purposes of section 2(2) of the European Communities Act 1972 in relation to measures relating to the protection of the euro against counterfeiting, in exercise of the powers conferred by that section id="regulation-1-1"><Pnumber>1</Pnumber><P2para><Text>These Regulations may be cited as the Protection of the Euro against Counterfeiting Regulations 2001 and shall come into force on 1st January IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/1/2/a" id="regulation-1-2-a"><Pnumber>a</Pnumber><P3para><Text>“the Community Regulation” means Council Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2001/1338" id="c00001" Class="EuropeanUnionRegulation" Year="2001" Number="1338">(EC) No. 1338/2001</Citation> of 28th June 2001 laying down measures necessary for the protection of the euro against counterfeiting <CommentaryRef Ref="c15817961"/>; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/1/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/1/2/b" id="regulation-1-2-b"><Pnumber>b</Pnumber><P3para><Text>expressions used in the Community Regulation have the same meaning in these Regulations as they have in the Community Regulation.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2002-01-01"><Title/><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/2" id="regulation-2"><Pnumber>2</Pnumber><P1para><Text>A credit institution, or other institution or establishment within Article 6(1) of the Community Regulation, which fails to withdraw from circulation a euro note or euro coin received by it which it knows or has sufficient reason to believe to be counterfeit shall be guilty of an offence and liable—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/2/a" id="regulation-2-a"><Pnumber>a</Pnumber><P3para><Text>on summary conviction, to a fine not exceeding the statutory maximum or to three months’ imprisonment, or to both; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/2/b" id="regulation-2-b"><Pnumber>b</Pnumber><P3para><Text>on conviction on indictment, to a fine or to imprisonment for a term not exceeding two years, or to both.</Text></P3para></P3></P1para></P1></P1group><P1group RestrictStartDate="2002-01-01"><Title/><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/3" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/3" id="regulation-3"><Pnumber>3</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/3/1" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/3/1" id="regulation-3-1"><Pnumber>1</Pnumber><P2para><Text>A credit institution, or other institution or establishment within Article 6(1) of the Community Regulation, which fails immediately to hand over to the relevant body (or to a person with authority to act on behalf of the relevant body for the purposes of this regulation) a euro note or euro coin received by that institution or establishment which it knows or has sufficient reason to believe to be counterfeit shall be guilty of an offence and liable—</Text><P3 id="regulation-3-1-a"><Pnumber>a</Pnumber><P3para><Text>on summary conviction, to a fine not exceeding the statutory maximum; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/3/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/3/1/b" id="regulation-3-1-b"><Pnumber>b</Pnumber><P3para><Text>on conviction on indictment, to a fine.</Text></P3para></P3></P2para></P2><P2 id="regulation-3-2-b"><Pnumber>b</Pnumber><P3para><Text>in the case of euro coins, the Royal Mint or the National Criminal Intelligence IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/4/1" id="regulation-4-1"><Pnumber>1</Pnumber><P2para><Text>If an offence under these Regulations committed by a body corporate is shown—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/4/1/a" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/4/1/a" id="regulation-4-1-a"><Pnumber>a</Pnumber><P3para><Text>to have been committed with the consent or connivance of any director, manager, secretary or other similar officer of the body corporate, or any person who was purporting to act in any such capacity, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/4/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/4/1/b" id="regulation-4-1-b"><Pnumber>b</Pnumber><P3para><Text>to be attributable to any neglect on his part,</Text></P3para></P3><Text>he as well as the body corporate shall be guilty of the offence and shall be liable to be proceeded against and punished accordingly.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/4/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/4/2" id="regulation-4-2"><Pnumber>2</Pnumber><P2para><Text>If the affairs of a body corporate are managed by its members, paragraph (1) applies in relation to the acts and defaults of a member in connection with his functions of management as if he were a director of the body.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/4/3" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/4/3" id="regulation-4-3"><Pnumber>3</Pnumber><P2para><Text>If an offence under these Regulations committed by a partnership is shown—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/4/3/a" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/4/3/a" id="regulation-4-3-a"><Pnumber>a</Pnumber><P3para><Text>to have been committed with the consent or connivance of any partner, or any person who was purporting to act as a partner, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/4/3/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/4/3/b" id="regulation-4-3-b"><Pnumber>b</Pnumber><P3para><Text>to be attributable to any neglect on his part,</Text></P3para></P3><Text>he as well as the partnership shall be guilty of the offence and shall be liable to be proceeded against and punished accordingly.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/4/4" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/4/4" id="regulation-4-4"><Pnumber>4</Pnumber><P2para><Text>If an offence under these Regulations committed by an unincorporated IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/4/4/a" id="regulation-4-4-a"><Pnumber>a</Pnumber><P3para><Text>to have been committed with the consent or connivance of an officer of the association or a member of its governing body, or any person who was purporting to act in any such capacity, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/3948/regulation/4/4/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/3948/regulation/4/4/b" id="regulation-4-4-b"><Pnumber>b</Pnumber><P3para><Text>to be attributable to any neglect on his part,</Text></P3para></P3><Text>he as well as the association shall be guilty of the offence and shall
