The 1995 Regulations implement Council Directive 91/414/EEC concerning the placing of plant protection products on the market, as amended, in relation to Great Britain.</dc:description>

Regulations 2001, come into force on 1st August 2001 and extend to Great Britain.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/2477/regulation/1/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/2477/regulation/1/2" id="regulation-1-2"><Pnumber>2</Pnumber><P2para><Text>In these Regulations—</Text></P2para></P2><UnorderedList Decoration="none"><ListItem><Para><Text>“the 1991 Directive” means Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1991/0414" id="c00001" Class="EuropeanEconomicCommunityDirective" Year="1991" Number="414">91/414/EEC</Citation> concerning the placing of plant protection products on the market <CommentaryRef Ref="c15604461"/> amended as listed <CommentaryRef Ref="c15604471"/> in the definition of ’the Directive’ in the 1995 Regulations;</Text></Para></ListItem><ListItem><Para><Text>“the 1995 Regulations” means the Plant Protection Products Regulations 1995 <CommentaryRef Ref="c15604481"/>;</Text></Para></ListItem><ListItem><Para><Text>“data” means scientific evidence submitted in support of application under the 1995 Regulations;</Text></Para></ListItem><ListItem><Para><Text>“the Schedule” means the Schedule to these Regulations;</Text></Para></ListItem></UnorderedList><Text>and any reference in the Schedule to an identified item or an identified note refers to the item or note so identified in the Schedule.</Text></P1para></P1></P1group><P1group RestrictStartDate="2001-08-01"><Title> Fees in connection with applications under the Plant Protection Products Regulations 1995</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/2477/regulation/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/2477/regulation/2" id="regulation-2"><Pnumber>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/2477/regulation/2/1" IdURI="http://www.legislation.gov.uk/id/uksi/2001/2477/regulation/2/1" id="regulation-2-1"><Pnumber>1</Pnumber><P2para><Text>An applicant under regulation 4 (active substances) or 10 (extensions) of, or for an approval under, the 1995 Regulations shall pay a fee to the Secretary of State in accordance with this regulation, and so shall—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/2477/regulation/2/1/a" IdURI="http://www.legislation.gov.uk/id/uksi/2001/2477/regulation/2/1/a" id="regulation-2-1-a"><Pnumber>a</Pnumber><P3para><Text>a person making a request under regulation 13(7)(b) (modifications) of the 1995 Regulations, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2001/2477/regulation/2/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/2001/2477/regulation/2/1/b" id="regulation-2-1-b"><Pnumber>b</Pnumber><P3para><Text>a person making a request to the Secretary of State for initial or renewed official recognition of a testing facility under paragraph 2.2 or 2.3 of Annex III to the 1991 Directive,</Text></P3para></P3><Text>and for the purposes of these Regulations either such person shall count as an applicant and his request as an application.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/2477/regulation/2/2" IdURI="http://www.legislation.gov.uk/id/uksi/2001/2477/regulation/2/2" id="regulation-2-2"><Pnumber>2</Pnumber><P2para><Text>The fee is the total of the amounts specified in the Table in the Schedule, as read with the notes, for each type of examination or related activity called for by the application, but if a lower sum (following consideration of actual work involved in examining any relevant application) is notified as the fee by the Secretary of State to the applicant then the fee is the lower sum in question.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/2477/regulation/2/3" IdURI="http://www.legislation.gov.uk/id/uksi/2001/2477/regulation/2/3" id="regulation-2-3"><Pnumber>3</Pnumber><P2para><Text>Payment shall, to the extent not previously made by the applicant, be made in accordance with any invoice for the fee (or the balance) sent to the applicant by the Secretary of State, and the Secretary of State shall be under no obligation to process the application so long as there is a failure to make any such payment.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2001/2477/regulation/2/4" IdURI="http://www.legislation.gov.uk/id/uksi/2001/2477/regulation/2/4" id="regulation-2-4"><Pnumber>4</Pnumber><P2para><Text>On completion of all examinations and related activities involved in processing the application, any difference between what has been paid and the fee shall be paid or refunded.</Text></P2para></P2><P2 id="regulation-2-5"><Pnumber>5</Pnumber><P2para><Text>Any amount due under this regulation but unpaid is recoverable on demand in writing sent to the person from whom it is id="regulation-2-6"><Pnumber>6</Pnumber><P2para><Text>In any proceedings relating to an application under these Regulations, a certificate of the Secretary of State as to the amount payable in of the 1995 Regulations with the exception of a subsequent application (that is to say, an application under regulation 7 where there is already an approval for a product containing the active substance covered by the application and the applicant has access to data relating to the active substance covered by the approval in question).</Text></P1para></P1><P1 id="schedule-paragraph-24"><Pnumber>24</Pnumber><P1para><Text>A full data package comprises the total dossier called for by Annex II, Annex III, or both, to the 1991 Directive, and percentages of it are based on the value of expert time called for in assessing a resubmitted application.</Text></P1para></P1><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/2477/schedule/paragraph/25" IdURI="http://www.legislation.gov.uk/id/uksi/2001/2477/schedule/paragraph/25" RestrictStartDate="2001-08-01" id="schedule-paragraph-25"><Pnumber>25</Pnumber><P1para><Text>A resubmitted application is one where a previous application for approval has been unsuccessful, and a new aplication is made in an attempt to address all the concerns raised from that earlier application.</Text></P1para></P1><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/2477/schedule/paragraph/26" IdURI="http://www.legislation.gov.uk/id/uksi/2001/2477/schedule/paragraph/26" RestrictStartDate="2001-08-01" id="schedule-paragraph-26"><Pnumber>26</Pnumber><P1para><Text>A very small data package comprises data which are submitted to complete the material required to enable a full data package to be re-evaluated and which contain fewer than 10 separate studies.</Text></P1para></P1><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2001/2477/schedule/paragraph/27" IdURI="http://www.legislation.gov.uk/id/uksi/2001/2477/schedule/paragraph/27" RestrictStartDate="2001-08-01" id="schedule-paragraph-27"><Pnumber>27</Pnumber><P1para><Text>Annex III to the 1991 Directive requires that the tests and analyses of the efficacy data be conducted only by officially recognised testing facilities or organisations which are found to satisfy the requirements of the The 1995 Regulations implement Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1991/0414" id="c00002" Class="EuropeanEconomicCommunityDirective" Year="1991" Number="414">91/414/EEC</Citation> concerning the placing of plant protection products on the market, as amended, in relation to Great Britain.</Text></Para></BlockText></P><P><BlockText><Para><Text>These Regulations introduce a new fee structure largely based on a modular approach founded on component examination elements, depending on the extent of examination called for by the type of application as well as the statutory examination function involved. The fee modules (Item A in the Table within the Schedule) are categorised into an initial preliminary examination charge, a basic examination charge and charges for specialist evaluations.</Text></Para></BlockText></P><P><BlockText><Para><Text>This new approach is not however to be applied to fees related to applications for products containing new active substances under Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1991/0414" id="c00003" Class="EuropeanEconomicCommunityDirective" Year="1991" Number="414">91/414/EEC</Citation>, (Item B in the Table within the Schedule) where each such application requires examination of a full dossier of data and other information. Resubmission of such an application for approval where an earlier application has been unsuccesful involves a tiered, tapering fee dependent on the relevant percentage of the full data package required for the unsuccessful application.
