The Secretary of State for Education and Employment, in exercise of the powers conferred on the Secretary of State by sections 22, 42(6) and 43(1) of the Teaching and Higher Education Act 1998(1), hereby makes the following Regulations:

1.  These Regulations may be cited as the Education (Student Support) Regulations 2001 (Amendment) Regulations 2001 and shall come into force on 25th May 2001.

2.  The Education (Student Support) Regulations 2001(2) shall be amended as follows.

3.  In regulation 5—

(a)in paragraph (2) substitute for the figure “19” the figure “18”; and

(b)after paragraph (2) insert the following paragraph:

(2A) For the purposes of paragraph (2) where periods of full-time study and work experience alternate within any week of the course the days of full-time study shall be aggregated with any weeks of full-time study in determining the number of weeks of full-time study in each year..

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which come into force on 25th May 2001, amend the Education (Student Support) Regulations 2001 (“the Student Support Regulations”). Regulation 5(2) of the Student Support Regulations is amended so that, taking the course as a whole, a sandwich course student is required to attend periods of full-time study for an average of at least 18 instead of 19 weeks in each year (regulation 3(a)). A new paragraph is inserted in regulation 5 of the Student Support Regulations to provide that where periods of full-time study and work experience alternate within any week of a sandwich course, the days of full-time study shall be aggregated with any weeks of full-time study in determining the number of weeks of full-time study in each year (regulation 3(b)).
