The Children (Leaving Care) Act 2000 (Commencement No. 1) (England) Order 2001

The Secretary of State for Health, in exercise of the power conferred on him by section 8(2) of the Children (Leaving Care) Act 2000(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation

1.—(1) This Order may be cited as the Children (Leaving Care) Act 2000 (Commencement No. 1) (England) Order 2001.

(2) This Order extends to England only.

Appointed Day

2.  1st October 2001 is the day appointed for the coming into force of sections 1 to 5, and 7(1) to (4) of the Children (Leaving Care) Act 2000.

Explanatory Note

(This note is not part of the Order)

This Order brings into force the Children (Leaving Care) Act 2000 (“the Act”) apart from section 6 (exclusion from benefits) in relation to England, on 1st October 2001. The provisions brought into force amend the Children Act 1989 (c. 41) as respects the arrangements to be made for the care and support of children who are, or have been looked after by local authorities.

This is the first commencement order to be made in England. Sections 1 to 5 and 7(1) to (4) have been brought into force in Wales by the Children (Leaving Care) Act 2000 (Commencement No. 1) (Wales) Order 2001 (SI 2001 No. 2191) (W. 153) (C. 71).

2000 c. 35. The power is exercisable, as respects section 6, by the Secretary of State alone, and as respects the remaining provisions, in relation to England by the Secretary of State and in relation to Wales, the National Assembly for Wales.
