Income support, jobseeker’s allowance, housing benefit and council tax benefit: capital disregard2There shall be added as—aparagraph 61 of Schedule 10 to the Income Support (General) Regulations 1987 (capital to be disregarded);bparagraph 56 of Schedule 8 to the Jobseeker’s Allowance Regulations 1996 ;cparagraph 64 of Schedule 5 to the Council Tax Benefit (General) Regulations 1992;dparagraph 64 of Schedule 5 to the Housing Benefit (General) Regulations 1987,the following paragraph—Where an ex-gratia payment of £10,000 has been made by the Secretary of State on or after 1st February 2001 in consequence of the imprisonment or internment of—athe claimant;bthe claimant’s partner;cthe claimant’s deceased spouse; ordthe claimant’s partner’s deceased spouse,by the Japanese during the Second World War, £10,000.. These Regulations amend the Income Support (General) Regulations 1987 (S.I.1987/1967), the Jobseeker’s Allowance Regulations 1996 (S.I.1996/207), the Housing Benefit (General) Regulations 1987 (S.I.1987/1971) and the Council Tax Benefit (General) Regulations 1992 (S.I.1992/1814).

In particular, regulation 2 provides that ex-gratia payments of £10,000 made on or after 1st February 2001 by the Secretary of State in consequence of a person’s imprisonment or internment by the Japanese during the Second World War, shall be disregarded as capital when ascertaining entitlement to those benefits.

These Regulations do not impose a charge on business.
