As regards Wales, the functions of the Secretary of State under the above mentioned powers are transferred to the National Assembly for Wales under article 2(a) of the National Assembly for Wales (Transfer of Functions) Order 1999 <ref eId="c00005" href="http://www.legislation.gov.uk/id/uksi/1999/672">S.I. 1999/672</ref> as amended by section 66(5) of the <abbr title="Health Act 1999 c. 8">1999 Act</abbr>; this Order therefore only extends to England.</p></authorialNote> and of all other powers enabling him in that behalf, it appearing to him that the functions of the Special Trustees for the Former United Sheffield Hospitals<authorialNote class="footnote" eId="f00002" marker="2"><p>See section 95 of the National Health Service Act 1977.</p></authorialNote> should be discharged by the trustees for the Central Sheffield University Hospitals, the Community Health Sheffield, the Northern General Hospital and the Sheffield Children’s Hospital National Health Service Trusts<authorialNote class="footnote" eId="f00003" marker="3"><p>See section 11 of the <abbr title="National Health Service and Community Care Act 1990 c. 19">1990 Act</abbr> and <ref eId="c00006" href="http://www.legislation.gov.uk/id/uksi/2000/212">S.I. 2000/212</ref>.</p></authorialNote> and having consulted the said Special Trustees and the trustees for the said National Health Service trusts, hereby makes the following Order:</p></formula></preamble><body><article eId="article-2n1"><heading>Citation, commencement and interpretation</heading><num>2.</num><paragraph eId="article-2-1n1"><num>(1)</num><content><p>This Order may be cited as the Special Trustees for the Former United Sheffield Hospitals (Transfers of Trust Property) Order 2000 and shall come into force on 1st April 2000.</p></content></paragraph><paragraph eId="article-2-2n1"><num>(2)</num><content><p>In this Order—</p><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>“the new trustees” means—</p><blockList class="ordered alpha parens" ukl:Name="OrderedList" ukl:Type="alpha" ukl:Decoration="parens"><item><num>(a)</num><p>in relation to the trust property specified in the schedule of trust property, dated 7th March 2000, prepared by, agreed upon by and signed on behalf of the Special Trustees and the trustees for the Central Sheffield University Hospitals National Health Service Trust, the trustees for that trust,</p></item><item><num>(b)</num><p>in relation to the trust property specified in the schedule of trust property, dated 7th March 2000, prepared by, agreed upon by and signed on behalf of the Special Trustees and the trustees for the Community Health Sheffield National Health Service Trust, the trustees for that trust,</p></item><item><num>(c)</num><p>in relation to the trust property specified in the schedule of trust property, dated 7th March 2000, prepared by, agreed upon by and signed on behalf of the Special Trustees and the trustees for the Northern General Hospital National Health Service Trust, the trustees for that trust,</p></item><item><num>(d)</num><p>in relation to the trust property specified in the schedule of trust property, dated 7th March 2000, prepared by, agreed upon and signed on behalf of the Special Trustees and the trustees for the Sheffield Children’s Hospital National Health Service Trust, the trustees for that trust;</p></item></blockList></item><item><p>“the Special Trustees” means the Special Trustees for the Former United Sheffield Hospitals;</p></item><item><p>“the trust property” means—</p><blockList class="ordered alpha parens" ukl:Name="OrderedList" ukl:Type="alpha" ukl:Decoration="parens"><item><num>(a)</num><p>in relation to the trustees for the Central Sheffield University Hospitals National Health Service Trust, the property specified in the aforementioned schedule of trust property signed on behalf of the Special Trustees and those trustees,</p></item><item><num>(b)</num><p>in relation to the trustees for the Community Health Sheffield National Health Service Trust, the property specified in the aforementioned schedule of trust property signed on behalf of the Special Trustees and those trustees,</p></item><item><num>(c)</num><p>in relation to the trustees for the Northern General Hospital National Health Service Trust, the property specified in the aforementioned schedule of trust property signed on behalf of the Special Trustees and those trustees,</p></item><item><num>(d)</num><p>in relation to the trustees for the Sheffield Children’s Hospital National Health Service Trust, the property specified in the aforementioned schedule of trust property signed on behalf of the Special Trustees and those trustees.</p></item></blockList></item></blockList></content></paragraph></article><article eId="article-2n2"><heading>Transfer of trust property</heading><num>2.</num><paragraph eId="article-2-1n2"><num>(1)</num><content><p>On 1st April 2000 the trust property, and any rights and liabilities arising from that property<authorialNote class="footnote" eId="f00004" marker="4"><p>See section 96(1) of the <abbr title="National Health Service Act 1977 c. 49">1977 Act</abbr> as amended by paragraph 29 of Schedule 4 to the <abbr title="Health Act 1999 c. 8">1999 Act</abbr>.</p></authorialNote>, shall be transferred from the Special Trustees to the new trustees.</p></content></paragraph><paragraph eId="article-2-2n2"><num>(2)</num><content><p>In any trust instrument relating to the trust property, any reference to the name by which the trustees of the trust property are to be known shall be construed as a reference to the new trustees and any reference to the Special Trustees in the name by which the charitable trust governing the trust property is to be known shall be construed as a reference to the National Health Service trust for which the new
