<Pnumber>1</Pnumber>
<P2para>
<Text>This article shall apply instead of section 8(1) of the <Abbreviation Expansion="Compulsory Purchase Act 1965 c. 56">1965 Act</Abbreviation> (as applied by article 11 above) in any case where—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/428/article/16/1/a/made" IdURI="http://www.legislation.gov.uk/id/uksi/2000/428/article/16/1/a" id="article-16-1-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>a notice to treat is served on a person (“the owner”) under the 1965 Act (as so applied) in respect of land forming only part of a house, building or factory or of land consisting of a house with a park or garden (“the land subject to the notice to treat”); and</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/428/article/16/1/b/made" IdURI="http://www.legislation.gov.uk/id/uksi/2000/428/article/16/1/b" id="article-16-1-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>a copy of this article is served on the owner with the notice to treat.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/uksi/2000/428/article/16/2/made" IdURI="http://www.legislation.gov.uk/id/uksi/2000/428/article/16/2" id="article-16-2">
<Pnumber>2</Pnumber>
<P2para>
<Text>In such a case, the owner may, within the period of 21 days beginning with the day on which the notice was served, serve on <Abbreviation Expansion="Knowsley Metropolitan Borough Council">the Council</Abbreviation> a counter-notice objecting to the sale of the land subject to the notice to treat and stating that he is willing and able to sell the whole (“the land subject to the counter-notice”).</Text>

</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/uksi/2000/428/article/16/3/made" IdURI="http://www.legislation.gov.uk/id/uksi/2000/428/article/16/3" id="article-16-3">
<Pnumber>3</Pnumber>
<P2para>
<Text>If no such counter-notice is served within that period, the owner shall be required to sell the land subject to the notice to treat.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/uksi/2000/428/article/16/4/made" IdURI="http://www.legislation.gov.uk/id/uksi/2000/428/article/16/4" id="article-16-4">
<Pnumber>4</Pnumber>
<P2para>
<Text>If such a counter-notice is served within that period, the question whether the owner shall be required to sell only the land subject to the notice to treat shall, unless the Council agrees to take the land subject to the counter-notice, be referred to <Abbreviation Expansion="Lands Tribunal">the tribunal</Abbreviation>.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/uksi/2000/428/article/16/5/made" IdURI="http://www.legislation.gov.uk/id/uksi/2000/428/article/16/5" id="article-16-5">
<Pnumber>5</Pnumber>
<P2para>
<Text>If on such a reference the tribunal determine that the land subject to the notice to treat can be taken—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/428/article/16/5/a/made" IdURI="http://www.legislation.gov.uk/id/uksi/2000/428/article/16/5/a" id="article-16-5-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>without material detriment to the remainder of the land subject to the counter-notice; or</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/428/article/16/5/b/made" IdURI="http://www.legislation.gov.uk/id/uksi/2000/428/article/16/5/b" id="article-16-5-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>in the case of part of land consisting of a house with a park or garden, without material detriment to the remainder of the land subject to the counter-notice and without seriously affecting the amenity and convenience of the house;</Text>
</P3para>
</P3>
<Text>the owner shall be required to sell the land subject to the notice to treat.</Text>
</P2para>
</P2>

<Pnumber>6</Pnumber>
<P2para>
<Text>If on such a reference the tribunal determine that only part of the land subject to the notice to treat can be taken—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>without material detriment to the remainder of the land subject to the counter-notice; or</Text>
</P3para>
</P3>

<Pnumber>b</Pnumber>
<P3para>
<Text>in the case of part of land consisting of a house with a park or garden, without material detriment to the remainder of the land subject to the counter-notice and without seriously affecting the amenity and convenience of the house;</Text>
</P3para>
</P3>
<Text>the notice to treat shall be deemed to be a notice to treat for that part.</Text>
</P2para>
</P2>

<Pnumber>7</Pnumber>
<P2para>
<Text>If on such a reference the tribunal determine that—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/428/article/16/7/a/made" IdURI="http://www.legislation.gov.uk/id/uksi/2000/428/article/16/7/a" id="article-16-7-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>the land subject to the notice to treat cannot be taken without material detriment to the remainder of the land subject to the counter-notice; but</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/428/article/16/7/b/made" IdURI="http://www.legislation.gov.uk/id/uksi/2000/428/article/16/7/b" id="article-16-7-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>the material detriment is confined to a part of the land subject to the counter-notice;</Text>
</P3para>
</P3>
<Text>the notice to treat shall be deemed to be a notice to treat for the land to which the material detriment is confined in addition to the land already subject to the notice, whether or not the additional land is land which the Council is authorised to acquire compulsorily under this Order.</Text>
</P2para>
</P2>

<Pnumber>8</Pnumber>
<P2para>
<Text>If the Council agrees to take the land subject to the counter-notice, or if the tribunal determine that—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/428/article/16/8/a/made" IdURI="http://www.legislation.gov.uk/id/uksi/2000/428/article/16/8/a" id="article-16-8-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>none of the land subject to the notice to treat can be taken without material detriment to the remainder of the land subject to the counter-notice or, as the case may be, without material detriment to the remainder of the land subject to the counter-notice and without seriously affecting the amenity and convenience of the house; and</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2000/428/article/16/8/b/made" IdURI="http://www.legislation.gov.uk/id/uksi/2000/428/article/16/8/b" id="article-16-8-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>that the material detriment is not confined to a part of the land subject to the counter-notice;</Text>
</P3para>
</P3>
<Text>the notice to treat shall be deemed to be a notice to treat for the land subject to the counter-notice whether or not the whole of that land is land which the Council is authorised to acquire compulsorily under this Order.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/uksi/2000/428/article/16/9/made" IdURI="http://www.legislation.gov.uk/id/uksi/2000/428/article/16/9" id="article-16-9">
<Pnumber>9</Pnumber>
<P2para>
<Text>In any case where by virtue of a determination by the tribunal under this article a notice to treat is deemed to be a notice to treat for less land or more land than that specified in the notice, the Council may, within the period of 6 weeks beginning with the day on which the determination is made, withdraw the notice to treat; and, if it does so, shall pay to the owner compensation for any loss or expense occasioned to him by the giving and withdrawal of the notice, to be determined in case of dispute by the tribunal.</Text>

</P2>

<Pnumber>10</Pnumber>
<P2para>
<Text>Where the owner is required under this article to sell only part of a house, building or factory or of land consisting of a house with a park or garden, the Council shall pay him compensation for any loss sustained by him due to the severance of that part in addition to the value of the interest acquired.</Text>
</P2para>
