumber><P3para><Text>in the case of animals, without delay to slaughter and destroy them, or cause them to be slaughtered and destroyed, or, in the case of animal products, without delay to destroy them or cause them to be destroyed, in accordance with such conditions as may be specified in the notice.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/13/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/13/2" id="regulation-13-2"><Pnumber>2</Pnumber><P2para><Text>In the case of any notice served under this regulation not being complied with, an inspector may seize or cause to be seized any animals or animal products to which it relates and arrange for the requirements of the notice to be complied with at the expense of the person on whom it was served.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2001-03-02"><Title> Obstruction</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/14" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/14" id="regulation-14"><Pnumber>14</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/14/1" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/14/1" id="regulation-14-1"><Pnumber>1</Pnumber><P2para><Text>No person shall—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/14/1/a" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/14/1/a" id="regulation-14-1-a"><Pnumber>a</Pnumber><P3para><Text>intentionally obstruct any person acting in the execution of these Regulations;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/14/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/14/1/b" id="regulation-14-1-b"><Pnumber>b</Pnumber><P3para><Text>without reasonable cause, fail to give to any person acting in the execution of these Regulations any assistance or information which that person may reasonably require of him for the purposes of his functions under these Regulations, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/14/1/c" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/14/1/c" id="regulation-14-1-c"><Pnumber>c</Pnumber><P3para><Text>furnish to any person acting in the execution of these Regulations any information which he knows to be false or misleading.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/14/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/14/2" id="regulation-14-2"><Pnumber>2</Pnumber><P2para><Text>Nothing in paragraph (1)(b) above shall be construed as requiring any person to answer any question or give any information if to do so might incriminate him.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2001-03-02"><Title> Offences by bodies corporate</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/15" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/15" id="regulation-15"><Pnumber>15</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/15/1" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/15/1" id="regulation-15-1"><Pnumber>1</Pnumber><P2para><Text>Where a body corporate is guilty of an offence under these Regulations, and that offence is proved to have been committed with the consent or connivance or, or to have been attributable to any neglect on the part of—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/15/1/a" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/15/1/a" id="regulation-15-1-a"><Pnumber>a</Pnumber><P3para><Text>any director, manager, secretary or other similar officer of the body corporate, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/15/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/15/1/b" id="regulation-15-1-b"><Pnumber>b</Pnumber><P3para><Text>any person who was purporting to act in any such capacity,</Text></P3para></P3><Text>he as well as the body corporate, shall be guilty of the offence and be liable to be proceeded against and punished accordingly.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/15/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/15/2" id="regulation-15-2"><Pnumber>2</Pnumber><P2para><Text>For purposes of paragraph (1) above, “director" in relation to a body corporate whose affairs are managed by its members, means a member of the body corporate.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2001-03-02"><Title> Penalties</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/16" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/16" id="regulation-16"><Pnumber>16</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/16/1" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/16/1" id="regulation-16-1"><Pnumber>1</Pnumber><P2para><Text>A person contravening any provision of these Regulations shall be guilty of an offence.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/16/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/16/2" id="regulation-16-2"><Pnumber>2</Pnumber><P2para><Text>A person guilty of an offence under regulation 14(1)(a) or (b) above shall be liable on summary conviction to a fine not exceeding level 5 on the standard scale or to imprisonment for a term not exceeding three months or to both.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/16/3" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/16/3" id="regulation-16-3"><Pnumber>3</Pnumber><P2para><Text>A person guilty of any other offence under these Regulations shall be liable—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/16/3/a" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/16/3/a" id="regulation-16-3-a"><Pnumber>a</Pnumber><P3para><Text>on summary conviction, to a fine not exceeding the statutory maximum or to imprisonment not exceeding three months or to both;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/16/3/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/16/3/b" id="regulation-16-3-b"><Pnumber>b</Pnumber><P3para><Text>on conviction on indictment, to a fine or to imprisonment for a term not exceeding two years or to both.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2001-03-02"><Title> Enforcement</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/665/regulation/17" IdURI="http://www.legislation.gov.uk/id/uksi/2001/665/regulation/17" id="regulation-17"><Pnumber>17</Pnumber><P1para><Text>In England these Regulations shall be enforced by the Minister or the local authority.
