(Earnings) Regulations 2000 and shall come into force on 2nd April 2000.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/1/2" 2001;</Substitution></Text></Para></ListItem><ListItem><Para><Text>“the Contributions and Benefits Act" means the Social Security Contributions and Benefits Act 1992;</Text></Para></ListItem><ListItem><Para><Text>“test period" means the period of 66 weeks specified in section 35(1)(b) of the Contributions and Benefits Act.</Text></Para></ListItem></UnorderedList></P1para></P1></P1group><P1group RestrictStartDate="2025-04-06" RestrictExtent="E+W+S"><Title> Specified payments for employed earners</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/2" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/2" id="regulation-2"><Pnumber>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/2/1" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/2/1" id="regulation-2-1"><Pnumber>1</Pnumber><P2para><Text>Subject to paragraph (2), for the purposes of section 35A(4)(a) of the Contributions and Benefits Act, the payments specified for a woman who is an employed earner in any week falling within the test period shall be all payments made to her or for her benefit as an employed earner including–</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/2/1/za" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/2/1/za" id="regulation-2-1-za"><Pnumber><Addition ChangeId="key-51e25033556fe0aa9abace4bfe37f3d6-1" CommentaryRef="key-51e25033556fe0aa9abace4bfe37f3d6">za</Addition></Pnumber><P3para><Text><Addition ChangeId="key-51e25033556fe0aa9abace4bfe37f3d6-1" CommentaryRef="key-51e25033556fe0aa9abace4bfe37f3d6">any amount retrospectively treated as earnings by regulations made by virtue of section 4B(2) of the Contributions and Benefits Act,</Addition></Text><Text/></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/2/1/a" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/2/1/a" id="regulation-2-1-a"><Pnumber>a</Pnumber><P3para><Text>any sum payable in respect of arrears of pay in pursuance of an order for reinstatement under section 114 or re-engagement under section 115 of the Employment Rights Act 1996 (orders for reinstatement and re-engagement) <CommentaryRef Ref="c1619497"/>;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/2/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/2/1/b" id="regulation-2-1-b"><Pnumber>b</Pnumber><P3para><Text>any sum payable by way of pay in pursuance of an order made under section 129 of the Employment Rights Act 1996 (procedure on hearing of application and making of order) for the continuation of a contract of employment;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/2/1/c" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/2/1/c" id="regulation-2-1-c"><Pnumber>c</Pnumber><P3para><Text>any sum payable by way of remuneration in pursuance of a protective award under section 189 of the Trade Union and Labour Relations (Consolidation) Act 1992 (complaint.................... and protective award) <CommentaryRef Ref="c1619498"/>;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/2/1/d" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/2/1/d" id="regulation-2-1-d"><Pnumber>d</Pnumber><P3para><Text>any sum payable by way of statutory sick pay, including sums payable in accordance with regulations made under section 151(6) of the Contributions and Benefits Act (employers’ liability) <CommentaryRef Ref="c1619499"/>;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/2/1/e" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/2/1/e" id="regulation-2-1-e"><Pnumber>e</Pnumber><P3para><Text>any sum payable by way of statutory maternity pay, including sums payable in accordance with regulations made under section 164(9)(b) of the Contributions and Benefits Act <CommentaryRef Ref="c1619500"/>.</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/2/1/f" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/2/1/f" id="regulation-2-1-f"><Pnumber><Addition payable in accordance with regulations made under section 171ZZ8(3) of the Contributions and Benefits Act</Addition><Addition ChangeId="key-8029f1545750cfee03e0d0a7308b9763-1747130727218" CommentaryRef="key-8029f1545750cfee03e0d0a7308b9763">;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/2/j" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/2/j" id="regulation-2-j"><Pnumber><Addition ChangeId="key-8029f1545750cfee03e0d0a7308b9763-1747130727218" CommentaryRef="key-8029f1545750cfee03e0d0a7308b9763">any sum payable by way of statutory neonatal care pay, including any sums payable in accordance with regulations made under section 171ZZ18(3) of the Contributions and Benefits Act.</Addition></Text></P3para></P3><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/2/2" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/2/2" id="regulation-2-2"><Pnumber>2</Pnumber><P2para><Text>The payments specified shall not include any sum excluded from the computation of a person’s earnings under regulation <Substitution ChangeId="key-bce0c2e290518072c9afead30ff3c177-2" CommentaryRef="key-bce0c2e290518072c9afead30ff3c177">25, 27 or 123 of, or Schedule 3 to,</Substitution> the Contributions Regulations (payments to be disregarded).</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2015-04-06"><Title> Specified payments for self-employed earners</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/3" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/3" id="regulation-3"><Pnumber>3</Pnumber><P1para><Text>For the purposes of section 35A(4)(b) of the Contributions and Benefits Act, where a woman is a self-employed earner in any week falling within the test period, the payments treated as made to her or for her benefit shall be–</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/3/a" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/3/a" id="regulation-3-a"><Pnumber>a</Pnumber><P3para><Text>a payment equal to <Substitution ChangeId="key-c495e84d8d597c595fcfd22c185395f2-2" CommentaryRef="key-c495e84d8d597c595fcfd22c185395f2">an amount 90 per cent. of which is equal to the weekly rate prescribed under section 166(1)(b) of the Contributions and Benefits Act that is in force</Substitution> on the last day of that week where she has paid a Class 2 contribution <CommentaryRef Ref="key-2f0a12edbc835a5ef4e002c8aaeded40"/>...; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/3/b" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/3/b" id="regulation-3-b"><Pnumber>b</Pnumber><P3para><Text>a payment equal to the maternity allowance threshold in force on the last day of that week <Substitution ChangeId="key-5bb42e0c17d1641d860cf4bd2e802ead-1434617603651" CommentaryRef="key-5bb42e0c17d1641d860cf4bd2e802ead">if she could have paid but has not paid such a contribution</Substitution> in respect of that week.</Text></P3para></P3></P1para></P1></P1group><P1group RestrictStartDate="2014-01-01"><Title> Aggregation of specified payments</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/4" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/4" id="regulation-4"><Pnumber>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2000/688/regulation/4/1" IdURI="http://www.legislation.gov.uk/id/uksi/2000/688/regulation/4/1" id="regulation-4-1"><Pnumber>1</Pnumber><P2para><Text>In a case <CommentaryRef Ref="key-90dd8fa830d4fe2095344ca99da9c13f"/>... where a woman, either in the same week or in different weeks falling within the test period, is engaged in two or more employments (whether, in each case, as an employed earner or a self-employed earner), any payments which are made, or treated in accordance with these Regulations as made to her or for her benefit shall be aggregated for the purpose of determining the average weekly amount of specified payments applicable in her case.</Text></P2para></P2><P2 of the period specified in regulation 5 above which includes a sum in respect of any week falling within that period, her average weekly amount of specified payments shall be determined as if such sum CommentaryRef="key-4b88739626d9197397f800c9a2c9f108">the woman’s earnings are lower than they would otherwise have been as a result of that woman being a furloughed weekly amount of the specified payments are to be determined as if for that week she were paid the amount she would have derived from her employment had she not been a furloughed arising from the health, social and economic emergency in the United Kingdom resulting from coronavirus and coronavirus disease and contained in such Directions as may be issued from time to time
