The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred on him by sections 76(2) and 146 of the Housing Grants, Construction and Regeneration Act 1996(1) and all other powers enabling him in that behalf, hereby makes the following Order:
1.—(1) This Order may be cited as the Disabled Facilities Grants and Home Repair Assistance (Maximum Amounts) (Amendment) (England) Order 2001 and shall come into force on 2nd April 2001.
(2) This Order extends to England only.
2. The Disabled Facilities Grants and Home Repair Assistance (Maximum Amounts) Order 1996(2) is amended in accordance with the following paragraphs.
3. In Article 4—
(a)delete “Subject to article 5”; and
(b)in paragraphs (a) and (b)(ii), for “£2,000” substitute “£5,000”.
4. Article 5 is revoked.

This Order amends the Disabled Facilities Grants and Home Repair Assistance (Maximum Amounts) Order 1996 (“the Order”) which, among other things, prescribes the maximum amount of home repair assistance which a local housing authority may give under Chapter III of Part I of the Housing Grants, Construction And Regeneration Act 1996.
Article 4 of the Order, which prescribes the maximum amount of home repair assistance for one application, is amended to increase that maximum from £2,000 to £5,000.
Article 5 of the Order, which prescribes a maximum amount of home repair assistance payable in respect of the same dwelling, house-boat or mobile home in any period of three years, is revoked.
1996 c. 53. The Secretary of State’s functions under sections 76(2) and 146, so far as exercisable in relation to Wales, were transferred to the National Assembly for Wales by S.I. 1999/672, Article 2 and Schedule 1.
