<Text>These Regulations may be cited as the Judicial Pensions Act 1981 (Amendment) Regulations 2000 and shall come into force on 1st December 2000.</Text>

<Title>Amendments to the Judicial Pensions Act 1981</Title>

<Text>The following shall be inserted after section 29A of the Judicial Pensions Act 1981<FootnoteRef Ref="f00002"/>—</Text>

<Title>Pension credits: restriction on payments</Title>

<Pnumber>1</Pnumber>
<P2para>
<Text>The appropriate Minister shall have no power to accept, for the benefit of a member of a judicial pension scheme constituted under or by virtue of this Act—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>a payment under paragraph 1(3) of Schedule 5 to the Welfare Reform and Pensions Act 1999,</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>a payment under section 95 of the Pension Schemes Act 1993<FootnoteRef Ref="f00003"/>, or</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>any other payment,</Text>
</P3para>
</P3>
<Text>to the extent that that payment directly or indirectly represents a pension credit.</Text>

<Text>In this section “the appropriate Minister” means—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>in relation to any judicial office whose jurisdiction is exercised exclusively in relation to Scotland, the Secretary of State; or</Text>

<Pnumber>b</Pnumber>
<P3para>
<Text>subject to paragraph (a), the Lord Chancellor.</Text>
