In this Order—

  • “the 1999 Act” means the Greater London Authority Act 1999; and

  • “specified activity” means an activity which—

    1. a

      may be carried on in the discharge of a function conferred on Transport for London by a provision of the 1999 Act specified in column (2) in relation to an item in the Schedule to this Order, of which a general description is given in column (3); and

    2. b

      where a limitation is specified in column (4) of that Schedule in relation to such an item, is carried on as so specified.

For the purposes of this Order an activity shall be taken to be carried on in the discharge of a function if it is done in relation to that function by virtue of paragraph 1(3) of Schedule 10 (incidental powers of Transport for London) or paragraph 32 of Schedule 11 to the 1999 Act (power of Transport for London to do anything necessary or expedient for the discharge of a function).

In the Schedule to this Order, “fee” does not include any charge which is made by Transport for London on terms which provide for the reimbursement of the whole or part of its costs only.
