eId="regulation-1"><heading> Citation and commencement</heading><num>1.</num><content><p>These Regulations may be cited as the Wireless Telegraphy (Exemption) (Amendment) Regulations 2000 and shall come into force on 1st May 2000.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading> Interpretation</heading><num>2.</num><content><p>In these Regulations, “the Principal Regulations" means the Wireless Telegraphy (Exemption) Regulations 1999 <noteRef href="#c16009981" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading> Amendment</heading><num>3.</num><intro><p>The Principal Regulations are hereby amended as follows–</p></intro><level class="para1" eId="regulation-3-a"><num>(a)</num><intro><p>in regulation 3(1)–</p></intro><level class="para2" eId="regulation-3-a-i"><num>(i)</num><content><p><mod>the following definition shall be inserted after the definition of <quotedText>“
                     the 1984 Act
                  ”</quotedText>–<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><p>“the Directive" means Directive <ref eId="c00001" href="http://www.legislation.gov.uk/european/directive/1999/0005">1999/5/EC</ref> of the European Parliament and of the Council on radio equipment and telecommunications terminal equipment and the mutual recognition of their conformity <noteRef href="#c16009991" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>;</p></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para2" eId="regulation-3-a-ii"><num>(ii)</num><content><p>“and" shall be deleted at the end of the definition of “station";</p></content></level><level class="para2" eId="regulation-3-a-iii"><num>(iii)</num><content><p><mod>“EN45002; and" shall be substituted for <quotedText>“
                    EN45002.
                  ”</quotedText> at the end of the definition of “test laboratory"; and</mod></p></content></level><level class="para2" eId="regulation-3-a-iv"><num>(iv)</num><content><p><mod>the following definition shall be inserted after the definition of “ test laboratory"–<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><p>“United Kingdom Radio Interface Requirement (IR)" means the interface requirement published by the Radiocommunications Agency of the Department of Trade and Industry (RA) in accordance with Article 4.1 of the Directive.</p></quotedStructure><inline name="appendText">;</inline></mod></p></content></level></level><level class="para1" eId="regulation-3-b"><num>(b)</num><content><p><mod>for regulation 4(2), there shall be substituted the following paragraph–<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="uksi" ukl:TargetClass="secondary" ukl:TargetSubClass="regulation" ukl:Context="main" ukl:Format="default"><paragraph><num>(2)</num><content><p>The exemption in paragraph (1) shall not apply to relevant apparatus which is established, installed or used to provide or to be capable of providing a wireless telegraphy link between telecommunication apparatus or a telecommunication system and other such apparatus or system, by means of which a telecommunication service is provided by way of business to another person.</p></content></paragraph></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="regulation-3-c"><num>(c)</num><intro><p>in Schedule 3–</p></intro><level class="para2" eId="regulation-3-c-i"><num>(i)</num><content><p><mod>the following definition shall be substituted for the definition of “ prescribed apparatus" in Part I–<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><p>“prescribed apparatus" means a user station as defined below and any station or apparatus described in the appropriate IR referred to in Part V of this Schedule;</p></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para2" eId="regulation-3-c-ii"><num>(ii)</num><content><p><mod>the following Part shall be substituted for Part II–<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><part><num>PART II</num><heading> ADDITIONAL TERMS, PROVISIONS AND LIMITATIONS</heading><article><heading/><num>1.</num><content><p>The prescribed apparatus shall be subject to and comply with the appropriate IR referred to in Part V of this Schedule.</p></content></article><article><heading/><num>2.</num><intro><p>Prescribed apparatus taken into service before 1st May 2000 must also comply with the Common Technical Regulations referred to in Part IV of this Schedule, and in the absence of a Common Technical Regulation applying to such apparatus, the prescribed apparatus must–</p></intro><level class="para1"><num>(a)</num><content><p>be approved by the Secretary of State under section 84 of the 1984 Act for the purposes of these Regulations;</p></content></level><level class="para1"><num>(b)</num><content><p>be approved to the ETSI standards or the draft ETSI standards referred to in Part IV as appropriate by a national administration following type testing at a test laboratory;</p></content></level><level class="para1"><num>(c)</num><content><p>comply with the requirements of MPT 1324 or MPT 1326 as appropriate in relation to prescribed apparatus taken into service before section 84 of the 1984 Act came into force <noteRef href="#c16010001" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>;
