7. A claim for a noise payment may only be made by a person who:
(a)at the date of the claim does not have an interest which qualifies for compensation under Part I of the Land Compensation Act 1973(1) in the land on which the movable home in relation to which the noise payment is claimed is situated, or to which it is moored if it is a houseboat, and has not had any such interest at any time since the relevant date, and
(b)has been in occupation of the movable home in relation to which the noise payment is claimed as his only or main residence throughout the qualifying period.
