<Title>Amendment of regulation 1(2) of the principal Regulations</Title>

<Title>Substitution of regulation 3 of the principal Regulations</Title>

<Text>For regulation 3 of the principal Regulations there shall be substituted the following regulation—</Text>

<Title>Child in residential accommodation in prescribed circumstances</Title>

<Text>The prescribed circumstances for the purposes of section 143(3)(c) of the Benefits Act (absence of child disregarded if in residential accommodation pursuant to certain provisions) are any circumstances in which a child is in residential accommodation pursuant to arrangements made under—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>where the child has attained the age of 18, section 21 of the National Assistance Act 1948<FootnoteRef Ref="f00008"/> or under section 12 of the Social Work (Scotland) Act 1968<FootnoteRef Ref="f00009"/>; or</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>the provisions specified in paragraph (2),</Text>
</P3para>
</P3>
<Text>and such accommodation has been provided solely on account of that child’s disability or because his health would be likely to be significantly impaired, or further impaired, unless such accommodation was provided.</Text>
</P2para>
</P2>
<P2>

<Text>The provisions specified for the purposes of paragraph (1)(b) are—</Text>

<Text>in which training for that child is being provided under a relevant training scheme; and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>in respect of which an allowance may be paid under such a scheme to that child.</Text>

<Text>Child benefit shall not be payable in respect of a child by virtue of section 142(1)(c) of the Benefits Act for any week in respect of which that child receives—</Text>

<Text>income support;</Text>

<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>an income-based jobseeker’s allowance within the meaning of section 1(4) of the Jobseekers Act 1995<FootnoteRef Ref="f00016"/>; or</Text>

</P3>

<Pnumber>c</Pnumber>
<P3para>
<Text>incapacity benefit by virtue of being a person to whom section 30A(1)(b) of the Benefits Act<FootnoteRef Ref="f00017"/> applies.</Text>

<Title>Amendment of regulation 7D of the principal Regulations</Title>

<Text>In regulation 7D of the principal Regulations<FootnoteRef Ref="f00018"/> (circumstances in which a person who has ceased to receive full-time education is to be treated as a child)—</Text>

<Text>For paragraph (5) there shall be substituted the following paragraphs—</Text>

<Text>Subject to paragraph (5A), for the purposes of paragraph 1(c) of Schedule 9 to the Benefits Act (child in care of a local authority in such circumstances as may be prescribed), the prescribed circumstances are that the child is provided with, or placed in, accommodation under Part III of the 1989 Act or under Part II of the 1995 Act and the cost of that child’s accommodation or maintenance is borne wholly or partly out of local authority funds or any other public funds.</Text>

<Text>Paragraph (5) shall only apply to the extent that the child is not in residential accommodation in the circumstances prescribed in regulation 3.</Text>

<Text>These Regulations amend the Child Benefit (General) Regulations 1976 (<Acronym Expansion="Statutory Instrument">S.I.</Acronym> <Citation URI="http://www.legislation.gov.uk/id/uksi/1976/965" id="c00001" Class="UnitedKingdomStatutoryInstrument" Year="1976" Number="0965">1976/965</Citation>) (“the principal Regulations”).</Text>
</P>
<P>
<Text>In particular, these Regulations—</Text>
</P>
<P>
<Text>provide new definitions of various Acts referred to in the principal Regulations (regulation 2(a));</Text>
</P>
<P>
<Text>replace references in the principal Regulations to youth training scheme with references to a relevant training scheme (regulations 2(b), 4, 5 and 7(a));</Text>
</P>
<P>
<Text>prescribe circumstances where a child’s absence in residential accommodation pursuant to certain provisions is to be disregarded (regulation 3);</Text>
</P>
<P>
<Text>provide that child benefit shall not be payable in respect of a child who satisfies certain conditions of entitlement to incapacity benefit (regulations 6 and 7(c));</Text>
</P>
<P>
<Text>update references to the persons with whom a person under 18 may be registered for work or training to include those persons with whom the Secretary of State, the National Assembly for Wales or Scottish Ministers have made arrangements under specified legislation (regulation 7(b));</Text>
</P>
<P>
<Text>prescribe circumstances where child benefit is not payable in respect of a child in the care of a local authority (regulation 8);</Text>
</P>
<P>
<Text>update references to legislation in the provisions in the principal Regulations relating to the right to benefit of voluntary organisations (regulation 9).</Text>

<Text>These Regulations do not impose any charge on business.</Text>
