The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred on him by section 143(1) and (2) of, and paragraphs 4 and 6 of Schedule 8 to, the Local Government Finance Act 19881 and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement1.

These Regulations may be cited as the Non-Domestic Rating Contributions (England) (Amendment) Regulations 2000 and shall come into force on 31st December 2000.

Amendment of the 1992 Regulations2.

Schedules 1 and 2 to the Non-Domestic Rating Contributions (England) Regulations 19922 are amended as follows in relation to financial years beginning on or after 1st April 2001.

Rules for calculation of contributions3.

In Schedule 1—

(a)

in paragraph 1(4), for “2000” there is substituted “2001”;

(b)

in paragraph 4(4), for “2000 is £83,476,000” there is substituted “2001 is £83,597,000”;

(c)

for Part II there is substituted—

Assumptions relating to provisional amounts4.

In relation to financial years beginning on or after 1st April 2001, in Schedule 2—

(a)

for paragraph 2(12) there is substituted the following—

“(12)

It shall be assumed that the amount calculated for the authority in accordance with the assumptions prescribed in sub-paragraphs (1) to (11) above is the total of the amount so calculated multiplied by 0.977.”;

(b)

for the table in paragraph 8(1) there is substituted the following—

(This note is not part of the Regulations)

Under Part II of Schedule 8 to the Local Government Finance Act 1988, billing authorities are required to pay amounts (called non-domestic rating contributions) to the Secretary of State. Payments in respect of a provisional amount of the contributions are made during the financial year, final calculations and any adjustments of payments being made after the year ends.

These Regulations amend the rules for calculation of contributions contained in the Non-Domestic Rating Contributions (England) Regulations 1992, with effect from 1st April 2001 by altering certain figures used in the calculations.
